To implement the "Regulations on Promoting the Development of Individual Businesses" (State Council Decree No. 755) and to better encourage, support, and guide the healthy development of the individual business sector, the following measures are formulated in light of the actual conditions in our province.
I. Reducing Operating Costs
(1) Extending the policy on phased reductions in social insurance contributions. For individual businesses with employees that participate in social insurance as entities, the policy on phased reductions in unemployment insurance and work-related injury insurance rates will be extended until December 31, 2024. Specifically, the unemployment insurance rate will remain at 1%, while the work-related injury insurance rate will be determined based on the number of months that the cumulative fund surplus from the previous year can cover, as calculated by each locality.(Responsible Units: Provincial Department of Human Resources and Social Security, Department of Finance, Tax Bureau; municipal and county-level governments. (2) Reduce the cost of business premises. Further relax registration restrictions on business premises for individual business operators and deepen the reforms of “multiple licenses at a single address” and “multiple addresses under a single license.” Support operators on e-commerce platforms in conducting “cluster registration.” Localities shall take effective measures to increase the supply of business premises for individual business operators. (3) Conduct price and fee rectification campaigns targeting individual businesses. Focus on key sectors, continue to address illegal charges against enterprises, severely crack down on illegal fee collection practices involving individual businesses, and alleviate the financial burden on individual businesses. (4) Strengthen insurance coverage. Guide self-employed individuals without employees to enroll in the basic old-age insurance and medical insurance for enterprise employees as individuals, and encourage self-employed individuals with employees to enroll in the basic old-age insurance, work-related injury insurance, unemployment insurance, medical insurance, and maternity insurance for enterprise employees as employers. Guide insurance institutions within the province to develop customized insurance products for self-employed individuals and provide comprehensive, integrated, and inclusive insurance services.(Responsible Units: Provincial Department of Human Resources and Social Security, Henan Regulatory Bureau of the National Financial Regulatory Administration)
II. Reducing the Tax and Fee Burden
(5) Implement tax and fee preferential policies for small-scale VAT taxpayers. Individual business operators classified as small-scale taxpayers who engage in VAT-taxable sales activities shall be exempt from VAT if their total monthly sales do not exceed 100,000 yuan (or quarterly sales do not exceed 300,000 yuan for those with a quarterly tax period).For taxable sales revenue of individual businesses classified as small-scale taxpayers subject to a 3% collection rate, VAT shall be levied at a reduced rate of 1%; for VAT prepayment items subject to a 3% prepayment rate, VAT shall be prepayed at a reduced rate of 1%. (6) Implement preferential policies for deed tax. Individual business operators who transfer ownership of housing or land registered under their personal name to the individual business, or individual businesses that transfer ownership of housing or land registered under the business back to the original operator’s personal name, shall be exempt from deed tax. (7) Implement the reduction and exemption policies for the “Six Taxes and Two Fees.” Individual business operators shall be subject to a 50% reduction in resource tax (excluding water resource tax), urban maintenance and construction tax, property tax, urban land use tax, stamp tax (excluding securities transaction stamp tax), tax on the occupation of cultivated land, and the education surcharge and local education surcharge. This policy shall remain in effect until December 31, 2027.(Responsible Units: Provincial Tax Bureau, Department of Finance)
(8) Implement preferential policies for individual income tax. For individual business operators, the individual income tax on the portion of annual taxable income not exceeding 2 million yuan shall be halved. The policy is effective until December 31, 2027. (9) Implement tax reductions and exemptions for key groups and self-employed demobilized soldiers.For individuals who have been lifted out of poverty, holders of an "Employment and Entrepreneurship Certificate" or an "Employment and Unemployment Registration Certificate," self-employed veterans, and college graduates engaged in individual business operations within the year of graduation, starting from the month of individual business registration, tax deductions will be applied sequentially against their actual annual tax liabilities for Value-Added Tax, Urban Maintenance and Construction Tax, Education Surcharge, Local Education Surcharge, and Individual Income Tax, up to an annual limit of 24,000 yuan per household, for a period of three years.This policy will remain in effect until December 31, 2027. III. Strengthening Financial Support
(10) Enhance Financing Convenience. Establish a credit rating and evaluation system for individual businesses, promote credit-based lending, and facilitate sustained growth in the outstanding loan balance and number of individual businesses across the province.Encourage financial institutions to develop specialized credit products, such as the “Famous, Special, Superior, and New Loan,” tailored to the characteristics of individual businesses. Develop pledge financing secured by accounts receivable, franchise rights, government procurement contracts, fee collection rights, and intellectual property rights. Promote the “borrow-and-repay-as-needed” loan model and expand support for unsecured loans and first-time borrowers. Guide commercial banks to improve due diligence and exemption mechanisms, and appropriately increase tolerance for non-performing loan rates on inclusive loans to individual businesses.(Responsible Units: Provincial Bureau of Local Financial Supervision, People’s Bank of China Henan Branch, Henan Regulatory Bureau of the National Financial Regulatory Administration)
