Measures for the Administration of the Industrial Development Fund of the Ordos Comprehensive Bonded Zone

Chapter 1 General Provisions

Article 1 To comprehensively advance the Autonomous Region’s “Two Major Tasks,” thoroughly implement the “Three Fours” work agenda of Ordos City, further strengthen and standardize the management of industrial development funds for the Ordos Comprehensive Bonded Zone (hereinafter referred to as the “Comprehensive Bonded Zone”), and support and promote the construction and industrial development of the Comprehensive Bonded Zone, in accordance with the *Budget Law of the People’s Republic of China*the “Measures for the Administration of the Fiscal Budget at the Inner Mongolia Autonomous Region Level,” the “Notice of the Ordos Municipal People’s Government on the Publication of the ‘Several Policies of Ordos City to Support Industrial Development in the Comprehensive Bonded Zone’” (Ordos Municipal Government Document [2017] No. 173), and other relevant provisions, and closely focusing on the requirements of the central task of fostering a strong sense of the Chinese national community, these Measures are formulated in light of the actual development of the Comprehensive Bonded Zone.
Article 2 The term “Industrial Development Fund” as used in these Measures refers to funds allocated from the municipal general public budget and earmarked specifically for supporting industrial development in the Comprehensive Bonded Zone.
Article 3 The Comprehensive Bonded Zone Industrial Development Fund shall primarily be used for projects conducive to the industrial development of the Comprehensive Bonded Zone, such as infrastructure construction and industrial cultivation. This includes projects within the scope of the Comprehensive Bonded Zone’s industrial development plan, such as construction projects, information technology development, procurement of equipment and labor services, headquarters economy, platform economy, advanced manufacturing, technological innovation, financial services, modern service industries, shipping and logistics, cross-border e-commerce, bonded industries, and promotional and training activities for investment attraction.
Article 4 The Comprehensive Bonded Zone Industrial Development Fund shall not be used for expenditures unrelated to the industrial development of the Comprehensive Bonded Zone, including but not limited to personnel salaries, official hospitality, various bonuses, allowances, and welfare subsidies, as well as routine expenditures such as electricity and property management fees.
Article 5 The management and use of the Comprehensive Bonded Zone Industrial Development Fund shall adhere to the principles of scientific standardization, municipal guidance, zone-wide coordination, prioritization of key areas, and emphasis on performance.

Chapter II Division of Responsibilities

Article 6 The Ordos Municipal Finance Bureau (hereinafter referred to as the Municipal Finance Bureau) shall, in accordance with relevant policies and regulations of the Municipal Party Committee and Municipal Government, be responsible for the budgetary allocation of the Comprehensive Bonded Zone Industrial Development Fund, review the fund distribution plan, supervise the management and implementation of the fund, organize key performance evaluations as appropriate, and provide guidance and recommendations.
Article 7 The Ordos Airport Logistics Park Management Committee, as the entity responsible for managing the Comprehensive Bonded Zone Industrial Development Fund, shall be responsible for: formulating the annual work plan for the Industrial Development Fund; preparing guidelines for fund applications; organizing project applications and evaluations; proposing fund allocation plans; and disclosing information regarding the fund allocation plans;implementing full-process budget performance management, scientifically setting performance targets, conducting dual monitoring of the degree of performance target achievement and budget execution, promptly carrying out self-evaluations of specific project performance, and reporting the results of such self-evaluations to the Municipal Finance Bureau; jointly supervising the management and execution of the industrial development funds with the Municipal Finance Bureau; actively accepting supervision from audit, supervision, and other relevant departments; and performing other duties as required by relevant regulations.

Chapter III: Regulations on the Use of Infrastructure Construction Funds

Article 8 When the Comprehensive Bonded Zone Industrial Development Fund is used for infrastructure construction projects, the following regulations shall be followed:
    (1) Scientific Decision-Making. The establishment of projects and the use of funds must adhere to the principle of “living within our means,” comply with the “Regulations on Government Investment” and relevant provisions of the Autonomous Region, Municipal Party Committee, and Municipal Government regarding the approval of investment projects, and must undergo necessary procedures such as expert review, risk assessment, legality review, and collective decision-making.
    (2) Designated Use. Project funds shall be used strictly for the purposes specified in the project budget; they shall not be withheld, diverted, or misappropriated, and must be accounted for in a separate ledger.
    (3) Pre-Approval Review. Project budgets shall be reviewed prior to the allocation of funds, and project final accounts shall be audited before approval.
    (4) Full-Process Supervision. The relevant functional departments of the Ordos Airport Logistics Park shall conduct full-process supervision, control, and inspection of the use of construction project funds.
    (5) Performance Evaluation. Relevant functional departments of the Ordos Airport Logistics Park shall formulate performance targets, conduct self-evaluations of the achievement of performance targets and the final financial settlement of construction projects, and utilize the results of performance evaluations to track the effectiveness of project funds and provide feedback for decision-making, thereby improving the efficiency of project decision-making management and fund utilization.
Article 9 Survey, design, construction, and supervision of construction projects, as well as procurement activities for important equipment and materials related to construction, shall be carried out in accordance with the "Bidding Law of the People’s Republic of China," the "Government Procurement Law of the People’s Republic of China," and relevant national laws and regulations.

