Notice of the Changzhi Municipal People’s Government on Issuing the Action Plan for Innovation and Improvement of the Business Environment in Changzhi

To thoroughly implement the "Regulations on Optimizing the Business Environment" and the "Shanxi Province Regulations on Optimizing the Business Environment," comprehensively improve the business environment, and stimulate new vitality for high-quality development, this plan is formulated in accordance with the relevant requirements of the "Shanxi Province Action Plan for Innovation and Improvement of the Business Environment" (Jin Zheng Fa [2022] No. 16) and in light of local conditions.

I. Guiding Principles

Guided by Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, we will thoroughly implement the spirit of General Secretary Xi Jinping’s important instructions during his inspection tour of Shanxi, fully carry out the spirit of the 12th Provincial and Municipal Party Congresses, comprehensively deepen the supporting actions of the “Five-Pronged Package,” and earnestly grasp the requirements of “Three-Free” and ““Three Feasibilities,” benchmark against domestic first-class standards, focus on the concerns of market entities, and adhere to the principles of building on strengths, addressing weaknesses, enhancing advantages, and striving for excellence. We will deepen reform and innovation on a larger scale, in broader fields, at a deeper level, and to a higher standard; advance full-chain optimization of approval processes, fair regulation throughout the entire process, and service enhancement across the full lifecycle; and promote a better integration of an effective market and an active government,further stimulate market vitality and social creativity, serve our city’s efforts to build a national demonstration zone for the transformation and upgrading of resource-based cities, and create a modern Taihang Mountain and Water City, thereby providing strong support for the all-round promotion of high-quality development.

II. Work Objectives

Focusing on fostering and stimulating the vitality of market entities, we will adhere to a systematic approach and innovative thinking, strengthen institutional innovation and technological empowerment, and prioritize maintaining a fair, just, and transparent market environment. Taking the deepening of the “streamlining administration, delegating power, and improving government services” reform as the overarching approach, and using digital leadership, collaborative advancement, and scenario-based applications as breakthroughs, we will focus on improving the administrative approval system, strengthening comprehensive and standardized supervision during the process, reinforcing joint post-event penalties, and enhancing the level of smart government services. We will vigorously advance the in-depth development of the business environment,truly creating a first-class market-oriented, rule-of-law-based, and international business environment, and continuously enhancing the satisfaction and sense of fulfillment among enterprises and the public.We aim to ensure that by the end of the 14th Five-Year Plan period, our city’s business environment ranks among the best in the country. We will generate a range of institutional innovations in key sectors that are replicable, scalable, and effective; comprehensively enhance the efficiency of government governance; significantly strengthen our capacity to attract and allocate various resources and factors nationwide; and markedly improve the vitality and development quality of market entities, with the total number of market entities in the city reaching approximately 500,000.

III. Key Tasks

(1) Creating a Fair and Impartial Legal Environment

1. Eliminate unreasonable restrictions that hinder fair competition. Comprehensively review and remove unreasonable restrictions in areas such as qualification acquisition, bidding and tendering, government procurement, and rights protection. Improve the fair competition review mechanism, promote third-party assessments, and strengthen antitrust supervision and enforcement against unfair competition.Streamline and standardize fees charged to enterprises, establish long-term mechanisms to curb arbitrary fees and levies, and focus on rectifying behaviors such as monopolistic operations and forced services by various intermediaries. Revise the municipal government’s negative list for government procurement to further clarify prohibited items in government procurement activities, and strictly prohibit the imposition of differential or discriminatory treatment on suppliers through unreasonable conditions.