(11) Reduce payment transaction fees.Encourage commercial banks, in addition to waiving one account management fee (including fees for small-balance accounts, but excluding fees for dormant accounts) and annual fees, to waive all corporate settlement account management fees and annual fees for individual business operators; for interbank corporate transfers and remittances of 100,000 yuan or less conducted by individual business operators through counter channels, offer a discount of no more than 10% off the current government-guided price standard;Eliminate charges for check issuance and loss reporting fees, as well as fees for promissory notes and bank drafts, including issuance, processing, and loss reporting fees. Among these, the implementation period for bill-related measures is indefinite, while the remaining measures will be effective until September 29, 2024. (12) Strengthen credit enhancement through guarantees. Guide government-backed financing guarantee institutions to intensify credit enhancement services for individual business operators, striving to ensure that “all eligible cases are guaranteed.”Implement requirements to reduce guarantee fees: government-backed financing guarantee institutions shall, under the premise of sustainable operations, reduce guarantee fees for individual business operators to no more than 1%. Localities shall establish and implement working mechanisms for capital replenishment, risk compensation, premium subsidies, and business incentive subsidies for government-backed financing guarantee institutions, and explore the establishment of a subsidy mechanism to cover the difference in guarantee fees for individual business operators. (13) Implement policies on entrepreneurship guarantee loans and interest subsidies.Eligible urban registered unemployed persons, persons facing employment difficulties (including persons with disabilities), veterans, persons released from prison, college graduates (including university graduates serving as village officials and returning overseas students), employees and unemployed persons from enterprises involved in resolving excess production capacity, returning migrant workers engaged in entrepreneurship, online merchants, persons who have escaped poverty, and rural farmers engaged in self-employment may apply for personal entrepreneurship guarantee loans. The loan amount shall not exceed 300,000 yuan, the term shall not exceed 3 years, and borrowers shall be eligible for fiscal interest subsidies.Localities may, in accordance with relevant regulations and with the approval of the provincial government, expand the scope of support for entrepreneurship guarantee interest subsidies and increase the upper limits on loan amounts, interest rates, and subsidy ratios based on local conditions. IV. Optimizing the Business Environment
(14) Improve the convenience of business registration. Implement a new smart registration model featuring “self-reporting, system verification, instant review, and real-time license issuance” to achieve a fully “contactless, paperless, interference-free, and fee-free” process for individual business registration.Implement reforms for the cross-jurisdictional relocation of individual businesses within the province. Enforce the suspension of business operations filing system and optimize the corresponding tax and social security service procedures. (15) Encourage and Support Business Transformation and Upgrading. Individual businesses that voluntarily change their operators may directly apply to the registration authority for a change of registration, and are permitted to retain their original business name and date of establishment; for those that meet the criteria, registration information will be automatically synchronized in the tax management information system. Individual businesses that transform into enterprises are permitted to continue using their original business name and date of establishment in accordance with the law and retain their industry characteristics; administrative licensing departments shall provide convenience in accordance with the law.Localities are encouraged to introduce relevant incentive and subsidy policies based on local conditions to support the transformation and upgrading of individual businesses into enterprises. (16) Promote inclusive and prudent regulation. Explore the implementation of credit risk classification management for individual businesses and optimize the credit information repair mechanism for individual businesses. Standardize routine inspection practices to ensure that businesses are not disturbed unless necessary.Make full use of reminders, advisories, suggestions, and interviews to guide individual business operators to voluntarily comply with regulations and laws. Where an individual business operator commits a violation without subjective fault; commits a first-time violation with minor harmful consequences and promptly rectifies it; or commits a minor violation that is promptly rectified and causes no harmful consequences, administrative penalties shall not be imposed in accordance with the law. (17) Protect Legitimate Rights and Interests. The legitimate rights and interests of individual business operators, including property rights and operational autonomy, are protected by law; no unit or individual may infringe upon or unlawfully interfere with them. It is prohibited to formulate or implement discriminatory policies or measures against individual business operators in areas such as qualification licensing, project applications, government procurement, and bidding and tendering in violation of regulations; it is prohibited to charge fees or impose disguised charges on individual business operators in violation of laws, regulations, and relevant provisions;No entity shall solicit funds or impose levies on individual business operators, nor shall it forcibly require them to provide sponsorship or accept paid services; no entity shall induce or coerce workers to register as individual business operators; no entity shall require individual business operators to accept unreasonable transaction terms regarding payment deadlines, methods, conditions, or liability for breach of contract; no entity shall default on or indirectly delay payment to individual business operators.Investigate and punish, in accordance with the law, unfair competition practices that squeeze the survival and employment space of individual business operators. Ensure unimpeded channels for individual business operators to voice their concerns and establish mechanisms for reporting, responding to, and resolving issues. V. Supporting Entrepreneurship and Innovation
(18) Implement a one-time startup subsidy. College and vocational school students (including graduates and current students of general universities, vocational schools, and technical schools within five years of graduation, as well as returnees from overseas studies within five years of graduation), individuals facing employment difficulties, veterans, laborers who have escaped poverty, and returning migrant workers who engage in individual business operations for the first time and have operated normally for at least one year from the date of business registration shall be granted a one-time startup subsidy of 5,000 yuan in accordance with regulations.(Responsible Agencies: Provincial Department of Human Resources and Social Security, Department of Finance, Department of Education, Department of Veterans Affairs, Department of Agriculture and Rural Affairs)
