Chapter 1 General Provisions
Article 1 To promote the clustered development of the advertising industry in Guizhou Province, strengthen and standardize the management of advertising industrial parks, and further leverage the positive role of the advertising industry in stimulating consumption, shaping brands, and disseminating civilization, these Measures are formulated in accordance with the "Administrative Measures for National Advertising Industrial Parks" and the "Provisions on the Recognition of National Advertising Industrial Parks," and in light of actual conditions.
Article 2: For the purposes of these Measures, “Guizhou Provincial Advertising Industry Park” refers to a specific area within the administrative region of Guizhou Province that possesses a comprehensive public service system for advertising industry development, features the aggregation of advertising industry elements, exhibits a high concentration of the advertising industry and related industrial chains, possesses strong innovation capabilities, and plays a leading role in the development of the province’s advertising and related industries.
Article 3 The Provincial Market Supervision Administration is responsible for the recognition, evaluation, and revocation of Guizhou Provincial Advertising Industry Parks.
Article 4: The construction and development of the park shall adhere to the principles of combining government guidance with market operations, integrated planning with rational layout, and a clear primary focus with distinctive characteristics. It shall prioritize both social and economic benefits and serve the province’s high-quality development.
Article 5: Parks and their tenant enterprises are encouraged to utilize new technologies such as big data and artificial intelligence to drive innovation and development, increase investment in innovation-driven initiatives, accelerate digital transformation and upgrading, explore the virtualization of advertising industry resources, platform-based operations, and networked collaboration, strengthen the creation, utilization, protection, management, and services related to intellectual property, actively cultivate new business formats and models in the advertising sector, and build innovative parks.
Chapter II Application and Recognition
Article 6: The application and recognition of Guizhou Provincial Advertising Industry Parks shall follow the principles of voluntariness, openness, and merit-based selection, and shall be conducted in accordance with standardized procedures.
Article 7: Applications for designation as a Guizhou Provincial Advertising Industry Park must meet the following conditions:
(1) The park must be consistent with the overall economic and social development plans and industrial development plans of the state, province, city (autonomous prefecture), and region, and must have been established with the approval of the municipal (autonomous prefecture) people’s government or the Gui’an New Area Administrative Committee;
(2) The park has a comprehensive construction and development plan; its scale meets the needs of industrial clustering; it is characterized by and positioned for the advertising industry and related industries; and it has clearly defined geographical boundaries;
(3) The entity responsible for the construction and operation of the park is clearly defined, possesses independent legal person status, has a dedicated management body and staff, operates under standardized mechanisms, and maintains sound management systems capable of effectively organizing and carrying out the management and operation of the park. The business activities of enterprises within the park comply with relevant laws and regulations;
(4) The park possesses a fully functional public service platform and support system capable of providing professional and basic services to tenant enterprises and organizations, as well as the necessary hardware and software environment for the development of the advertising and related industries; the park’s safety production, energy conservation, and environmental protection measures comply with national regulations;
(5) Enterprises in the advertising industry and related industries account for more than 50% of the total enterprises within the park and number no fewer than 20; the park’s performance indicators, such as advertising revenue and transaction volume, rank among the top in the province.
Article 8: Applications for designation as a Guizhou Provincial Advertising Industry Park shall be submitted by the park’s management body. The municipal-level Market Supervision Administration where the park is located shall conduct a preliminary review in accordance with the conditions specified in Article 7 of these Measures and provide a review opinion. If the conditions are met, the application shall be submitted to the Provincial Market Supervision Administration in the name of the municipal (autonomous prefecture) Market Supervision Administration or the Gui’an New Area Administrative Committee after obtaining approval from the municipal (autonomous prefecture) People’s Government or the Gui’an New Area Administrative Committee.
Article 9: The Provincial Market Supervision Administration shall entrust a third-party evaluation agency or organize an expert review panel to examine the application materials, conduct on-site inspections and professional assessments of the park, prepare a review report, and propose a recommendation for recognition or non-recognition. For parks recommended for recognition, the Provincial Market Supervision Administration shall select the best candidates and submit them to its executive meeting for final approval. Upon public notice and the absence of objections, the park shall be recognized as a “Guizhou Provincial Advertising Industry Park.”
Article 10. No entity may use the title “Guizhou Provincial Advertising Industry Park” or similar expressions in any form without prior recognition by the Provincial Market Supervision Administration.
Chapter III Management and Evaluation
Article 11: The Market Supervision Administration of the city (autonomous prefecture) where the Guizhou Provincial Advertising Industry Park is located, or the Market Supervision Administration of the Gui’an New Area, shall submit a report on the park’s development in the previous year annually, in accordance with the requirements of the Provincial Market Supervision Administration.
Article 12: When a Guizhou Provincial Advertising Industry Park makes significant adjustments to its development plan or major advertising industry projects, it shall obtain the consent of the People’s Government of the city (autonomous prefecture) where the park is located or the Administrative Committee of Gui’an New Area. The application shall be submitted by the Market Supervision Administration of the city (autonomous prefecture) or Gui’an New Area. The Provincial Market Supervision Administration shall organize the review. For proposed adjustments to be approved, the Provincial Market Supervision Administration shall issue a formal approval document after deliberation and approval by its executive meeting.
Article 13: The Provincial Market Supervision Administration shall entrust a third-party evaluation agency or organize an expert review panel to evaluate the Guizhou Provincial Advertising Industry Park. The evaluation shall cover the following aspects:
(1) Whether the development direction complies with relevant national and provincial policies, laws, and regulations, as well as the requirements of these Measures;
(2) The implementation status of the park’s planning;
(3) The management and operation of the park, including the establishment of organizational structures and institutional frameworks, the development of public service capabilities, the growth of advertising enterprises within the park, the park’s contribution to the development of the regional advertising industry, and the cooperation between the park and its enterprises with relevant departments;
(4) Opinions of the Market Supervision Administration of the relevant prefecture-level city (autonomous prefecture) or Gui’an New Area regarding the park’s management and operations;
(5) The park’s compliance with relevant laws and regulations.
Article 14: The Provincial Market Supervision Administration shall conduct administrative interviews with parks that fail the evaluation and order them to rectify within a specified time limit, which shall not exceed six months. Upon expiration of the rectification period, the Provincial Market Supervision Administration shall organize a re-evaluation.
Article 15: If a Guizhou Provincial Advertising Industry Park falls under any of the following circumstances, its designation shall be revoked after approval by the executive meeting of the Provincial Market Supervision Administration:
(1) Altering the primary nature of its advertising industry development due to policy adjustments or changes in business direction;
(2) Engaging in advertising activities that involve significant issues of misdirection or other conduct that causes adverse social impacts;
(3) Harming consumer interests and causing serious adverse social impact;
(4) Publishing false or illegal advertisements or providing false or illegal advertising services, thereby causing serious social repercussions;
(5) Where poor management results in the park no longer meeting the criteria for designation;
(6) Entities that submitted false application materials or used other means to fraudulently obtain park certification;
(7) Failing to meet the requirements upon re-evaluation after being given a deadline for rectification;
(8) Engaging in other major violations of laws or regulations.
Chapter IV Supplementary Provisions
Article 16. The Guizhou Provincial Market Supervision Administration shall be responsible for interpreting these Measures.
Article 17 These Measures shall come into effect on the date of promulgation. The "Measures for the Development of Advertising Industrial Parks in Guizhou Province (Trial)" (Qian Gong Shang Guang [2014] No. 2) shall be repealed simultaneously.