2. Fully implement the system of administrative law enforcement discretion benchmarks. Conscientiously implement the “Opinions of the General Office of the State Council on Further Standardizing the Formulation and Management of Administrative Discretion Benchmarks,” the “Measures of Shanxi Province for Standardizing Administrative Law Enforcement Discretion,” and the “Notice of the General Office of the People’s Government of Shanxi Province on Further Standardizing the System of Administrative Law Enforcement Discretion Benchmarks.” Municipal administrative agencies shall, in accordance with the provisions of municipal-level local regulations, refine and quantify administrative law enforcement powers where discretion exists, and formulate discretion benchmarks;Municipal and county-level administrative agencies shall strictly enforce provincial-level administrative law enforcement discretion benchmarks and may refine and quantify them based on actual work requirements; municipal and county-level administrative agencies shall publicly announce the scope, types, and range of discretion for each administrative law enforcement action, and establish a mechanism for regular, dynamic adjustments and disclosure.

3. Establish a legal support community for the business environment. Streamline communication channels for the design, implementation, and feedback of policies and systems; identify, study, and resolve institutional bottlenecks and systemic issues hindering the optimization of the business environment; and provide intellectual support for the development of a law-based business environment. Cooperate in conducting law enforcement inspections on the implementation of the “Shanxi Province Regulations on Optimizing the Business Environment.”Comprehensively review and revise government regulations and administrative normative documents that are inconsistent with the requirements for optimizing the business environment. By the end of 2022, formulate and issue supporting measures to ensure the prompt implementation of the principle that “getting things done relies on systems, not connections.”

4. Strengthen the protection of the legitimate rights and interests of market entities. Protect entrepreneurs’ rights to autonomous management, property rights, intellectual property rights, and other legitimate rights and interests in a lawful, equitable, and comprehensive manner. Strengthen law enforcement oversight, strictly distinguish between economic disputes and criminal offenses, and regularly organize the review of property rights disputes involving major asset dispositions, as well as criminal cases involving private enterprises and investors. Severely crack down on illegal and criminal acts that infringe upon the legitimate rights and interests of private enterprise investors, managers, and employees.

5. Improve the quality and efficiency of judicial adjudication in the courts. Deepen the development of “Smart Courts” and improve a multi-channel litigation system encompassing online platforms, hotlines, mobile apps, and self-service terminals. Explore models for self-service case filing, appointment-based filing, online filing, and cross-jurisdictional filing to ensure that 100% of parties involved in business-related disputes need to make “no more than one visit” during the case filing stage. Address issues of improper extensions or reductions of trial deadlines to enhance case adjudication efficiency.Deepen reforms to the case classification and diversion mechanism, explore the establishment of mechanisms for prioritizing the trial and adjudication of model cases as well as expedited trial and adjudication for cases where mediation has failed, and improve systems for pre-trial risk assessment, soliciting opinions during proceedings, and post-case follow-up for enterprise-related cases. Explore the formation of three expedited adjudication teams—commercial, criminal, and enforcement—to accelerate the processing of simple cases.Promote the diversified resolution of investor disputes, make full use of online platforms for diversified dispute resolution, and establish practical coordination models such as delegated mediation to provide comprehensive and effective protection for investors.

6. Accelerate the reform of the relative concentration of administrative penalty authority. Focus efforts on intensifying the reform of the relative concentration of administrative penalty authority in areas closely related to the public’s daily lives and production—such as urban management, market regulation, and the cultural market—where enforcement frequency is high, issues of multiple agencies enforcing the same regulations are prominent, and technical requirements are appropriate. Strictly implement procedures for the cross-sectoral and cross-departmental relative concentration of administrative penalty authority, coordinate the allocation of administrative penalty functions and enforcement resources, and promote the decentralization of enforcement efforts and the deployment of resources to the grassroots level.

(II) Creating an Efficient and Convenient Government Service Environment

7. Implement list-based management of administrative approval items. In accordance with the provincial reform requirement of “a single seal for approval,” further standardize the transfer of administrative approval items during the reform process, compile the *List of Administrative Approval Items of Changzhi City*, and establish a dynamic adjustment mechanism for items under the “single seal for approval” system to standardize the management of approval items.

