General Provisions

Article 1

Purpose of Establishment

To implement the "Overall Program for the Construction of Hengqin, Guangdong and Macao Deep Collaboration Zone" and to cultivate a new normalcy. In order to implement the "Overall Plan for the Construction of Hengqin Guangdong-Macao Deep Cooperation Zone", to cultivate new impetus for economic development under the new normal, to promote the realization of high-quality development of the real economy by means of e-commerce, to make use of the advantageous resources of the synergy between Macao and Qin, and to promote the moderate and diversified development of Macao's economy, and to take into account the actual situation of the Hengqin Guangdong-Macao Deep Cooperation Zone (hereinafter referred to as "the Zone"), the Measures are formulated.

Article 2

Definitions

For the purpose of applying these Measures, the following terms are defined as:

(a) E-commerce enterprises, refers to legal persons and unincorporated organizations engaged in business activities of selling goods or providing services through the Internet and other information networks, including e-commerce platform enterprises, e-commerce brand distribution enterprises, e-commerce service enterprises, comprehensive e-commerce enterprises and other innovative e-commerce enterprises;

where "e-commerce platform enterprises", refers to the e-commerce platform business enterprises through the self-built platform to carry out self-operating activities or to provide platform services to third-party operators, including the provision of physical goods retail or wholesale services of the self-operated platform enterprises, or to provide transaction services for the third-party platform enterprises of e-commerce operators, or to provide transaction services for the third-party platform enterprises. Third-party platform enterprises providing transaction services, as well as through the Internet and other information networks to provide catering takeaway, education, medical, cultural, tourism, sports, local life and other service products enterprises;

which "e-commerce brand distribution enterprises ", refers to the third-party e-commerce platform to sell goods or provide services to the e-commerce business enterprises; or through the non-website other Internet means of selling goods or providing services to the e-commerce enterprises;

which "e-commerce services Enterprises" refers to enterprises that provide e-commerce operators with e-commerce-related services such as marketing (including live broadcasting), technology, operation, data, credit, consulting, training, logistics, financial payment, netroots incubation and operation, and comprehensive foreign trade services;

wherein Comprehensive e-commerce enterprises" refers to enterprises that simultaneously carry out the above two (or more) business activities;

where "other innovative e-commerce enterprises", refers to enterprises that carry out business through the Internet and other information networks;

where "other innovative e-commerce enterprises". refers to enterprises that carry out other types of business activities through the Internet and other information networks;

Enterprises set up in the Zone that sell goods to their Macao affiliates through other means other than websites, and then have the Macao affiliates sell the goods on the e-commerce platforms, shall be regarded as e-commerce enterprises. Macao Affiliated Company means a company established in Macao in accordance with the law, which pays taxes (including but not limited to income supplement tax and business tax) or is exempted from taxes in accordance with the law, and which is directly owned (excluding nominee holding) by an enterprise in the Zone of more than fifty percent of the shares of the Zone of Cooperation or which directly owns (excluding nominee holding) more than fifty percent of the shares of an enterprise in the Zone of Cooperation, and which engages in the same or similar business with an enterprise in the Zone of Cooperation;

(b) live e-commerce enterprises, refers to the commercial activities through the Internet site, applications, small programs, etc., in the form of live video, live audio, live graphics or a combination of a variety of live broadcasts and other forms of commercial activities to carry out marketing, including live broadcasting marketing platforms, live broadcasting e-commerce sales enterprises and live broadcasting e-commerce service enterprises;

(C) cross-border e-commerce enterprises, refers to enterprises that have applied for commercial registration in the territory and are engaged in cross-border merchandise sales or providing supporting services for cross-border merchandise sales through the Internet and other information networks, including platform-type, transactional and service-type cross-border e-commerce enterprises;

(d) Wholly-owned subsidiaries, meaning companies with 100% direct or indirect (excluding nominee) shareholding by the parent company, including the first-, second-, and third-level wholly-owned subsidiaries of the parent company;

