Interim Opinions of Quanzhou Taiwan Business Investment Zone on Regulating the Operation and Development of B&Bs

In order to deeply implement Xi Jinping's thought of socialism with Chinese characteristics in the new era, implement the spirit of General Secretary Xi Jinping's important speech to visit Fujian, vigorously implement the strategy of rural revitalization, and further regulate the management of lodging in our region, improve the quality of lodging services, and promote the development of lodging economy. According to "Fujian Province Tourism Regulations", "Ministry of Housing and Urban-Rural Development, Ministry of Public Security, National Tourism Administration on the issuance of the "Nongjiale (B&B) building fire guidelines (for trial implementation)" notice" (Jianmura [2017] No. 50), "Basic Requirements and Evaluation of Tourist B&Bs" (LB/T065-2019) Amendment No. 1, "General Office of the People's Government of Fujian Province on the promotion of the development of a number of measures of B&Bs notice "(Fujian Government Office [2022] No. 36) and other provisions, combined with the actual situation in our region, has developed this opinion.  

First, the object definition 

B&B refers to the local residents or other business subjects in the countryside and tourist attractions and other specific areas, the use of residential housing, collective housing or other housing, combined with local Natural landscape, humanities and customs, agriculture, forestry, animal husbandry and fisheries production activities, the overall design, repair and renovation, so that the building appearance, indoor and outdoor decoration and configuration and business premises with distinctive regional cultural characteristics, to provide tourists with accommodation services to experience the local nature, culture and production of lifestyle business premises (excluding budget hotels, apartment hotels, etc.).  

Second, the application requirements 

(a) B&B site selection in line with the jurisdiction of the territorial spatial planning, urban and rural planning, the architectural style should be coordinated with the local folklore, landscape and environment, with the countryside and local characteristics.  

(2) The ownership of the building is clear and undisputed.  

(C) the bed and breakfast room shall be a free-standing building, the main building does not exceed 4 floors, the floor area does not exceed 800 square meters, the number of guest rooms is not less than 5 (sets), not more than 14 (sets), the number of beds should be 30 beds or less (large beds in order to calculate the number of two beds).

Third, the application process 

(a) pre-approval of the name of the lodging

(2) Legal representative (principal person in charge) ID card.  

(3) clear proof of ownership of the B&B building, including but not limited to the land use right certificate, house ownership certificate, real estate right certificate, above the county level, deed paper, town ticket, village ticket and other effective procedures; lease operation should also provide a lease contract.  

(4) B&B building ownership clear, non-controversial announcements and photographs (see Annex 2, the announcement needs to be posted on the B&B business houses, the announcement time is 3 days).  

(5) Original photographs, architectural elevation design program, decoration design effect.  

(6) A number of photos of the inside and outside view of the B&B after renovation, including panoramic views of the building exterior, public recreation areas, guest rooms, room types, and other photos of the actual scene.  

(7) Qualified institutions with appropriate qualifications for the B&B business premises for the reliability of the structure of the house or security testing and identification report.  

(8) After the completion of the renovation, provide the fire safety assessment report issued by the fire safety technical service organization with statutory qualifications.  

(9) B&B business commitment (see Annex 3).

2. In line with the territorial spatial planning of the assembled bed and breakfast application materials: 

(1) "Quanzhou Taiwan Business Investment Zone, XX townships, bed and breakfast business declaration form.  

(2) Legal representative (principal person in charge) ID card.  

(3) Project project or the text of the project contract with the government.  

(4) Original photographs, architectural elevation design plans, decoration design renderings.  

(5) A number of photos of the inside and outside views of the B&B after renovation, including panoramic views of the building exterior, public recreation areas, guest rooms, room types, and other photos of the actual scene.  

(6) B&B business commitment (see Annex 4).  

(C) village (community) town verification

(D) district-level recognition 

After the township verification, B&B operators to pre-approved B&B name for the relevant procedures.  

1. To the District Administrative Approval Service Bureau to apply for a "business license", for the "food business license" (does not involve food and beverage need not be processed).  

2. To the District Bureau of Livelihood Protection to apply for the "Public Places Health License".  

3. After the completion of the relevant procedures, by the District B&B management leading group office to grant the "Quanzhou Taiwan Business Investment Zone B&B" signage.  

4. District Public Security Bureau in accordance with the management of the B&B management leading group office letter awarded the "Quanzhou Taiwan Business Investment Zone B&B" signage business list, consulting with the higher authorities to install the B&B security management information system and guide the B&B operators to install the second generation license. Fourth, supervision and management 

B&B management adheres to the principle of territorial management, the township government for the B&B verification and management unit. District Education, Culture, Sports and Tourism Bureau: responsible for star rating B&B; organization to carry out B&B publicity and marketing, practitioners of business management and service skills training and other work.  

District People's Livelihood Protection Bureau: responsible for the B&B "public places health license" approval; responsible for the B&B practitioners health certificate for the processing, the annual inspection; to strengthen the daily operation of the B&B health supervision, according to the law to investigate and deal with illegal business practices.  

District Finance and State-owned Assets Bureau: with the District Education, Culture, Sports and Tourism Bureau to introduce and implement the relevant policies to support the B&B industry.  

District Administrative Examination and Approval Service: responsible for the B&B name pre-approval, "Business License" registration and "Food Business License" approval; responsible for reviewing and approving the assembly of B&B projects in line with the territorial spatial planning of the project materials; responsible for the development of the B&B application online verification work.  

District Market Supervision Administration: guide and supervise the B&B operators in accordance with market supervision and management laws and regulations of the relevant provisions of the integrity of the business, fair competition; to strengthen food safety supervision, supervise the implementation of the main responsibility of the B&B operators of food safety; guidance and supervision of B&B operators in accordance with law marking prices, investigate and deal with price The main reason for this is that it is not a good idea to have a good time.

District Comprehensive Law Enforcement and Emergency Management Bureau (District Security Office): responsible for investigating and dealing with illegal use of land; supervise the various industry regulators in accordance with the responsibility of production safety to grasp the day-to-day supervision; with the townships in which the advertisements of the lodging store signs, logos, signs, and remediation.  

District Fire and Rescue Brigade: to strengthen the comprehensive supervision of the fire of the B&B, and strengthen the B&B owners of the fire laws and regulations of publicity and education training.  

The township people's government: the fulfillment of the local management responsibility, responsible for the jurisdiction of the B&B verification, guidance, services, statistics, safety production and other day-to-day supervision and management work, and do a good job of land, building ownership verification work.  

District Investment Group Co., Ltd: is responsible for reviewing and checking compliance with the territorial spatial planning of the assembled lodging project and the government signed the investment contract.  

Fifth, the legal responsibility

(D) When an emergency occurs, the B&B operator shall report to the local township people's government in accordance with the relevant provisions of the state, the district B&B management work of the leading group office and the relevant departments at the district level. (D) B&B reference to the hotel industry related regulations for management, the operator should be operated in accordance with the law, standardized management, civilized service, according to the law and pay taxes. Six, bylaws 

(a) The specific interpretation of this opinion by the Quanzhou Taiwan Business Investment Zone Management Committee of the Education, Culture, Sports and Tourism Bureau.