8. Launch a “Minimal Approval” initiative. Eliminate a batch of disguised approvals and streamline administrative measures such as catalog management, registration, annual inspections and reporting, and designated certifications. Pilot the exemption of technical reviews for a batch of investment projects. In principle, technical reviews will no longer be organized for major projects that do not involve public interest or public safety, enterprise investment projects that do not involve environmental protection, production safety, or the safety of life and property, as well as government services and regional comprehensive assessment projects implemented under the commitment system; instead, a lifetime accountability system for designers will be implemented.Continue to carry out the “Five Reductions” standardization reform of administrative approval items—reducing the number of items, procedures, materials, processing times, and required certifications—by clarifying the licensing conditions, application materials, and approval procedures for each item, formulating operational manuals for business acceptance, and enhancing the standardization and normalization of administrative approvals.We will explore a range of smart approval services, promote “instant application and approval” for simple business-related approval matters, strengthen the service functions of the “12345” hotline, advance the integration and sharing of public resource trading platforms, and optimize the service experience for market entities.

9. Intensify efforts to streamline administration and delegate power in the engineering construction sector. Deepen reforms of the engineering construction project approval system, and advance initiatives such as “integration of multiple planning regulations,” “joint acceptance,” and “joint surveying” for construction projects. Optimize municipal facility connection services; leveraging the online approval and supervision platform, implement fully online and parallel processing for planning permits, greening permits, road administration permits, and road occupancy/excavation permits.Pilot comprehensive licensing reforms for specific industries. Develop and issue “comprehensive” solutions and online service plans for specialized sectors, such as the “Implementation Plan for Building Permits for Simple, Low-Risk Social Projects” and the “Implementation Plan for External Utility Line Approvals for Municipal Public Facilities,” enabling businesses to “get everything done in one stop.”

10. Fully implement the “One Project, One Plan, One Checklist” approval model. Building on preliminary project planning services, launch “one-stop” approval services prior to project approval. Based on project type, investment scale, and land location, develop a customized approval (agency) plan for each project, clearly defining an approval checklist that includes approval items and required documents, ensuring enterprises can submit a single application, receive a single notification, and complete the process at a single location.

11. Facilitate market entity entry and exit. Deepen the “one-stop” reform for business establishment, implementing registration and licensing through “one-stop online access, one-window processing, half-day completion, and zero cost,” and integrating registration, company seal engraving, invoice application, and the opening of bank, social security, medical insurance, and housing fund accounts into a fully integrated management process.Deepen the “one license for multiple addresses” and “one certificate for multiple addresses” reforms; implement the “one industry, one certificate” reform; explore an “multiple industries, one certificate” approval model; and advance the “multiple reports consolidated into one” reform for enterprise annual reporting. Pilot a registration confirmation system for market entities; improve the government-court coordination mechanism for market entity exit; and further streamline procedures for market entities. Conduct comprehensive effectiveness assessments of market entry and exit; and establish smooth channels for market entities to provide feedback on hidden barriers, along with corresponding response mechanisms.

12. Promote cross-regional mutual recognition of frequently used qualification certificates. Promote the application of online identity verification, electronic certificates, and specialized electronic seals for administrative approvals in business areas such as customs clearance, bank loans, project applications, bidding and tendering, and government procurement.Encourage certification bodies to promote the use of electronic seals in areas such as certification certificates. By the end of 2022, achieve basic mutual recognition and universal acceptance of qualification certificates for high-frequency service matters related to individuals and business operations; by the end of 2023, ensure that materials issued by municipal government departments are generally exempt from submission, and that physical certificates are generally exempt from submission where electronic certificates can be provided.

13. Optimize bidding and government procurement services. Eliminate hidden barriers and obstacles set for non-local enterprises in the bidding and government procurement sectors, and comprehensively rectify practices that exclude non-local bidders—such as requiring bidding entities to establish branches at the project site.Promote full-process electronic transactions. In accordance with provincial and municipal directives, facilitate the sharing of bid evaluation experts, promote information sharing between electronic bidding and tendering platforms and the treasury payment system, and enable online inquiries regarding project payment status. Encourage procuring entities to increase the reserved share and advance payment ratio for small, medium, and micro enterprises, and enhance preferential treatment in price evaluations.Regularly convene joint meetings on bidding and tendering supervision to analyze the current situation and existing issues in bidding and tendering work, and to agree on solutions and measures. Explore the establishment of the Changzhi City Engineering Construction Project Bidding and Tendering Evaluation Committee to conduct dispute resolution for bidding and tendering activities involving major controversies or requiring high levels of technical expertise.

