Chapter I General Provisions
Article 1 In order to deeply implement the strategy of strengthening the province with talents, to fully stimulate the innovation and vitality of talents, and to further encourage and attract the outstanding overseas talents to come to Shanxi Transformation and Comprehensive Reform Demonstration Area (hereinafter referred to as "Shanxi Transformation Comprehensive Reform Demonstration Zone") innovation and entrepreneurship, to promote the construction of regional overseas talent gathering heights, and actively contribute to the full range of high-quality development, is the development of this approach.
The second focus on support to China Shanxi Overseas Educated Personnel Entrepreneurship Park (hereinafter referred to as "stay in the park") as a carrier to carry out innovation and entrepreneurship services for overseas Chinese students, by the examination and approval of the enterprises of overseas Chinese students must be stationed in the stay in the park to carry out innovation and entrepreneurship activities. The "RCCP" is the carrier of the Shanxi Provincial People's Government. It is a state-level entrepreneurship park for overseas Chinese students built by the Shanxi Provincial People's Government and the Ministry of Human Resources and Social Security, which provides a full chain of professional incubation services for overseas Chinese students' innovation and entrepreneurship.
Article 3 The Administrative Committee of Shanxi Transformation and Comprehensive Reform Demonstration Zone has set up a "special fund for innovation and entrepreneurship of overseas Chinese students", which is included in the annual budget of Shanxi Transformation and Comprehensive Reform Demonstration Zone and is arranged to be no less than 20 million yuan for encouraging and supporting the innovation and entrepreneurship of overseas Chinese students every year. The special fund is mainly used for the innovation and entrepreneurship of overseas Chinese students. The special fund is mainly used for the innovation and entrepreneurship start-up support program for overseas Chinese students, housing rental, property, heating and air-conditioning, and other related expenses, as well as the innovation and entrepreneurship environment and atmosphere in the park.
Chapter II Supervision, Management Organizations and Responsibilities
Article 4: The Ministry of Human Resources is the supervisory department of the Park. The Talent Introduction and Exchange Service Center (Talent Office, Overseas Educated Personnel Pioneer Park Service Center) (hereinafter referred to as "Talent Center") is responsible for the daily management and operation of the Park as well as the services for the overseas educated personnel and the enterprises of overseas educated personnel, with the following specific duties:
(a) It is responsible for the construction of the national-level Overseas Educated Personnel Pioneer Park and the national-level science and technology business incubator jointly built by the Ministry and the provincial government, and actively creates an innovative and entrepreneurial atmosphere that encourages entrepreneurship and tolerates failure. It carries out the work of recruiting talents and attracting talents to the park, examines the qualifications of overseas students and enterprises of overseas students, handles the formalities for enterprises of overseas students to enter the park, and implements the policies of national, provincial, municipal, and district overseas students returning to their home countries for innovation and entrepreneurship. Organize and counsel overseas Chinese enterprises to declare all kinds of national, provincial and municipal talents and science and technology projects. Organize overseas Chinese enterprises to participate in all kinds of domestic and foreign talents, science and technology exchange exhibitions and activities.
(2) Independent or entrusted talent services, science and technology projects, incubator management and other third-party professional service organizations to provide the following services for the foreign students and foreign students' enterprises: day-to-day service management based on the whole chain of the incubator, the construction of public platforms, entrepreneurial mentor counseling, entrepreneurial activities, the formulation of development strategies, A series of professional incubation services such as key technology support, docking with investment and financing institutions, market promotion and operation, and coordination of land demand, etc., and actively explore the reform practice of "separation of management and operation"; full-process management of the project of innovation and entrepreneurship start-up support program for overseas Chinese students (the entrusted party shall have more than three years' experience in the management of provincial-level scientific and technological program projects, and at the same time, have the experience in the management of the project of overseas Chinese students' entrepreneurship). The trustee must have more than three years of provincial science and technology program project management experience, and at the same time have the experience of project management services for overseas students' entrepreneurship, and have a professional project management team.
