Chapter I General Provisions
Article 1 In order to deeply implement the innovation-driven development strategy, implement the "Opinions of the CPC Central Committee and State Council on Deepening the Reform of the Science and Technology System and Accelerating the Construction of the National Innovation System", further strengthen the status of enterprises as the main body of technological innovation, guide and support enterprises to enhance the ability of technological innovation, and improve the market-oriented mechanism of technological innovation, and regulate the identification and management of Guiyang Municipal Enterprises' Technical Center (hereinafter referred to as "Municipal Enterprise Technology Center") identified and managed in accordance with the "Law of the People's Republic of China on the Progress of Science and Technology", with reference to the "Management Measures for the Recognition of National Enterprise Technology Centers" and "Management Measures for the Recognition of Guizhou Provincial Enterprise Technology Centers", and hereby formulate the present measures.
Second Article The enterprise technology center referred to in these measures, refers to the enterprise according to the market competition needs to set up technology research and development and innovation institutions, responsible for the development of enterprise technology innovation planning, industrial technology research and development, the creation and use of intellectual property rights, the establishment of a technical standard system, cohesion and training of innovative talents, building a collaborative innovation network, and to promote the implementation of the whole process of technological innovation.
Article 3 Guiyang encourages and supports enterprises to establish technology centers, play the main role of enterprises in technological innovation, establish and improve the system and mechanism for enterprise-led industrial technology research and development and innovation. According to the requirements of innovation-driven development and economic restructuring needs, strong innovative capacity, good innovation mechanism, leading demonstration role, and meet the conditions of the enterprise technology center to be identified, and give policy support to encourage and guide the backbone of the industry to drive industrial technological progress and innovation capacity.
Article IV of the Municipal Bureau of Industry and Information Technology, Municipal Development and Reform Commission, Municipal Bureau of Science and Technology, Municipal Finance Bureau, Municipal Market Supervision Bureau, Municipal Taxation Bureau and other relevant departments, jointly formed the "Guiyang Municipal Enterprises Technology Center Steering Group" (hereinafter referred to as the "municipal enterprise technology center steering group (hereinafter referred to as "Guiyang Municipal Enterprise Technology Center Steering Group"), which is responsible for guiding and coordinating the work of Guiyang Enterprise Technology Center. The Municipal Bureau of Industry and Information Technology shall take the lead in identifying and evaluating the operation of the municipal enterprise technology centers. The departments in charge of industry and information technology in each district (city, county and development zone) are responsible for the cultivation, organization declaration and daily management of municipal enterprise technology centers.
Chapter II: Recognition
Article 5: The recognition of municipal enterprise technology centers shall be carried out once a year in principle.
Article 6: Municipal enterprise technology centers shall have the following basic conditions:
(1) industrial enterprises registered and operating in Guiyang City's administrative area with independent legal personality;
(2) enterprises in the industry with significant development advantages and competitive advantages, with strong technological innovation and higher level;
(3) enterprises has a better mechanism for technological innovation, a sound organizational system of enterprise technology center, and significant innovation efficiency and effectiveness;
(d) the enterprise has established an enterprise technology center within the enterprise and has operated normally for more than one year.
(E) the enterprise within 2 years (refers to the municipal enterprise technology center in the year the deadline for reporting forward 2 years) did not occur the following:
1, due to violations of the Tax Administration Law and related laws and administrative regulations, constitute tax evasion, fraudulent export tax rebates, false invoicing and other serious tax violations;
2, 1 year did not occur in a major production safety accidents.
3. Other serious violations of laws and regulations and breach of trust as determined by judicial and administrative organs.
Article VII in addition to different business fields, technological innovation resources are not shared, the parent company or subsidiary is already a municipal enterprise technology center, in principle, its subsidiaries or parent company will no longer be recognized as a municipal enterprise technology centers; municipal enterprise technology centers do not set up a sub-center.
Article VIII of the recognition process:
(a) enterprises in accordance with the current year's reporting requirements to the competent departments of industry and information technology in their regions (cities, counties, development zones) to submit application materials;

(2) The competent department of industry and information technology of each district (city, county and development zone) verifies and examines the application materials submitted by the enterprise and the relevant situation of the enterprise and fills in the recommendation and submits it to the Municipal Bureau of Industry and Informatization;
(3) The Municipal Bureau of Industry and Informatization organizes an expert group or commissions an eligible third-party institution to carry out the preliminary evaluation, and, based on the results of the preliminary evaluation, organizes an expert group to carry out on-site inspection of the enterprise, and Formation of expert evaluation opinions;
(4) the Municipal Bureau of Industry and Information Technology, based on industrial policy, expert evaluation opinions and other comprehensive assessment, puts forward a proposed list of municipal enterprise technology centers identified by the Municipal Enterprise Technology Center Steering Group review and determine the confirmation of municipal enterprise technology centers identified list;
(5) the Municipal Bureau of Industry and Information Technology will be confirmed in the list of municipal enterprise technology centers in the Municipal Bureau of Industry and Information Technology website publicized to the public. Chapter III: Operation and Evaluation
Article 9: The Steering Group of Municipal Enterprise Technology Center shall conduct operation and evaluation of the Municipal Enterprise Technology Center once every three years. The Municipal Bureau of Industry and Information Technology issues an evaluation notice in the evaluation year.