(e) Fortune 500 companies, meaning companies that have been selected as one of the "World's Five Largest Enterprises" by the Fortune magazine in the previous year in which the application was filed. FORTUNE" magazine, "the world's largest 500 companies" list of enterprises;

(F) China's top 500 enterprises, refers to the application of the previous year was selected by the China Enterprise Confederation, the China Entrepreneurs Association to the community of the top 500 enterprises in China (f) China's top 500 enterprises, refers to the applicants who were selected in the previous year by the All-China Federation of Industry and Commerce list of China's top 500 private enterprises;

(j) E-commerce Demonstration Bases, the latest e-commerce demonstration bases selected and announced by the Ministry of Commerce in the current or previous year of application;

(k) National E-commerce Demonstration Enterprises, the latest e-commerce demonstration bases selected by the Ministry of Commerce in accordance with the "E-commerce Demonstration Regulations" in the current or previous year of application;

(l) Hengqin, Guangdong and Macao Deep Cooperation Zone Cross-border e-commerce demonstration parks are professional parks that meet the conditions and have been recognized by the Economic Development Bureau of the Zone, and are divided into leading demonstration parks and growth demonstration parks;

(xiii) Macao-funded enterprises, which refer to the investor should be a resident of Macao, or a legal person that has been established in Macao according to the law and has been engaged in the operation of the business for not less than two years, and the proportion of the shares held should not be less than twenty-five percent. The total shareholding is not less than twenty-five percent;

(xiv) Enterprises of scale (quota) or above, refers to industrial enterprises of scale or above, wholesale and retail trade of scale or above, accommodation and catering of scale or above, and service enterprises of scale or above;

(xvi) Live webcasting brokers (MCN agencies), refers to those enterprises that, in the name of the enterprise, are established on Tmall (Taobao), Jingdong Pinduoduo, Jitterbug, Shutterbug, Xiaohongshu, Tencent video number, Beili Beili, Vipshop, Yingkai live and other major live platforms to establish brokerage agency accounts, and for the signing of the anchor to provide market planning, supply chain, incubation and training and other cultural and entertainment brokerage services and business services enterprises;

(xvii) Live e-commerce base, refers to the cooperation zone to live network brokerage institutions (MCN), live e-commerce brand enterprises, live e-commerce service enterprises as the main industrial agglomeration carriers, carriers need to be equipped with a public live room, selection center, office space, etc., to meet the resident enterprise product display, e-commerce live, thematic training, salon interactions, short video filming, and other basic business needs;

(xviii) mainstream e-commerce platforms, refers to Tmall (Taobao), Jingdong, Jinduoduo (Temu), Jieyin (Tik), and other e-commerce platforms. (xxi) Macao anchor means (xxii) E-commerce professionals, meaning talents engaged in e-commerce business technology development, operation and management, marketing, data analysis, live broadcasting and design-related talents, subject to the approval of the Economic Development Board;

Enterprises that do not meet the conditions of substantial operation shall not enjoy the preferential policies;

(25) Economic contribution refers to the total amount of economic contribution formed by annual value-added income of the enterprise, annual income of the enterprise, as well as income of the enterprise from withholding and paying the income of the foreign enterprise on behalf of the foreign enterprise due to purchase of products, services and intellectual property rights provided by the foreign enterprise; annual economic contribution shall be calculated on the basis of the corresponding period of time. (xxvi) Carrying sales refers to the total amount of orders placed during the period of live carrying on domestic and overseas mainstream e-commerce platforms minus the total amount of orders returned within the commodity return cycle, which is the actual turnover amount, and is the tax-inclusive annual sales;

(xxvii) The amounts referred to in these Measures are all in RMB;

(xxviii) "Fixed Asset Investment" "Investment Amount (xxviii) "Fixed Asset Investment", "Investment Amount", "Actual Costs Incurred", "Service Costs" and "Labor Costs Expenditure" referred to in these Measures shall be based on the data in the special audit report issued by the third-party auditing organization;

Article 3

Applicable conditions

The main body of the application for support funds of these measures need to meet the following basic conditions:

