Mianyang Municipal People's Government Implementing Opinions on Promoting the High-Quality Development of Mianyang's Construction Industry

To promote the sustained, healthy, and high-quality development of the city’s construction industry, in accordance with the “Opinions of the General Office of the State Council on Promoting the Sustained and Healthy Development of the Construction Industry” (State Council General Office Document [2017] No. 19), the “Implementation Opinions of the General Office of the People’s Government of Sichuan Province on Promoting the Sustained and Healthy Development of the Construction Industry” (Sichuan Provincial Government General Office Document [2018] No. 9), and the “Implementation Opinions of the General Office of the People’s Government of Sichuan Province on Promoting the High-Quality Development of Sichuan’s Construction Industry” (Sichuan Provincial Government General Office Document [2019] No. 54 ), and in light of our city’s actual conditions, the following implementation opinions are hereby put forward.
I. Guiding Principles Guided by Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, we will take advancing supply-side structural reform as the main thread, enhance the quality, efficiency, development potential, and brand value of the construction industry, deepen the “streamlining administration, delegating powers, and improving services” reform in the construction sector, accelerate the research, development, and application of new construction technologies, foster and develop new business models, and promoting new modes of construction organization. We will comprehensively employ policy guidance, project-driven initiatives, market cultivation, and financial incentives to support and strengthen leading construction enterprises, optimize the market development environment, enhance engineering quality and safety, promote the transformation and upgrading of the construction industry, and achieve high-quality development. II. Work Objectives To make the industry’s supporting role more prominent, accelerate the improvement of enterprises’ comprehensive strength, significantly enhance sustainable development capabilities, and accelerate the transformation and upgrading of the construction industry. We will expedite the promotion of prefabricated construction, engineering general contracting, BIM technology applications, and full-process consulting, continuously standardize the construction market order, and significantly improve the quality and safety of construction projects. Within three years, the city’s total construction output value will strive to reach 150 billion yuan, with three construction enterprises holding Special Class qualifications, 32 holding Class I general contracting qualifications, and 200 holding Class II general contracting qualifications. Among these, there will be one enterprise with an annual output value of over 10 billion yuan, three enterprises with an annual output between 5 billion and 10 billion yuan, and 10 enterprises with an annual output value between 1 billion and 5 billion yuan. Within five years, the city aims to achieve a total output value of 200 billion yuan in the construction industry, with 5 construction enterprises holding special-class qualifications, 36 first-class general contracting enterprises, and 240 second-class general contracting , of which 2 will have an annual output value of over 10 billion yuan, 5 will have an annual output value of 5–10 billion yuan, and 15 will have an annual output value of 1–5 billion yuan.
III. Main Tasks (1) Support enterprises in upgrading their qualifications. Strengthen guidance on qualification upgrades, with a focus on helping enterprises advance to Special Class and Class I general contracting qualifications. Establish a fast-track process for enterprises with good market integrity and excellent project performance, and assign dedicated personnel to provide assistance and follow-up services. (Responsible units: Municipal Housing and Urban-Rural Development Commission; governments of all counties, districts, and cities; and park management committees. The unit listed before the comma is the lead unit; the same applies below) (2) Cultivate leading backbone enterprises.Encourage capable construction enterprises to form a group of construction enterprise conglomerates through strategic alliances, mergers, or reorganizations. Support government platform companies in establishing large enterprise groups through various means such as capital injections, acquisitions, mergers and reorganizations, and joint ventures, and apply for Special Class and Class I general contracting qualifications for construction. Promote the transition from construction general contracting to engineering general contracting, and encourage units engaged in construction, surveying, design, construction, component manufacturing, building materials, and research to establish industrial alliances.