Chapter IV: Regulations on the Use of Industrial Development Funds

Article 10 Enterprises and institutions that meet the functional positioning and requirements of the Comprehensive Bonded Zone’s industrial development plan; are registered within the Airport Industrial Park; and operate on an independent accounting basis with sound financial systems and actual business operations may apply for funds through the applicant entity in accordance with the requirements of the application announcement and guidelines.
Article 11 Support for enterprises through the Comprehensive Bonded Zone Industrial Development Fund shall primarily take the forms of subsidies, interest subsidies, incentives, and guiding funds.
Article 12 The relevant competent authorities of the Ordos Airport Logistics Park shall issue specific application guidelines and review the qualifications of the applicants and the submitted materials. If the application materials are incomplete, the applicant shall be notified once of the required supplementary materials; if the requirements are met, the application shall be accepted and reviewed.
Article 13 The financial department of the Ordos Airport Logistics Park shall disburse funds in a timely manner in accordance with the review results and relevant regulations on special fund management and centralized treasury payment management.
Article 14 Applicants are responsible for the authenticity, completeness, validity, and legality of the application materials, shall bear corresponding legal liabilities, and shall use the industrial development funds in accordance with laws and regulations. In the event of violations of relevant regulations, such as fraud, falsification, or duplicate or multiple applications, the applicant’s eligibility for the policy shall be revoked, any support funds already received shall be recovered in full, and legal and regulatory liability shall be pursued.

Chapter V: Performance Management and Supervision and Inspection

Article 15 The relevant operational departments and the finance department of the Ordos Airport Logistics Park shall be responsible for summarizing and conducting performance evaluations of the use of special funds for specific projects. By the end of January each year, the Management Committee of the Airport Logistics Park shall submit to the Municipal Finance Bureau a report on the use of special funds for the previous year (including fund disbursement status, details of supported projects, effectiveness of fund utilization, existing issues, and policy recommendations), a self-assessment report on performance, and the status of carryovers and surpluses accumulated from special funds over previous years.The Municipal Finance Bureau shall organize and conduct key performance evaluations of industrial development funds at appropriate times; the evaluation results shall serve as an important reference for refining fiscal policies, budget allocations, and management improvements.
Article 16 The finance department and relevant functional departments shall strengthen the supervision and management of special funds and projects.Upon receipt of special funds, the project-bearing entity shall expedite project implementation and use all funds exclusively for approved projects in accordance with their designated purposes; it shall not arbitrarily alter the project or expand the scope of fund usage. For projects that cannot be continued in the short term due to changes in circumstances, the entity shall promptly report to the finance department and relevant business management departments of the Ordos Airport Logistics Park, and the park’s finance department shall recover the special funds in accordance with regulations; special funds not allocated to specific projects within two years shall be recovered by the Municipal Finance Bureau for centralized use.
Article 17. Project entities receiving special fund support shall be responsible for the compliance and effectiveness of the fund’s use. They shall handle accounting in accordance with relevant national financial and accounting regulations, use funds strictly in accordance with regulations, and voluntarily accept supervision and inspection by the Airport Logistics Park, as well as finance, audit, and other departments. They shall properly preserve application and review materials in accordance with relevant national archival management regulations for verification purposes.
Article 18: If relevant departments (units), enterprises, or their staff engage in acts such as using improper means to defraud funds or violating regulations in the allocation of funds during the application, review, distribution, or disbursement of special funds, or commit other illegal acts such as abuse of power, dereliction of duty, or malfeasance, they shall be held accountable in accordance with the relevant national provisions of the *Budget Law of the People’s Republic of China* and the *Law of the People’s Republic of China on Administrative Sanctions for Public Servants*the “Supervision Law of the People’s Republic of China,” and the “Regulations on Penalties and Disciplinary Actions for Fiscal Law Violations,” among other relevant national provisions; where criminal suspicion exists, the case shall be transferred to judicial authorities.

Chapter VI Supplementary Provisions

Article 19 Matters not covered by these Measures shall be implemented in accordance with relevant regulations of the State, the Autonomous Region, and Ordos City. If relevant regulations of the State, the Autonomous Region, or Ordos City are amended, the amended provisions shall apply.
Article 20 The Municipal Finance Bureau shall be responsible for interpreting these Measures, which shall take effect 30 days after the date of promulgation.