14. Optimize intellectual property protection and services. Launch special campaigns to combat intellectual property infringement, and establish and improve a full-chain intellectual property service system and a rapid protection mechanism. Launch the “Enterprise Park Support” special campaign for intellectual property pledge financing to promote such financing.

15. Optimize tax services for taxpayers. Promote the “11-in-1” tax filing system and quarterly filing for small and micro enterprises.Fully implement electronic invoices (receipts) and promote paperless reimbursement, bookkeeping, archiving, and storage. Further optimize tax and fee payment processes, streamline filing documentation, and expand the scope of “contactless” tax and fee payment services. Publish a list of tax matters that can be handled entirely online, improve the “pre-filled” form system, and build a fully functional, user-friendly integrated online tax filing platform.Strengthen the development of 24-hour self-service tax halls and improve the “grid-based” self-service tax system. Optimize the functional applications of self-service tax terminals and expand the range of self-service matters; gradually ensure that 90% of frequently handled tax-related matters can be processed via self-service terminals. Fully implement online invoice application with offline self-pickup or TOT (Tax-On-Delivery) mail delivery services to achieve “walk-in, walk-out” and “contactless” tax services.

16. Promote the facilitation of cross-border trade. Accelerate the development of the “Single Window” for international trade, promote the unified handling of port and cross-border trade operations through the “Single Window,” and achieve rapid coordination between customs clearance and logistics operations.Advance the integration and sharing of information across transportation modes—including rail, road, and air—to enhance multimodal transport capabilities, ensuring transport capacity data is accessible and enabling real-time tracking of goods throughout their entire journey. Optimize customs inspection procedures, refine the error-tolerance mechanism for enterprise declarations, and continue implementing the two-stage market access supervision model.

17. Enhance the level of foreign-related services. Launch the “Changzhi City Foreign Investment Guide” column to provide foreign nationals with timely and accurate information on investment, work, and living in our city. This will help them promptly and accurately understand key aspects such as our city’s investment advantages, industrial platforms, and investment promotion policies, thereby continuously enhancing our city’s international profile and communication capabilities.We will consolidate and streamline foreign-related approval and service items across all departments to provide guidance services—including procedural manuals, foreign policy inquiries, and public convenience services—for the establishment and development of foreign-invested enterprises, as well as for foreigners, residents of Hong Kong, Macao, and Taiwan, and overseas Chinese coming to Changzhi to start businesses, invest, or pursue employment and career development.

18. Explore applications of “blockchain + government services.” Advance national blockchain innovation pilot projects such as “blockchain + vocational skills training” and “blockchain + integrated work-related injury insurance,” and explore the application of blockchain technology in areas such as government services, transportation and logistics, accounting, and statistics.

(3) Fostering a Credit Environment Based on Integrity and Trust

19. Establish a credit-based tiered and categorized supervision system. Take the lead in conducting credit rating evaluations in key sectors such as market regulation, taxation, engineering construction, government procurement, ecological environment, mineral resources, energy, and safety. Further increase the utilization rate of credit risk classification results in “double-random, one-public” inspections, reasonably determine the targets and proportions for such inspections, and ensure a utilization rate of no less than 60%.Improve the system of incentives for trustworthy behavior and penalties for dishonest conduct, and promote cross-regional mutual recognition of credit standards, sharing of credit information, and coordinated rewards and penalties. Actively implement a government procurement access management system based on “commitment plus credit management.”