(Responsible Units: Governments of all counties, districts, and cities; - 6 - Park Management Committees; Municipal Housing and Urban-Rural Development Commission; Municipal State-owned Assets Supervision and Administration Commission; Municipal Market Supervision Administration) (3) Actively attract leading enterprises. Include construction enterprise industrialization projects, headquarters, and corporate relocations within the scope of investment promotion. For Class A survey, design, and supervision enterprises from outside the city, as well as construction enterprises with Special Class or Class I general contracting qualifications that establish operations in our city, relevant functional departments should proactively (Responsible Units: Governments of all counties, districts, and cities; Industrial Park Management Committees; Municipal Economic Cooperation Bureau; Municipal Housing and Urban-Rural Development Commission; Municipal Finance Bureau; Municipal Market Supervision Administration; Municipal Transportation Bureau; Municipal Water Resources Bureau) (4) Support enterprises in expanding, strengthening, and optimizing their operations. For the top 10 enterprises in annual construction industry tax payments, the Municipal Government shall designate them as “Enterprises with Outstanding Contributions to Annual Construction Industry Tax Revenue” and grant commendations and rewards; for the top 10 enterprises in annual construction industry output value, the Municipal Government shall designate them as “Annual Leading Enterprises in the Construction Industry” and grant commendations and rewards; for the top 5 enterprises in annual social security , the municipal government will designate them as “Annual Construction Enterprises with Outstanding Contributions to Employment” and grant commendations and rewards; enterprises ranking among the top 10 in annual construction output growth for two consecutive years will be designated by the municipal government as “Construction Development and Growth-Oriented Enterprises” and granted commendations and rewards. Construction enterprises registered within our city that win national, provincial, or municipal awards for high-quality projects shall be granted rewards of 300,000 yuan, 100,000 yuan, and 50,000 yuan, respectively, by the municipal government. For those awarded national or provincial construction methods, the local government where the project is located shall grant rewards of 200,000 yuan and 50,000 yuan per method, respectively. Support for the construction industry enterprises to apply for invention patents; construction enterprises that obtain domestic invention patent authorization in the current year shall receive a reward of 20,000 yuan per patent from the local government where the enterprise is registered. For Class 1 construction engineers, Class 1 cost engineers, and senior engineers who are newly registered or transfer their registration to construction enterprises in our city, the local finance department where the enterprise is registered may grant a reward of 5,000 yuan per person if they have completed three years of registration, signed a labor contract with the enterprise, and paid social insurance. For those who have been awarded provincial-level or higher “Outstanding Enterprise Manager” or “Outstanding Project Manager” titles, the local finance department where the enterprise is registered may grant a reward of 10,000 yuan per 10,000 yuan per person. Leverage the role of skills assessment institutions to extensively conduct skills evaluation for construction workers. Encourage enterprises to conduct talent training through in-house initiatives or by selecting training institutions, focusing on cultivating a high-quality workforce of construction workers. Vigorously promote the spirit of craftsmanship, organize industry-wide skills competitions, select a group of outstanding technical leaders, and encourage construction enterprises to establish incentive mechanisms to fully leverage their role in “mentoring, assisting, and guiding” others, thereby continuously improving the technical skills of frontline operators.(Responsible Units: Governments of all counties, districts, and cities; Management Committees of industrial parks; Municipal Commission of Housing and Urban-Rural Development; Municipal Bureau of Human Resources and Social Security; Municipal Bureau of Transportation; Municipal Bureau of Water Resources) (7) Adjust and optimize the industrial structure. Guide construction enterprises to expand into key national investment sectors and emerging fields such as highways, water conservancy, railways, rail transit, and urban utility tunnels. Strengthen the development of modern construction industrial parks, encourage leading enterprises and growing enterprises to form industrial alliances, and actively participate in major infrastructure construction.Support qualified construction enterprises in extending their industrial chains upstream and downstream, transforming into comprehensive enterprises with multi-chain operations that integrate research, design, development, construction, and operational services, thereby forming an industrial development pattern characterized by “focusing on core businesses while pursuing moderate diversification.” (Responsible Units: Governments of all counties, districts, and cities; Management Committees of Industrial Parks; Municipal Development and Reform Commission; Municipal Housing and Urban-Rural Development Commission; Municipal State-owned Assets Supervision and Administration Commission; Municipal Bureau of Government Services and Supervision; Municipal Transportation Bureau; Municipal Water Resources Bureau) (8) Leverage the Construction Industry’s Leading Role. Further harness the supporting role of the construction industry as a pillar sector, increase its contribution to the city’s economy, and drive the development of related industries and products such as building materials, construction equipment, and