(19) Support for College Student Entrepreneurship. College graduates may participate in one session each of entrepreneurship awareness training, business start-up (or improvement) training, entrepreneurship practical training, and online (e-commerce) entrepreneurship training while still enrolled. Training subsidies of 200 yuan, 1,000 yuan, 300 yuan, and 1,500 yuan, respectively, will be provided in accordance with regulations.Support various incubation platforms in allocating a certain proportion of free incubation space to college student innovation and entrepreneurship teams; government-invested incubators and other entrepreneurial platforms should allocate approximately 30% of their space free of charge to college graduates. (20) Implement differentiated and categorized cultivation. Establish classification criteria for individual businesses into “survival-type,” “growth-type,” and “development-type” categories based on industry type, business scale, and operational characteristics. Build a database of “renowned, distinctive, high-quality, and innovative” businesses, strengthen dynamic management, and provide targeted support. (21) Strengthen intellectual property services. Support intellectual property service centers and protection agencies in providing individual business owners with services such as intellectual property policy consultation, patent and trademark application and registration, and assistance with intellectual property rights protection. Improve the mechanism for cultivating trademark brands among individual business owners, tap into the resources of “time-honored” trademark brands, and strengthen the protection of individual business owners’ rights and interests—including business names, trademarks, patents, and trade secrets—in accordance with the law. (22) Support efforts to boost consumer confidence. Support individual business operators in participating in various consumption-promotion activities, and encourage localities to issue consumption vouchers targeting industries with a high concentration of individual business operators, such as catering and retail.With approval from county-level or higher governments or relevant departments, and provided that operations are conducted in a standardized and orderly manner and road traffic remains safe and unobstructed, eligible individual businesses will be permitted to moderately expand their outdoor operating areas and extend operating hours. Temporary parking for dining during off-peak nighttime hours will also be permitted. Building on the creation of national pilot cities for the “15-minute” convenient living circle, guide individual businesses to enter communities to promote the development of community-based living services. (23) Promote the integrated development of online and offline operations. Support individual business operators in enhancing their online marketing capabilities and adopting emerging business models such as live-streaming e-commerce, community e-commerce, and social e-commerce to achieve integrated online and offline business development. Encourage internet platform enterprises to provide support for individual business operators’ online operations by relaxing entry requirements, waiving or reducing fees for online store deposits and promotional activities, simplifying online operational rules, and conducting training on digital operations for individual business operators to improve their online business proficiency.Platform operators shall not use service agreements, platform rules, data algorithms, or technology to impose unreasonable restrictions, attach unreasonable conditions, or charge unreasonable fees on individual business operators within their platforms. VI. Expand Service Provision
(24) Conduct vocational skills training. Support vocational schools and training institutions in aligning with the development needs of individual business operators. Organize order-based and targeted vocational skills training for urgently needed and scarce occupations (job categories), and provide training subsidies to eligible participants in accordance with regulations. Include eligible employees of individual business operators within the scope of vocational training subsidies as prescribed, helping individual business operators improve their skills and risk-resilience.(Responsible Units: Provincial Department of Human Resources and Social Security, Department of Education, Department of Finance)
(25) Provide Public Interest Legal Services. Leveraging local private enterprise legal service teams, pool legal resources such as lawyers, notaries, people’s mediators, and arbitrators to regularly conduct “legal health checks” and legal awareness campaigns tailored to the needs of individual business operators. Encourage and guide legal service institutions to provide free legal consultations, mediation, and other services to individual business operators seeking to protect their rights and seek remedies, and assist them in resolving disputes related to contract performance and labor employment.(Responsible Unit: Provincial Department of Justice)
(26) Leverage the Role of Social Organizations. Guide local associations for the individual and private economy to provide guidance and assistance to individual business operators in areas such as market access, transformation and upgrading, capacity building, and Party-building leadership. Encourage various industry associations and chambers of commerce to conduct policy consultations, entrepreneurship guidance, and employment training, and coordinate efforts to resolve difficulties and issues encountered by individual business operators in their production and operations. (27) Strengthen the Leading Role of Exemplary Models. Extensively carry out selection and recognition campaigns for “Civilized and Integrity-Oriented Individual Business Operators” and “Most Beautiful Individual Workers” to reinforce positive incentives for individual business operators. Strengthen Party building work among “small, individual, and specialized” enterprises, leverage the role of Party organizations and Party members among individual business operators as strongholds and vanguards, and use Party building to guide the high-quality development of individual business operators. (28) Establish a development support mechanism. All localities and departments shall, based on actual working conditions, refine and implement policy measures to support the development of individual businesses, strengthen the compilation and release of policies, extensively conduct policy interpretation and publicity, summarize and promote exemplary practices in fostering the development of individual businesses, and enhance supervision of policy implementation and situation reporting.