20. Accelerate the establishment of a new comprehensive regulatory mechanism. Improve the new comprehensive regulatory mechanism based on credit-based supervision, with “double random, public disclosure” inspections as the primary means and “Internet Plus Regulation” as the main application. Relying on the provincial “Internet Plus Regulation” system, establish a cross-regional, cross-departmental, and cross-level coordinated response and collaborative regulatory mechanism to achieve “initiated at one point, coordinated across the entire network.”Advance the “one-stop reform” for comprehensive supervision of vocational skills training and housing construction projects, and establish a collaborative supervision mechanism for new business models in transportation, ensuring that enterprises and the public receive “prompt responses to every request” while government departments “do not interfere unless necessary.”

21. Explore more flexible, inclusive, and prudent regulation. Promote flexible law enforcement by compiling, in accordance with the law, lists of matters subject to lenient penalties, reduced penalties, and exemptions from penalties for first-time minor violations. Explore pilot programs for inclusive and prudent regulation, such as “sandbox regulation” and trigger-based regulation. In fields such as market supervision, cultural law enforcement, labor inspection, and ecological environment, implement the use of credit reports to replace the requirement for enterprises to provide certificates of no violations.

22. Strengthen full-chain regulatory mechanisms in key sectors. Regulatory authorities should explore establishing a system of key regulatory lists, clearly defining key regulatory matters, procedures, and methods. For key sectors directly related to public safety and the health and safety of the people, implement strict, comprehensive oversight covering all entities, all product types, and the entire supply chain to ensure quality and safety standards are upheld. Strengthen the review and evaluation of online medical practice and enhance supervision of physicians’ professional conduct.

23. Explore credit repair mechanisms during corporate reorganization. Establish and improve standards for credit evaluation and repair, strengthen information sharing and exchange among market regulation, tax, banking, insurance, and securities authorities, and facilitate credit repair for eligible enterprises undergoing bankruptcy reorganization by promptly adjusting credit restrictions and punitive measures.

24. Improve and refine the mechanism for the government to uphold its commitments. Establish and improve a system of “government commitments + social oversight + accountability for breaches of trust,” continue to carry out special campaigns to address government breaches of trust, and comprehensively resolve the issue of “new officials ignoring past obligations.”Deepen efforts to clear overdue payments owed to small and medium-sized enterprises. By the end of 2022, formulate and issue supporting measures to ensure the prompt implementation of the principle that “new officials settle old debts.” Establish a government integrity evaluation mechanism, conduct regular evaluations of government integrity across all levels and departments, and proactively uphold government credibility. Establish and improve a coordination mechanism for the enforcement of government integrity-related litigation.

(IV) Creating an Open and Enlightened Social Environment

25. Build a full-lifecycle service chain for policies. Strengthen the management of enterprise-related policies throughout their entire lifecycle—from research and formulation to implementation and eventual repeal—and strictly implement the system for market entities to participate in policy formulation. Accelerate integration with the province’s unified enterprise policy cloud platform, integrate and optimize application scenarios, and shift the approach from “enterprises seeking policies” to “policies finding enterprises.” Promote “maximum preferential treatment” and “automatic eligibility without application” for policies based on certification or achievement of specific indicators.Actively establish a “Business Support Policy Information Platform” and explore the creation of an information-based service platform system for policy implementation. Develop and deploy functions such as policy search, policy matching, policy push notifications, and policy interpretation to address pain points such as policies being “difficult to find” or “difficult to understand.”

26. Build a full-lifecycle service chain for enterprises. Focus on services related to enterprise registration and operations—including employment, financing, taxes and fees, bidding and procurement, intellectual property, and legal matters—as well as full-lifecycle matters such as deregistration or bankruptcy. Categorize and compile a list of service items, and integrate and launch a set of standardized “full-lifecycle enterprise” service packages.