elevators. (Responsible Units: Governments of all counties, districts, and cities; Industrial Park Management Committees; Municipal Commission of Housing and Urban-Rural Development) (9) Accelerate the Implementation of Engineering General Contracting and Cultivate Full-Process Engineering Consulting Service Enterprises.Government and state-funded investment projects shall take the lead in implementing new construction organization and implementation models such as engineering general contracting and full-process engineering consulting. For engineering general contracting projects under fixed-price contracts, during project settlement and review, only the contractually agreed-upon changes and adjustments, as well as provisional sum items, need to be reviewed. Promote the EPC engineering general contracting model, vigorously cultivate the engineering general contracting capabilities of construction enterprises, and guide the city’s large construction enterprises to establish For projects where full-process engineering consulting services are provided by enterprises selected through open bidding and possessing the corresponding engineering supervision qualifications, it is no longer necessary to separately commission supervision services. Support local construction enterprises in forming consortia through mergers and reorganizations, establishing strategic partnerships with large real estate developers, state-owned enterprises, and central government-owned enterprises, and actively expanding into construction markets outside the province by leveraging these large enterprises. Support capable large-scale construction enterprises in enhancing their engineering general contracting capabilities and strengthening management of project quality and contract fulfillment , leading small and medium-sized enterprises to “go global” through cooperation, actively participating in “Belt and Road” initiatives, and jointly developing international markets. The housing and urban-rural development department is responsible for establishing a coordinated promotion mechanism and tracking and resolving difficulties encountered by enterprises during the process of undertaking projects outside the province. The commerce department is responsible for guiding foreign economic enterprises in handling procedures related to overseas construction, including matters concerning performance bonds (letters of guarantee). The tax department is responsible for issuing certificates of tax administration for out-of-province operations to enterprises and providing corresponding policy consultation services.Each year, the municipal government will recognize the top 10 enterprises in the city’s construction industry for their overseas expansion efforts as “Outstanding Overseas Expansion Enterprises” and grant them commendations and rewards. (Responsible units: Governments of all counties, districts, and cities; management committees of all industrial parks; Municipal Housing and Urban-Rural Development Commission; Municipal Finance Bureau; Municipal Commerce Bureau; Mianyang Municipal Tax Bureau) (11) Reducing the Burden on Enterprises. Except for bid bonds, performance bonds, quality guarantees, and migrant worker wage guarantees, no other guarantees may be established. Construction enterprises may substitute cash payments for various guarantees with bank letters of credit or guarantee insurance; no entity may refuse such substitutions without cause. Support professional guarantee companies with good market reputation and strong comprehensive capabilities in conducting engineering guarantee business. Guarantees must not be diverted for other uses; for performance guarantees and engineering quality guarantees paid in cash, the competent industry authorities shall, in conjunction with banks, shall jointly supervise the deposits. A differentiated management approach shall be implemented for migrant worker wage deposits: enterprises ranked among the top 50 in tax payments for general construction contracting in the previous year, and with no complaints of wage arrears involving migrant workers in the past three years, may apply to pay the migrant worker wage deposit in a single lump sum. Advance payments stipulated in construction contracts shall not be less than 10% of the total contract value (excluding provisional sums). Project owners shall promptly pay contractors the full amount of advance payments and progress payments as agreed in the contract, and shall promptly settle accounts in accordance with the contract, and pilot the use of payment guarantees to prevent arrears in project payments. Government- funded projects must not be constructed with funds advanced by the contractor. For localities and construction units with long-term arrears in project payments, except for extremely special projects, the Development and Reform, Finance, and other relevant departments (units) shall not approve new project construction.