(c) The application subject shall be responsible for the truthfulness, legality, and completeness of the application materials, and shall not submit to other Executive Committee of the Zone any application materials in respect of the same project or part of the project. The applicant subject shall not apply for the relevant support under these Measures if any of the following circumstances existed in the year of application or the previous year:

Basic Conditions for Applying for Recognition of Cross-border E-commerce Demonstration Parks

Those applying for recognition of cross-border e-commerce demonstration parks in the Cooperation Zone shall also meet the following basic conditions:

(1) Park Construction and Operation The main body is an independent legal person whose place of registration, tax collection and management relationship, and statistical relationship is in the Zone;

(2) The ownership of the park property is clear and definite, the planning is scientific and reasonable, and the function is accurately positioned. The infrastructure is sound, equipped with a public cross-border network line, a well-functioning public service support system, and a scientific and standardized management organization and operation mechanism;

(c) The park has facilities such as office space, a live broadcasting base, a public canteen, and commercial support facilities, and the facilities are complete;

(d) The park has a complete range of facilities such as office space, a live broadcasting base, a public canteen, and commercial support facilities;

(d) The park is equipped with a professional investment and operation service team of no less than twenty people, capable of effectively organizing the park's operation and management, with a standardized management mechanism and system, and a professional operation management system that covers investment promotion, enterprise services, property management and other aspects.

Article 5

Conditions for Applying for Recognition of Cross-border E-commerce Demonstration Parks

The Economic Development Bureau of the Cooperative Zone organizes an evaluation committee every two years. The evaluation committee is organized by the Economic Development Bureau of the Cooperation Zone every two years to rate and recognize the parks that have submitted applications and met the requirements. The "Hengqin Guangdong-Macao Deep Cooperation Zone Cross-border E-commerce Demonstration Zone" (hereinafter referred to as the Zone's Cross-border E-commerce Demonstration Zone) is categorized into leading demonstration zones and growing demonstration zones.

(1) In addition to meeting the basic conditions, the following conditions shall be met when applying for recognition as a leading demonstration zone:

(1) The overall floor area of the zone shall not be less than 50,000 square meters, and the enterprises (including platform enterprises) registered in the zone and substantially operating in the zone shall be recognized as leading demonstration zone. Cross-border e-commerce enterprises (including platform-type enterprises, transaction-type enterprises and service-type enterprises, etc.) of not less than thirty (based on the registered industrial and commercial address), the total number of e-commerce enterprises residing in the park is more than fifty (among which there are not less than ten Australian-funded enterprises), and the number of people engaging in e-commerce and paying social security in the park and actually working in the office is not less than 800;

(2) The application for recognition as a growth-oriented demonstration park shall meet the following conditions while meeting the basic conditions:

1. The overall floor area of the park shall not be less than 20,000 square meters, and registered in the park and substantially operated by Cross-border e-commerce enterprises (including platform-type enterprises, transaction-type enterprises and service-type enterprises, etc.) of not less than ten (based on the registered industrial and commercial address), the total number of e-commerce enterprises residing in the park is more than thirty (of which not less than five are Australian-funded enterprises), and the number of people engaged in e-commerce industry in the park who have paid the social security and have actually worked in the office is not less than 500;

Supporting the Development of Cross-border E-commerce Demonstration Parks

Supporting sustainable development of Cross-border E-commerce Demonstration Parks, and providing parks with Support:

(a) Fixed assets support. The recognized leading demonstration park, according to the main body of the park construction to apply for thirty percent of the actual annual fixed asset investment expenditure to give one-time support, up to 100 million yuan; recognized growth demonstration park, according to the main body of the park construction to apply for twenty percent of the actual annual fixed asset investment expenditure to give one-time support, up to 20 million yuan.

The fixed asset investment expenditure does not include the investment expenditure on large-scale commercial complexes, hotels and apartments in the park, and only includes the fixed asset investment on offices (or sites with office functions) and related necessary supporting facilities in the park, excluding the cost of civil construction, land acquisition and relocation.