(3) other work assigned by the Management Committee of Shanxi Transformation and Comprehensive Reform Demonstration Zone.
Chapter III Conditions and Procedures for Admission to the Park
Article 5 Overseas Chinese students referred to in these Measures are:
(1) those who have obtained a state-recognized bachelor's degree or a bachelor's degree from an institution of higher education in a foreign country, (a) International students who have obtained state-recognized bachelor's degrees or above in foreign institutions of higher education and scientific research (bachelor's degrees are required to be from the top 500 universities in the world rankings announced by authoritative institutions, excluding the domestic ones; master's degrees and above are not required).
(2) Those who have obtained a master's degree or above in China and have a master's degree or above, or have obtained an intermediate title or above, and have gone to overseas institutions of higher education or scientific research institutes to be visiting scholars or postdoctoral fellows for one year.
(c) Equivalent candidates studying in Hong Kong, Macao and Taiwan.
Article 6 Overseas Educated Personnel Enterprises referred to in these Measures refer to enterprises wholly owned or jointly owned by overseas educated personnel, established in the Shanxi Transformation and Comprehensive Reform Demonstration Zone, and with independent legal personality. The establishment time of the enterprise is generally not more than 24 months, and the relocation from outside the zone to the Shanxi Transformation and Comprehensive Reform Demonstration Zone is not subject to the establishment time limit. Overseas students must be capital or technical equity in the enterprise, and the proportion of shares accounted for no less than 30% (including 30%), overseas students must be the legal representative of the enterprise, for the enterprise to provide project sources, technical support and business management services.
Article 7 The projects of the Innovation and Entrepreneurship Start-up Support Program for Overseas Chinese Students should have high growth and be in line with the direction of the development of the leading industries in the Shanxi Transformation and Reform Demonstration Zone and the relevant environmental protection requirements, with a clear development plan and entrepreneurial plan, and have their own funds corresponding to the entrepreneurial plan.
Article 8: Enterprises applying for admission to the Park shall submit the following materials and be responsible for their authenticity and legitimacy:
(1) Application for Overseas Educated Personnel Innovation and Entrepreneurship Start-Up Support Program Project;
(ii) Business plan of the project of Overseas Educated Personnel Innovation and Entrepreneurship Initiation Support Program;
(iii) attached materials.
1. Business license, articles of association, shareholders' resolution, capital verification report (only for innovative projects) and other valid information;
2. Visiting scholars or postdoctoral fellows must submit their domestic ID cards, domestic academic degree certificates or title certificates, certificates of returnees (if they return to their home countries after October 1, 2020 and are unable to issue certificates of returnees, they must submit documents of acceptance to foreign institutions or scientific research organizations, and certificates of acceptance to foreign institutions or scientific research organizations). Admission materials of foreign institutions or scientific research institutions, foreign institutions or scientific research institutions issued by the study and further training certificate materials, and provide passports and visas, immigration information, return trip tickets, etc. used to prove that the period of study) and other valid information;
4. Overseas Chinese students corresponding to the level of talent to prove that they own intellectual property rights of technology; special Industry qualifications (environmental assessment reports or documents, safety monitoring reports, market access certificates, product certification, qualification certificates, etc.) and other valid information.
Article IX: The evaluation of projects under the Innovation and Entrepreneurship Start-up Support Program for Overseas Chinese Students will be held twice a year, with the participation of overseas Chinese students and members of the core team of the enterprise. After passing the formal review of the projects under the Innovation and Entrepreneurship Start-up Support Program for Overseas Educated Personnel, they are required to undergo an on-site defense, and the evaluation committee composed of experts in the relevant fields will make a comprehensive assessment of the qualifications of the overseas educated personnel, as well as the project's technological level, the ability of the core team, and the prospects for market development, and then come up with the evaluation results. The evaluation results are divided into five grades: excellent, good, good, qualified and unqualified, and the evaluation rules of the Overseas Educated Personnel Innovation and Entrepreneurship Start-up Support Program are formulated separately. The evaluation results shall be publicized to the society after being reviewed and approved by the Ministry of Human Resources, and the publicity period shall be not less than 5 working days. Any unit or individual with objections to the public notice shall submit written objections to the Talent Center within the public notice period, and the Talent Center shall investigate and verify the objections. Objection is established, the results of the matter is publicized; objection is not established, inform the objector or unit in writing.