(Responsible Units: Municipal Housing and Urban-Rural Development Commission, Municipal Audit Bureau, Municipal Development and Reform Commission, Municipal Finance Bureau, Municipal Transportation Bureau, Municipal Water Resources Bureau) (13) Fully implement the real-name registration system for construction workers. Strengthen the long-term mechanism for addressing wage arrears and ensuring payment to construction workers to safeguard their legitimate rights and interests. Enforce the regulation requiring enterprises to set aside 1.5% to 2.5% of the total employee wage fund for education and training expenses.In accordance with the principles of “whoever employs is responsible” and “the general contractor bears overall responsibility,” ensure that enterprises fulfill their wage payment obligations and pay workers’ wages in full on a monthly basis in accordance with the law. Vigorously promote enterprises’ participation in work-related injury insurance in accordance with the law, and encourage enterprises to participate in work safety liability insurance. Construction units shall fulfill their social responsibilities, continuously improve the working environment for construction workers, enhance occupational health standards, and promote stable employment for construction workers. Enterprises found to have engaged in wage arrears shall be placed on a “blacklist.”Advance the development of “smart construction sites” to improve the level of information management at construction sites. (Responsible Units: Municipal Commission of Housing and Urban-Rural Development, Municipal Human Resources and Social Security Bureau, Municipal Emergency Management Bureau, Municipal Transportation Bureau, Municipal Water Resources Bureau) (14) Broaden enterprises’ financing channels. Actively establish platforms for bank-enterprise cooperation to promote collaboration between banks and enterprises; for key construction enterprises with good credit standing, increase credit limits and relax entry requirements in accordance with regulations.Encourage financial institutions to innovate credit products and support construction enterprises in lawfully using land use rights, factory buildings, accounts receivable, construction materials, engineering equipment, and equity that meet credit eligibility criteria as collateral for financing. Encourage local construction enterprises to engage with and access capital markets. For enterprises making their initial public offering (IPO) or listing on the National Equities Exchange and Quotations (NEEQ), those listed through the Tianfu (Sichuan) United Equity Exchange Center and included in Sichuan Province’s “Four 100 Plans” for enterprise listings, as well as those that have passed the acceptance inspection for corporate restructuring to meet capital market standards and have been included in the municipal or provincial reserve pool of prospective listed and listed enterprises, the municipal government will provide subsidies in accordance withthe “Notice of the General Office of the Mianyang Municipal People’s Government on Continuing to Implement Fiscal-Financial Synergy and Fiscal Policies to Encourage Direct Financing by Enterprises” (Mianfu Ban Fa [2019] No. 3), and actively apply for provincial-level subsidy funds. (Responsible Units: Municipal Finance Bureau, Municipal Housing and Urban-Rural Development Commission, Municipal Financial Work Bureau, People’s Bank of China Mianyang Central Branch) (16) Support enterprises in reducing tax costs.Construction enterprises shall complete annual tax settlement and finalization in accordance with regulations. If the corporate income tax prepaid during the tax year is less than the amount due, the enterprise shall settle the outstanding corporate income tax within the annual tax settlement period; if the prepaid tax exceeds the amount due, the competent tax authority shall promptly process a tax refund in accordance with relevant regulations, or with the taxpayer’s consent, offset the excess against the corporate income tax due in the following year.For construction enterprises in this city that establish subsidiaries or undertake labor contracts outside the city, dividend income derived from operating profits obtained outside the city that meets the conditions for indirect tax credit outside the city shall be credited in accordance with regulations. (Responsible Unit: Mianyang Municipal Tax Bureau) (17) Vigorously promote the development of green building materials and green buildings. Actively promote the integration of green building materials and energy-saving products with the construction industry, and accelerate the implementation of the “Green Building Evaluation Label” and the “Green Building Materials Evaluation Label.”Green ecological districts and green buildings shall give priority to the use of green building materials. Government-invested construction projects or those funded by public finances—such as government agencies, schools, hospitals, and affordable housing— are encouraged to prioritize the use of green (new) building materials. By 2022, prefabricated construction shall account for more than 30% of the total floor area of new buildings. Further research shall be conducted on the application of appropriate technologies for prefabricated construction, regulatory oversight shall be improved, exemplary demonstration projects shall be cultivated, and the development of the prefabricated construction industry chain shall be comprehensively advanced. Production sites for prefabricated building components shall be reasonably planned and laid out , and provide policy support in areas such as land use guarantees, tax and credit policies, project pricing, and the transportation of components and parts. Research and formulate the “Interim Measures for the Comprehensive Credit Evaluation Management of General Contracting Enterprises and Supervision Enterprises in Construction” and launch the “Comprehensive Credit Evaluation System Platform” to conduct comprehensive scoring of general