(ii) Park operation subsidy. For the recognized cross-border e-commerce leading demonstration parks in the zone, according to the ratio of seventy percent and fifty percent of the actual expenses incurred in the annual operation of the park, the park will be subsidized for two consecutive years for the operation of the park, with a maximum of 20 million yuan per year. For the recognized cross-border e-commerce growth demonstration parks in the zone, according to the park's annual operation of the actual costs incurred seventy percent, fifty percent of the proportion of the park's annual operation of the park's operating subsidies for two consecutive years, up to a maximum of five million yuan per year.

The operation fee includes the park's operation cost, property service cost, information technology cost, apartment operation cost, canteen and other public supporting costs.

(3) Rewards for introducing or cultivating high-quality enterprises in the park. For the recognized cross-border e-commerce demonstration parks in the Zone, for each e-commerce enterprise above the scale (quota) introduced or cultivated to settle in the park, the operating body will be given a reward of 100,000 yuan, with a total reward of up to five million yuan for each park.

(D) Park high-quality development incentives. For the first time to obtain the business sector recognized "e-commerce demonstration base" of the park, to give the park operating body five million yuan one-time incentive. The first time the provincial business sector recognized as "leading cross-border e-commerce industrial parks" and "growth-oriented cross-border e-commerce industrial parks" parks, respectively, to give the park operating body three million yuan and one million yuan one-time incentive.

Encourage the creation of live broadcast e-commerce bases

Support for live broadcasting e-commerce base construction. The construction of cross-border e-commerce demonstration parks in the recognized cooperation zones or the operation of the main body of the park to build their own live e-commerce bases, in principle, will no longer enjoy the support of this item.

The total area of the live streaming e-commerce base set up in the recognized cross-border e-commerce demonstration zones in the Zone should not be more than 20% of the total gross floor area of the zone.

The investment subsidy for the operating body of the recognized live broadcasting e-commerce base to set up an affiliated entity in Macao and lease a site of not less than 200 square meters to carry out live broadcasting, business incubation, talent training and other businesses shall be implemented in accordance with the 120% investment subsidy for the operating body of the cooperation zone.

Support the base to strive for platform empowerment. For the first time at home and abroad to obtain the mainstream e-commerce live platform licensing "live e-commerce base", a one-time award of 500,000 yuan, to obtain a number of platforms authorized to recognize the award will not be repeated.

Article 8

Conditions for Recognition of Live E-commerce Bases

Application for Recognition of Live E-commerce Bases needs to meet the following conditions:

Encourage cross-border e-commerce service providers to provide cross-border e-commerce enterprises with professional services, such as data services, logistic services, financial services, marketing services, and other professional services, and to promote cross-border e-commerce industry development. For service cross-border e-commerce enterprises not less than ten, annual operating income of not less than 20 million yuan of service providers, and annual operating income growth of not less than 20%, according to the cross-border e-commerce service costs of five percent of the capital subsidies, the maximum of two and a half million yuan per year per enterprise. For the establishment of cross-border e-commerce O2O offline experience stores in the cooperation zone with customs supervision conditions. In accordance with the principle of reasonable use of space, with reference to the third-party professional institutions of the appraisal of 80% of the price and a maximum of 80 yuan per square meter per month to give rental subsidies to the same enterprises or associations subsidies for the same area of up to 3,000 square meters, a maximum of 24 consecutive months of subsidies.

For cross-border e-commerce enterprises to open an independent station business, and the previous year to achieve cross-border e-commerce transactions reached 30 million yuan RMB, according to the independent station construction costs, cloud servers, SaaS technology service fees, information management system development and maintenance costs, system equipment costs, such as 50% of the costs of a one-time support. The maximum subsidy for each enterprise is eight hundred thousand yuan.