Article 10 of the audit and publicity of no objection to the foreign student enterprises and talent centers to sign the "China Shanxi Overseas Educated Personnel Pioneer Park Business Incubation Agreement", the incubation period is generally no more than 48 months (the technology field of biomedicine, modern agriculture, integrated circuits of the enterprise, the incubation period of no more than 60 months), the foreign student enterprises with the signed "China Shanxi Overseas Educated Personnel Pioneer Park", and the incubation period of no more than 60 months. The incubation period is generally more than 48 months (the incubation period for enterprises in the technology field of biomedical, modern agriculture and integrated circuit is not more than 60 months), and the enterprises of overseas Chinese students will sign the Agreement on Enterprise Incubation of China Shanxi Overseas Chinese Students Pioneer Park with the signed Agreement on Enterprise Incubation of China Shanxi Overseas Chinese Students Pioneer Park and sign the lease and property contract with Shanxi Fenfei Development Group Co.
Article 11: Those who voluntarily continue to carry out innovation and entrepreneurship activities in RIP after the expiration of the incubation agreement or the exemption of housing rental fee must submit a written application 15 working days before the expiration of the incubation agreement or the exemption of housing rental fee. The Talent Center will arrange and renew the "Agreement on Business Incubation in China Shanxi Overseas Educated Person Pioneer Park" if the conditions of the site allow, and the office and R&D space rental fee and related expenses will be charged by Fenfei Group according to the same period of time of Staying in Venture Park. If the incubation agreement period or the exemption of housing rental fee expires after the voluntary departure of the overseas Chinese enterprises, they will be given a buffer period of 5 working days to move out, and if their overseas Chinese innovation and entrepreneurship start-up support program projects are still in the implementation period, they will be allowed to continue to carry out their projects based on the content of the project plan and task book until the project acceptance and closure.
Chapter IV Encouragement
Article XII: Establishment of "Overseas Educated Personnel Innovation and Entrepreneurship Start-up Support Program" is used to support the innovation and entrepreneurship activities of enterprises of overseas educated personnel. The support program is divided into innovation and entrepreneurship categories.
Innovation projects require the entrepreneurial team to have a certain degree of scientific and technological innovation ability, the enterprises of overseas Chinese students are engaged in the research and development of high and new technology and products and the transformation of results, and to carry out business activities based on this, the project must be in line with the "national key support for high-tech areas", with the intellectual property rights and the identification of high-tech enterprise plans for the next 2-3 years, and the actual implementation of the program. Recognized high-tech enterprise planning, and paid-in capital is not less than 50% of the total estimated investment of the project of the Overseas Educated Personnel Innovation and Entrepreneurship Start-up Support Program, and the overseas students should have a master's degree or above.
Entrepreneurship projects generally support the entrepreneurial team engaged in cross-border e-commerce, cultural creativity, art design and other new business activities in line with national laws and regulations.
Article XIII: Projects approved by the Overseas Educated Personnel Innovation and Entrepreneurship Start-up Support Program (Innovation Category) will be given 20-1 million RMB start-up funding. According to the relevant talent tiering standards, the projects of A, B and C categories of overseas students shall be given the maximum of 1 million yuan for "excellent" grade, 700,000 yuan for "good" grade and 500,000 yuan for "good" grade; the projects of D and E categories shall be given the maximum of 500,000 yuan for "good" grade. The maximum amount is 500,000 yuan; the maximum amount of "excellent" grade, "good" grade, "300,000 yuan", and "good" grade, "200,000 yuan", will be given to the programs of category D, E and other overseas Chinese students. The maximum amount of grant is 200,000 yuan. Projects under the Innovation and Entrepreneurship Start-up Support Program for Overseas Educated Scholars (Entrepreneurship Category) that are assessed as "excellent" will be given a maximum of 200,000 RMB as start-up funding. The actual amount of support for start-up funding is calculated on a pro rata basis, and within the maximum support amount, it is in principle no more than 50% of the total estimated investment of the projects under the Overseas Educated Personnel Innovation and Entrepreneurship Start-up Support Program.