contracting and supervision enterprises. Effectively utilize the results of public credit evaluations by linking them to bidding and tendering, administrative approvals, supervisory spot checks, and awards and commendations, thereby promoting honest business practices and upgrading the quality of construction and supervision enterprises, and further standardizing the order of the construction market. Implement tiered and categorized supervision, strengthening daily oversight of enterprises that violate laws and regulations or engage in dishonest practices, and increasing the frequency of inspections.Conduct “blacklist” designations in accordance with relevant national and provincial “blacklist” systems and identification criteria. All departments shall push information regarding construction-related “blacklists,” administrative penalties, and spot inspections to the Municipal Public Credit Information Sharing and Exchange Platform, and publicly disclose such information through the “Credit China (Sichuan Mianyang)” website and the National Enterprise Credit Information Publicity Platform, implementing Implement cross-departmental joint disciplinary measures in accordance with laws and regulations; restrict entities listed on “blacklists” such as the People’s Court’s list of discredited persons subject to enforcement from engaging in project bidding, market access, and related activities within our city, thereby fostering a market environment where “keeping one’s word brings benefits everywhere, while breaching trust leads to restrictions everywhere.” (Responsible Units: Municipal Housing and Urban-Rural Development Commission, Municipal Development and Reform Commission, Municipal Market Regulation Bureau, Municipal Government Services Supervision Bureau, Municipal Transportation Bureau, Municipal Water Resources Bureau) (20) Promote industry self-regulation. Strengthen the development and management of the Municipal Construction Enterprise Association. Guide the association to focus on enhancing industry self-regulation, improving service standards, and advancing industry development. Cooperate with government departments in conducting comprehensive enterprise credit evaluations, managing the construction market, and providing training and education for technical and management personnel. Timely collect issues encountered by construction enterprises during administrative procedures, and regularly invite relevant competent authorities to organize training sessions to address questions and resolve concerns. Leverage the city’s government offices stationed outside the city, strengthen communication and coordination with provincial and municipal governments and housing and urban-rural development departments, promote our city’s leading enterprises, and assist in attracting high-caliber management talent. In regions with significant market potential and a high concentration of our city’s export-oriented enterprises, professional personnel may be dispatched to provide services to help enterprises expand into provincial markets. Implement the engineering quality disclosure system and the responsibility system, and the lifetime accountability system for principal responsible persons. We will reinforce the quality responsibilities of supervision, testing, and construction drawing review units, and severely crack down on acts such as issuing false test reports. We will thoroughly advance pilot projects for standardizing engineering quality management, and incorporate enterprises’ implementation of project standardization into the corporate credit management system. We will fully implement real-name management for personnel in key positions of engineering projects, and strengthen government supervision over critical stages such as the foundations , key parts of the main structure, and project completion acceptance. (Responsible units: Municipal Commission of Housing and Urban-Rural Development, Municipal Market Regulation Bureau) (22) Strengthen management of safe and civilized construction. Firmly establish the concept of safe development, fully implement primary responsibility for work safety, and enhance the overall safety level of construction projects. Accelerate the construction of a dual-prevention mechanism for risk classification and control as well as hidden hazard identification and rectification, improve the identification and control mechanism for hazardous risk sources, and establish a sound routine mechanism for addressing construction safety hazards.Promote the deep integration of information technology with work safety, and strengthen work safety supervision through digital means. Vigorously advance the creation of standardized and civilized construction sites, continuously strengthen dust and noise control at construction sites, and effectively manage exhaust emissions from construction machinery to achieve green construction. Strictly investigate and punish all types of work safety violations, and rigorously hold parties accountable for work safety accidents. (Responsible units: Municipal Commission of Housing and Urban-Rural Development, Municipal Ecology and Environment Bureau, Municipal Emergency Management Bureau, Municipal Market Regulation Bureau) (23) Strengthen bidding and tender management. Uniformly implement the use of standardized bidding document templates and an electronic filing system for bidding projects across all state-invested projects in the city; accelerate the full-process digitization of