Article 12

Support for renting overseas warehouses

Cross-border e-commerce enterprises whose main business is exporting rent warehousing facilities outside China to provide warehousing, logistics, inventory management, and inventory management services. Provide their own warehousing and logistics, inventory management, returns and after-sales services, the total area of overseas warehouses to reach 1,000 square meters and cross-border e-commerce annual turnover of not less than 5 million U.S. dollars, in accordance with the actual leasing costs of 50 percent of the subsidies, the maximum of one million yuan per year per enterprise.

Cross-border e-commerce enterprises leasing the use of third-party public overseas warehouse, and cross-border e-commerce annual turnover of not less than three million U.S. dollars, in accordance with the actual leasing costs of fifty percent of the subsidies, each enterprise up to five hundred thousand yuan per year.

Article 13

Supporting enterprises to take out logistics insurance

For cross-border e-commerce enterprises insured by insurance organizations in Macao or the Zone, the storage risk incurred in warehousing and logistics will be subsidized. For cross-border e-commerce enterprises insured by insurance institutions in Macao or in the cooperative zone, the premiums for warehouse insurance, shipping documents insurance and transportation insurance arising from warehousing and logistics will be given a subsidy of no more than 20 percent of the paid premiums, with a maximum subsidy of 300,000 yuan per year for each enterprise.

If the appraisal price is higher than the actual leasing price, the actual leasing price as the basis for subsidies in accordance with 80%, rent-free period will not be subsidized.

E-commerce and e-commerce companies that have settled in the Zone and have a combined business revenue of more than 10 billion yuan in three fiscal years shall be subsidized. Encourage enterprises to cooperate with major universities in Macao and the Mainland, and support social training institutes, e-commerce enterprises, industry associations, mainstream e-commerce platforms, and live webcasting brokers (MCN agencies) to carry out training related to e-commerce, cross-border e-commerce, and live broadcasting. E-commerce industry-related training to comprehensively strengthen the construction of e-commerce talent.

No more than five standardized e-commerce training bases are identified through enterprise applications, and an annual assessment and exit mechanism is implemented. For e-commerce enterprises stationed in cross-border e-commerce demonstration parks of the cooperation zones recognized to be of scale ( quota) above e-commerce enterprises are rewarded with a quota of senior management and operation personnel.

Senior management and operation personnel are required to sign labor contracts, labor service contracts or employment agreements with enterprises for more than three years (inclusive) and work on-site in the Zone, and are rewarded annually in accordance with the total taxable salary of the previous year based on the extent of their contribution to the development of the enterprise. For the above senior management and operation personnel with annual salary of 500,000 yuan (inclusive) or more, a reward of 50,000 yuan will be given.

The number of senior management and operation personnel of the same enterprise applying for this incentive shall not exceed ten percent of the total number of employees of the enterprise, and the cumulative total of the year shall not exceed ten persons.

Improve the e-commerce talents' life protection 

The e-commerce enterprises and associations that are stationed in the cross-border e-commerce demonstration parks of the cooperation zones are recognized. The e-commerce enterprises and associations in the demonstration zones of the recognized e-commerce enterprises and associations employing e-commerce professionals to work in the cooperation zone, the e-commerce professionals below the bachelor's degree (excluding the bachelor's degree) will be given apartment rent subsidies in accordance with the per person of 60,000 yuan to be issued in equal installments over three years.

The applicant should have continuously paid personal income tax and social insurance in the Zone and still be paying personal income tax and social insurance in the Zone as of the end date of the current subsidy application.

For the first application of this subsidy, the applicant must have paid the individual income tax and social insurance continuously for at least six months, for the second application, the applicant must have paid them continuously for at least 24 months, and for the third application, the applicant must have paid them continuously for at least 36 months.

Overseas talents who enjoy exemption from payment of social insurance in Mainland China or domestic talents who are unable to pay social insurance in the Zone due to objective reasons are only required to provide proof of individual income tax.

If the type of activity belongs to the category defined in the "Support Measures for the Development of the Convention and Exhibition Industry in Hengqin Guangdong-Macao Deep Cooperation Zone", it will be implemented in accordance with the standards of the Support Measures, and the incentives will not be repeated.