Article XIV of the review and approval of the overseas student innovation and entrepreneurship start-up support program projects, the implementation of office and R & D space first use after paying rent support policy. For those enterprises with qualified annual assessment, the Overseas Educated Personnel Innovation Park will directly subsidize the rent for the year of assessment, with the subsidized area not larger than 300 square meters and the subsidized period not exceeding 3 years, and the subsidized area will be determined by combining the actual usage demand of the enterprises with the expert assessment. For those enterprises with unqualified annual assessment, they are required to pay the full amount of rent for the assessment year in accordance with the same standard of RC Park.
Article 15 Overseas Educated Personnel Enterprises with "Qualified" rating can voluntarily sign the "Agreement on Business Incubation in China Shanxi Overseas Educated Personnel Pioneer Park" to rent office and R&D space at the same time of the same period of the standard price of the rental fee of the housing in the Park and enjoy the same benefits of the full range of services provided by the Park. Equally enjoy the whole chain and professional incubation services provided by the Park.
Chapter V: Cooperation in attracting talent
Article 16: Actively explore overseas offshore innovation and entrepreneurship work practices, the establishment of the "registered in the region, at sea and abroad" model to attract overseas talent to Shanxi Transformation and Comprehensive Reform. Attract overseas talents to Shanxi Transformation and Comprehensive Reform Demonstration Zone for innovation and entrepreneurship. The cooperative organizations that have outstanding results in establishing "offshore innovation and entrepreneurship bases" in foreign countries to gather overseas talents and import high-quality projects will be rewarded and subsidized. For the cooperative organizations that have signed the cooperation agreement and set up the overseas offshore innovation and entrepreneurship base of the Reunion Park, the projects of overseas talents introduced by them (subject to the formal pre-incubation or introduction agreement signed between the cooperative organizations and the overseas talents) can apply for 100,000 RMB operation subsidy in the year when they set up their enterprises in Shanxi Transformation and Comprehensive Reform Demonstration Zone and are finally reviewed and approved by the evaluation meeting of the park, if they introduce the number of enterprises that meet the above requirements up to 5 each year. Subsidies; subsidies of 30,000 yuan for each additional one introduced during the year, with the total annual subsidy not exceeding 400,000 yuan.
"Overseas Offshore Innovation and Entrepreneurship Base" partner organizations must meet the following basic conditions:
(a) Independent domestic legal entity, with the ability to carry out left;">(c) Have two or more successful incubation projects landed in Shanxi Transformation and Comprehensive Reform Demonstration Zone in the past three years.
Article XVII Actively explore domestic enclave economy practice, strengthen the domestic advantage of industrial docking, and actively undertake the spillover of talent and project resources. For the establishment of "Domestic Enclave Innovation and Entrepreneurship Base" in advanced areas of the country for the stay in the park of innovation and entrepreneurship, the cooperation organization with outstanding results in gathering entrepreneurs of foreign students and importing high-quality projects will be given awards and subsidies. For the partner organization that has signed the cooperation agreement and established the domestic enclave innovation and entrepreneurship base of the Reunion Park, if the projects of the overseas Chinese students introduced by the partner organization (with the formal pre-incubation or introduction agreement signed between the partner organization and the overseas Chinese students) are set up in the Shanxi Transformation and Comprehensive Reform Demonstration Zone and passed the final examination and approval by the evaluation meeting of the park, if the number of the enterprises introduced each year meets the above requirements reaches 5, the organization can apply for RMB 100,000 yuan of operation subsidy for the same year. The subsidy is 20,000 RMB for each additional enterprise introduced during the year, and the total annual subsidy is not more than 300,000 RMB.