Article 10: Municipal enterprise technology centers participating in the evaluation shall submit relevant materials in accordance with the requirements of the notice, including:
1. Evaluation materials of Guiyang Municipal Enterprise Technology Center
2. Summary of the work of Guiyang Municipal Enterprise Technology Center
Article 11: The competent department of industry and information technology in charge of each district (city, county and development zone) shall review and issue review opinions on the evaluation materials submitted by the Municipal Enterprise Technology Center. Conduct a review and issue a review opinion.
Article 12: The Municipal Industry and Information Technology Bureau shall organize a group of experts or entrust qualified third-party institutions to verify the submitted materials in accordance with the Evaluation Indicator System of Guiyang Municipal Enterprises' Technology Centers in a way that includes convening a meeting or on-site verification, etc., and then calculate and analyze the verified data in accordance with the Evaluation Indicator System of Guiyang Municipal Enterprises' Technology Centers in order to arrive at the evaluation results, and form an evaluation report. Article 13: Evaluation results shall be divided into excellent, good, better, basically qualified and unqualified:
(1) Evaluation scores of 90 points and above shall be excellent;
(2) Evaluation scores of 65 to 90 points (excluding 90 points) shall be good;
(3) Evaluation scores of 60 to 65 points (excluding 65 points) shall be basically qualified;
(d) Evaluation scores below 60 points as unqualified.
The municipal enterprise technology center with a comprehensive evaluation score of basic pass or above can continue to retain the title of municipal enterprise technology center.
Article 14: The steering group of the municipal enterprise technology center shall review and confirm the evaluation results and publish them.
Article 15: The evaluation of municipal enterprise technology centers shall be completed within 70 working days from the deadline for submission of materials.
Chapter IV Management and Policies
Article 16 The Municipal Enterprise Technology Center shall submit to the Municipal Bureau of Industry and Information Technology in May each year the annual summary of the work of the Enterprise Technology Center, the operational snapshot and the plan of technology development projects. In January and July of each year, it fills in the half-yearly dynamic table of the implementation of technology development projects.
Article XVII of the municipal enterprise technology center in the enterprise name change, reorganization and other major adjustments should be handled within 30 working days after the relevant procedures will be reported to the Municipal Bureau of Industry and Information Technology.
Article 18 shall revoke the title of Municipal Enterprise Technology Center in any of the following cases:
(1) Failure to pass the operation evaluation;
(2) Failure to submit the relevant materials for the operation evaluation after the due date;
(3) Provision of false materials and data;
(4) Occurrence of major quality and safety accidents due mainly to technical reasons;
(v) Serious tax violations such as tax evasion, fraudulent export tax rebates, false invoicing, etc. due to violation of the Tax Administration Law and related laws and administrative regulations;
(vi) Other serious violations of laws and regulations and breach of trust determined by judicial and administrative organs;
(vii) Enterprises terminated in accordance with law.
Article 19 If the qualification of a municipal enterprise technology center is revoked due to the reasons listed in items (1) and (2) of Article 18 of these Measures, the competent department of industry and informatization of each district (city, county and development zone) shall not recommend the enterprise again within 2 years from the date of revocation.
Article 20 of Article 18 (3) to (6) of the Measures for the reasons listed in the qualification of the revocation of municipal enterprise technology centers, from the date of revocation, the districts (cities, counties, development zones), the competent departments of industry and information technology shall not recommend the enterprise again within 3 years.
Article 21 of the districts (cities, counties, development zones) industry and information technology departments are responsible for guiding and supervising the evaluation of the basic qualification of the municipal enterprise technology center to improve its work.
Article 22 of the "Municipal Enterprise Technology Center Steering Group" member units jointly issued a document to the districts (cities, counties, development zones) industry and information technology departments and management departments at the same level to notify the municipal enterprise technology centers adjusted, withdrawn, and renamed the results of the public in the Municipal Bureau of Industry and Information Technology website.
Article 23 of the Municipal Bureau of Industry and Information Technology, the Municipal Development and Reform Commission, the Municipal Science and Technology Bureau, the Municipal Finance Bureau, the Municipal Market Supervision Bureau, the Municipal Taxation Bureau and other members of the "Municipal Enterprise Technology Center Steering Group" to provide guidance and support for the Municipal Enterprise Technology Center.
Chapter V Supervision and Penalties
Article 24 of the enterprise and its technology research and innovation institutions, third-party agencies in the application and acceptance of the review of the auxiliary work, there are fraud, concealment of the facts, collusion and cheating, the issuance of false reports, and other violations of law, the Municipal Bureau of Industry and Information Technology in accordance with the national and provincial and municipal laws, rules and regulations to be dealt with seriously, and to pursue the corresponding legal responsibility; suspected of committing a crime. Chapter VI Supplementary Provisions

Article 26 of these measures shall come into force on the date of publication, and the Administrative Measures for the Recognition of Guiyang Municipal Enterprises' Technology Centers (《Guiyang Municipal Enterprises' Technology Centers Recognition and Management Measures》(Chuigongxinfa[2021]No.28), which was published in 2021, shall be repealed.
Article 27 These Measures shall be interpreted by the Municipal Enterprise Technology Center Steering Group.