construction bidding and tendering; establish and improve a public resource trading supervision platform; prevent and curb illegal activities such as bid-rigging and collusion; prevent tenderers (bidding agencies) from imposing unreasonable conditions to restrict or exclude potential bidders during the bidding process; and promote and improve the city’s level of electronic information technology in bidding and tendering. Strengthen the management of tender control prices and reasonable low prices; investigate and punish malicious low-price and unreasonable low-price competition in accordance with the law to safeguard the healthy development of the industry. Strengthen professional guidance on enterprise statistical work, ensure the registration of newly established construction enterprises, and guarantee that all eligible entities are included in the statistics and that statistical data is timely and accurate. (Responsible units: Governments of all counties, districts, and cities; Management Committees of industrial parks; Municipal Commission of Housing and Urban-Rural Development; Municipal Bureau of Statistics) (25) Protect the property rights of construction enterprises in accordance with the law.In civil litigation proceedings, adhere to the principle of protecting creditors’ legitimate rights and interests in accordance with the law while fully respecting the normal production and business operations of debtor enterprises, and ensure proper implementation of property preservation measures. (Responsible Units: Municipal Court, Municipal Procuratorate, Municipal Bureau of Justice) (26) Strictly crack down on illegal activities. Departments including Housing and Urban-Rural Development, Development and Reform, Public Security, and Market Regulation shall strengthen coordination and cooperation, thoroughly carry out the special campaign against organized crime and evil forces, and maintain a fair and competitive market order. Strengthen inspections of key personnel at construction sites to ensure they are on duty and performing their duties, continue to conduct law enforcement inspections of the construction market, and severely crack down on illegal acts such as splitting contracts, subcontracting, illegal subcontracting, bid-rigging, and lending qualifications under another entity’s name. For enterprises subject to administrative penalties, those meeting the criteria for inclusion on the “blacklist” shall be added to the construction market entities’ “blacklist,” subject to credit score deductions, and restrictions shall be imposed in accordance with the law regarding market access, qualification management, bidding bidding. Work Guarantees (1) Strengthen Organizational Leadership. Establish a city-wide joint conference system for the construction and real estate industries, convened by the Vice Mayor in charge, bringing together responsible officials from relevant municipal departments, counties, districts, and industrial parks to hold regular or ad hoc meetings. These meetings will analyze the performance of economic indicators in the construction sector, countermeasures, review and deliberate on incentive and support measures for the construction industry’s development, and focus on resolving difficulties and issues faced by enterprises in their development. The Office of the Joint Conference shall be housed within the Municipal Commission of Housing and Urban-Rural Development, with the Director of the Municipal Commission of Housing and Urban-Rural Development serving as the Office Director. The Office shall be responsible for regularly collecting information on difficulties and issues faced by construction enterprises and the industry, and proposing corresponding recommendations and measures to be submitted to the Municipal Government for approval.The municipal government shall establish an annual special fund for the development of the construction industry of no less than 5 million yuan. Each county, district, and industrial park shall establish corresponding special funds for the development of the construction industry, to be used for encouraging enterprises to upgrade their qualifications, awarding excellence, supporting scientific research and development, promoting technological innovation, expanding markets, and providing legal assistance. (2) Strengthen Supervision and Constraints. Any enterprise that violates relevant laws and regulations shall not be eligible for any annual preferential incentive policies.Enterprises receiving rewards (or subsidies) shall not relocate outside Mianyang within five years; otherwise, they must fully refund the relevant reward (or subsidy) funds. It is strictly prohibited for public officials, relevant units, or applicant enterprises to fabricate information or fraudulently obtain reward (or subsidy) funds; once verified, such funds shall be immediately recovered, and the relevant departments shall handle the matter seriously in accordance with laws, discipline, and regulations; Where criminal suspicion exists, the case shall be transferred to judicial authorities in accordance with the law.
These Opinions shall take effect on May 18, 2020, and remain valid for five years; during this period, if the state or Sichuan Province issues separate regulations, those provisions shall prevail. The "Opinions of the Mianyang Municipal People’s Government on Further Supporting the Accelerated Development of the Construction Industry" (Mianfu Fa [2017] No. 11) is hereby repealed.