"Domestic Enclave Innovation and Entrepreneurship Base" cooperative organizations must meet the following basic conditions:
(a) Domestic independent legal entity, with the ability to carry out (a) independent domestic legal entities, with the ability to carry out the pre-incubation of projects of overseas students in advanced regions of China and the transformation of the results of the Shanxi Transformation and Comprehensive Reform Demonstration Zone in the whole process of service work;
(b) owns no less than 2,000 square meters of incubation space in advanced regions of China, with no less than five full-time staff;
Chapter VI Expansion and Establishment of Sub-parks
Article 18 Encouragement and support for the establishment of sub-parks of the Reunion Park to expand the mode of radiation, drive, and lead the development of overseas talents in Shanxi Province. The application for the establishment of sub-parks should have the following basic conditions:
(1) independent legal personality, sound organizational structure and rules and regulations, and standardized and orderly management and operation;
(2) attach importance to the work of entrepreneurship of overseas educated persons returning to China, and have more complete functions
(b) attach importance to the entrepreneurial work of overseas Chinese, have a more complete business incubation service system, and have the ability to provide office and research and development space for the enterprises of overseas Chinese;
(c) have no less than five enterprises of overseas Chinese.
Article 19 The application for the establishment of a branch of RETP shall be submitted to the Talent Center with a written application, and after the preliminary examination by the experts and on-site inspection and evaluation, and if it meets the conditions, it shall be reported to the Ministry of Human Resource for approval and granted a license after no less than five working days' publicity without any objection.
Chapter VII Supervision and Management
Article 20: If an enterprise of studying abroad that has been approved changes its name or reorganizes itself, it shall re-apply for review and approval of the qualification of enterprises of studying abroad within 15 working days after the change. Article 20 Overseas Chinese enterprises that have been re-examined and approved shall implement the relevant support policies in accordance with the principle of non-duplication.
Article 21 The Park implements an annual assessment system for enterprises, and strictly enforces the exit mechanism for unqualified enterprises. If any one of the following cases occurs, the Talent Center will notify it in writing to cancel the qualification of staying in the Park, and Fenfei Group will return the office and R&D space used by it within 5 working days, and at the same time, immediately suspend its enjoyment of other relevant support policies:
(a) Being investigated or reported to have Provide false information, take fraudulent means to obtain the qualification of the enterprise of overseas students.
(ii) No longer meet the conditions for admission to the Park or fail the annual assessment.
(c) Overseas Chinese enterprises that have changed their names or reorganized their businesses without re-applying for review of their qualifications in accordance with the stipulated time.
(d) There are cases of tax evasion, poor integrity, intellectual property infringement, or falsification of statistical data, or serious violations of national, provincial, or municipal laws and regulations, or the management regulations of the Overseas Chinese Entrepreneurship Park (OCEP).
(e) Unauthorized change of business direction or substantial stagnation or cessation of the Overseas Educated Personnel Innovation and Entrepreneurship Start-up Support Program project, or unauthorized change of the use of the office and R&D space or transfer to others.
(f) If the office and R&D space is left vacant for more than 60 working days in a year from the start of incubation.
Article 22 Supervision and management of innovation and entrepreneurship start-up grants shall be carried out in accordance with the "Administrative Measures for Financial Support Funds of Shanxi Transformation Comprehensive Reform Demonstration Zone" and "Supervision and Management Measures for Implementation of Policies for Supporting Enterprises in Shanxi Transformation Comprehensive Reform Demonstration Zone". At the same time, we will separately formulate the rules for the use and project management of the funding for the Overseas Student Innovation and Entrepreneurship Start-up Support Program, and develop corresponding assessment standards for different projects.
