Article 1 In order to deeply implement the innovation-driven development strategy, strengthen the status of the main body of enterprise science and technology innovation, and further enhance the scientific and technological innovation capacity of enterprises in the province, optimize and improve the "science and technology-based small and medium-sized enterprises - Gansu Province, science and technology innovation enterprises - high-tech enterprises "ladder cultivation system, boosting the development and growth of high-tech enterprises. According to "on deepening the reform of science and technology system and mechanism innovation to promote high-quality development of a number of measures" (Ganbanfa [2021] 28), with reference to the "high-tech enterprises identified management methods" (State Science and Technology Fire [2016] 32) "science and technology-based small and medium-sized enterprise evaluation methods" (State Science and Technology Development [2017] 115), combined with the actual situation in our province, the development of this approach.

Second Article The scientific and technological innovative enterprises in Gansu Province referred to in these Measures refer to the enterprises that are in line with the development direction of high-tech industry, have stable investment in scientific and technological research and development and research and development personnel, continue to carry out research and development and transformation of technological achievements, form the core of the enterprise's independent intellectual property rights, and have a strong capacity for innovation and carry out the production and business activities on this basis.

Article 3 The Department of Science and Technology of Gansu Province is responsible for the identification of scientific and technological innovative enterprises in the province. The municipal (state) science and technology administrative departments are responsible for the cultivation and management of science and technology innovation-oriented enterprises in the administrative area and recommend the work. Gansu Provincial Department of Science and Technology commissioned a third-party professional management organization to carry out services for the identification of scientific and technological innovation-oriented enterprises in Gansu Province.

Article 4 The identification of scientific and technological innovative enterprises in Gansu Province follows the principles of highlighting the main body of enterprises, encouraging technological innovation, and adhering to the principles of fairness and justice.

Article 5 The process of recognizing scientific and technological innovative enterprises in Gansu Province mainly includes enterprise declaration, recommendation of cities and states, formal review, expert evaluation, comprehensive review, public announcement of recognition and issuance of certificates.

Article 6: In general, scientific and technological innovative enterprises in Gansu Province shall meet the following conditions:

(1) Resident enterprises that have been registered in Gansu Province for more than one year, and are able to accurately attribute research and development expenses, and have sound accounting, and implement the checking of accounts and levying of revenues.

(2) The technology that plays a core supportive role for the main products (services) belongs to the scope stipulated in the "High and New Technology Fields of National Key Support".

(c) It possesses more than one independent intellectual property right that plays a core supporting role in technology for its main products (services).

(d) R&D personnel engaged in R&D and related technological innovation activities accounted for 10% (inclusive) or more of the total number of employees of the enterprise in the year.

(v) The ratio of total R&D expenses in the last two fiscal years (calculated on the basis of actual operating time if the actual operating period is less than two years) to total sales revenue in the same period complies with the following requirements:

1. The ratio is not less than 5% for enterprises with a sales revenue of less than 30 million yuan (inclusive) in the previous year;

2. million to 100 million yuan (inclusive), the proportion shall not be less than 4%;

3. For enterprises with sales revenue of more than 100 million yuan in the previous year, the proportion shall not be less than 3%.

(6) The sum of revenues from high-tech products (services) in the previous year shall not be less than 50% of the total revenues in the same period.

(vii) No major safety or quality accidents occurred in the year before the enterprise applied for recognition.

(viii) The enterprise has not committed any serious breach of trust in scientific research within one year before applying for recognition, and has not been included in the list of business anomalies and the list of enterprises in serious breach of trust.

(ix) The recognized high-tech enterprises shall not participate in the recognition of scientific and technological innovation enterprises in Gansu Province.

Article 7 Application by enterprises.

Enterprises in the Gansu Provincial Department of Science and Technology website "Gansu Provincial Science and Technology Management Information System" to declare, and submit the following materials:

(a) Gansu Provincial Science and Technology Innovative Enterprises declaration;

(b) the enterprise registered in accordance with the law to establish the evidence;

(c) enterprise intellectual property rights, scientific research project completion, transformation of scientific and technological achievements, research and development organization and management system and other supporting materials;

(d) enterprise employees and R & D personnel situation supporting materials;

(e) enterprise's previous year R & D expenditure table, with R & D activities supporting materials;

(f) enterprise's previous year of high-tech products (services) income and total revenue situation supporting materials.

Article VIII Recommendation Review.

The declaration of scientific and technological innovative enterprises in Gansu Province will be reviewed by the municipal (state) science and technology administrative departments and recommended to be submitted to Gansu Provincial Department of Science and Technology, which will commission a third-party professional management organization to conduct a formal review.

Article IX Review and Recognition.

Gansu Provincial Department of Science and Technology to organize a meeting of experts to review, combined with expert review of the opinions of the applicant enterprises to conduct a comprehensive review, put forward a list of publicity in the Gansu Provincial Department of Science and Technology website for five working days, no objection, to be identified, and issued a unified printed "Gansu Province, science and technology innovation enterprise certificate"; there are objections. By the Gansu Provincial Department of Science and Technology for verification and processing.

Article 10: The qualification of scientific and technological innovative enterprises in Gansu Province shall be valid for 3 years from the date of qualification, and the enterprises may apply for re-qualification after the expiration.

Article 11 The newly recognized scientific and technological innovative enterprises in Gansu Province shall be given subsidies in accordance with relevant policies. Re-recognized scientific and technological innovation enterprises in Gansu Province do not enjoy the subsidy. The same enterprise in the same year to enjoy a subsidy, the year at the same time was recognized as Gansu Province, science and technology innovation-oriented enterprises and national high-tech enterprises, only enjoy the subsidies of the national high-tech enterprises.

Article XII of the municipal (state) science and technology administrative departments of Gansu Province, science and technology innovation-oriented enterprises to cultivate, and recommended to the Department of Science and Technology of Gansu Province, high-tech enterprise certification, and under the same conditions, priority recommended to undertake science and technology program projects.

Article XIII of these measures by the Gansu Provincial Department of Science and Technology is responsible for the interpretation.

Article 14 These Measures shall be implemented from the date of issuance and shall be valid for five years, and the original "Measures for the Identification and Management of Scientific and Technological Innovative Enterprises in Gansu Province" (Ganke Gao Gao Gao [2018] No. 2) shall be repealed at the same time.