Article 23 Overseas Chinese Enterprises receiving support from Overseas Chinese Enterprises Innovation and Entrepreneurship Initiation Support Program (Innovation and Entrepreneurship "excellent" grade) shall sign the "Overseas Chinese Enterprises Innovation and Entrepreneurship Initiation Support Program Project Mission Statement" and carry out the Overseas Chinese Enterprises Innovation and Entrepreneurship Initiation Support Program in strict accordance with the relevant contents signed in the mission statement. Enterprises supported by Overseas Educated Personnel Innovation and Entrepreneurship Start-up Support Program (innovation and entrepreneurship "excellent" grade) must sign the "Overseas Educated Personnel Innovation and Entrepreneurship Start-up Support Program Project Mission Statement" and strictly follow the relevant contents of the mission statement to carry out the implementation of the project. Start-up funding by the policy to cash through train approval process by the financial management and operation of the part of the two batches of payment, students enterprises in the park and normal operation of three months after the first 60%, students innovation and entrepreneurship start-up support program project through the acceptance of the payment of another 40%.
Article 24 Fenfei Group is responsible for the venue guarantee of the Reunion Park. In case the space of the Park is full, Fenfei Group is responsible for arranging the expansion space for the Park in other buildings belonging to Fenfei Group to meet the demand of office and R&D space for the enterprises of overseas Chinese students. Fenfei Group will summarize and report the annual (non-natural year) office and R&D space rental fee, property, heating and air-conditioning and other related expenses (minus the part paid by the enterprises) to the Talent Center before the end of October every year, and the Talent Center will apply for the related funds from the Financial Management and Operation Department and pay them to the Fenfei Group after reviewing and approving the application.
Article 25 If the subsidized area of housing rental fee for the enterprises enjoying the subsidy for the overseas Chinese students is not enough to meet the actual usage requirements, the Talent Center will make the arrangement if the conditions of the site permit, and the Fenfei Group will charge the housing rental fee according to the standard of the same period of the housing rental fee of the Staying in Chuangye Park for the part of the area exceeding the subsidized area.
Article 26 The "Overseas Offshore Innovation and Entrepreneurship Base" or "Domestic Enclave Innovation and Entrepreneurship Base" of Reunion Park, which has signed the cooperation agreement and listed on the license plate, shall introduce fewer than 5 enterprises of overseas Chinese students in each consecutive year. If fewer than 5 enterprises with overseas students are introduced, the license shall be removed after the approval of the Ministry of Human Resources, and the cooperation agreement shall be terminated at the same time.
Article 27 The Talent Center has the obligation to provide business guidance to the co-built sub-parks, but does not participate in the daily management and operation of the co-built sub-parks. The sub-park shall implement the work report system and dynamic withdrawal mechanism, and the sub-park shall submit an annual work summary report to the Talent Center in December of each year. If one of the following situations exists in the sub-park, the Talent Center will cancel the qualification of the sub-park after reporting to the Ministry of Human Resources:
(a) No new enterprises of overseas Chinese students have entered the sub-park for two consecutive years.
(ii) Changing the main function of the branch park and not having the capability of business incubation.
(c) The sub-park operates in violation of the law, or seriously damages the reputation of the Park.
(d) Other cases that should be canceled.
Article 28 If the foreign students and enterprises of the foreign students have enjoyed other similar and comparable policies to support the foreign students other than those of Shanxi Transformation and Comprehensive Reform Demonstration Zone, these measures shall be applied in accordance with the principle of non-repeat.
Chapter VIII Supplementary Provisions
Article 29 These Measures shall come into force on September 26, 2023, and shall be valid until December 31, 2026. The original "Shanxi Transformation Comprehensive Reform Demonstration Zone Measures to Encourage Innovation and Entrepreneurship of Overseas Educated Personnel" (Jin Zongshifa [2021] No. 90) shall be repealed at the same time. In case of inconsistency between other relevant policies and these Measures, these Measures shall prevail. In case of national, provincial and municipal policy adjustments during the implementation process, the higher-level policies will be adjusted accordingly.