27. Establish a full-lifecycle service chain for projects. Actively implement the construction tasks for the province-wide integrated online government service platform, deeply integrating it with the online approval and supervision platform for investment projects, the construction project approval management system, and the natural resources “three-level joint processing” system, to achieve fully electronic project filing, contactless approval, and traceable supervision. Implement the “Chief Service Secretary” system for major projects and key engineering projects, and enforce the “Project Director Responsibility System” for key investment projects.

28. Build a full-lifecycle service chain for individuals. Conduct a precise inventory of full-lifecycle matters across 10 stages—including birth, household registration, education, employment, housing, healthcare, marriage, childbirth, retirement, and end-of-life affairs—for individuals. Compile a list of full-lifecycle service items for individuals and roll out categorized “one-stop” service packages.

29. Build a chain for the universal access and sharing of basic public services. Accelerate the improvement of the housing security system centered on public rental housing, affordable rental housing, and shared-ownership housing, and expand the supply of affordable rental housing.We will continue to carry out the “Clear-Out” campaign for real estate registration and promote “one-stop online processing” and “single-window processing” for real estate registration, transactions, and tax payments. We will improve the unified registration system for movable property and rights security. We will increase the supply of compulsory education resources and ensure that school-age children of migrant workers holding residence permits are enrolled in compulsory education schools in their destination cities. We will establish a multi-tiered medical insurance system to effectively address difficulties in accessing medical care and reimbursement.Gradually achieve the interoperability and sharing of electronic medical records, test and examination results, and treatment information across different hospitals; promote the mutual recognition of test and examination results; and make information such as test reports and examination results available for individuals to access. Support the free or low-cost opening of public sports venues and create “10-minute fitness circles” in urban communities.

(5) Creating a High-Quality and Comprehensive Environment for Factor Support

30. Deepen the “Commitment System + Standard Land + Full Agency Services” reform. By the end of 2022, further improve the supporting mechanisms to accelerate the implementation of the “Commitment System + Standard Land + Full Agency Services” reform. Adhere to the principles of the government setting standards, enterprises making commitments, strict supervision of the process, and credit-based rewards and penalties, and further expand the scope of the commitment system for enterprise investment projects.Implement the "Guidelines for the 'Standard Land' Reform in Shanxi Province." In provincial-level and higher-level development zones, the proportion of "standard land" plots granted shall account for no less than 80% of the zone’s industrial land. Explore and advance the "standard land" reform for production-oriented service industries. Deepen the reforms of "integrated planning" and "integrated surveying," promote reforms in intermediary services related to review procedures, and establish a mechanism for pre-project services.Formulate and implement a streamlined approval service system for small-scale, low-risk social investment projects, promoting “certificate issuance upon transaction,” “construction commencement upon land handover,” and “registration upon completion.” Implement a list-based commitment system (consolidating all matters eligible for commitment into a single list), a “tolerance for missing documents” acceptance system (expanding the scope of cases accepted with missing documents), and a “one enterprise, one policy” system (providing early-stage intervention to tailor processing models for enterprises). Allow enterprises to freely select commitment-based matters to achieve “integration of multiple commitments.”

31. Establish a market-oriented system for the allocation of innovation factors. Improve innovation incentive mechanisms and build a distribution mechanism that fully reflects the value of innovation factors such as knowledge and technology. Vigorously support research institutes in carrying out mixed-ownership reforms regarding the ownership of scientific and technological achievements made in the course of their duties. Leverage the market’s guiding role in determining the direction and pathways of technological R&D as well as the allocation of innovation resources; promote joint innovation, creation, and entrepreneurship among market entities; and improve the organizational management of science and technology projects. Accelerate the implementation of policies for attracting foreign “high-end, specialized, and scarce” talent.

32. Deepen reform of the science and technology system.We will fully implement relevant national and provincial policies, continue and integrate existing policies, and research and formulate our city’s implementation rules and work measures to reshape the management system for Changzhi’s science and technology project plans. We will issue documents such as the “Changzhi Science and Technology Project Management Measures” and the “Changzhi Scientific Research Project Funding Management Measures,” with a focus on exploring the “open challenge” system for major science and technology projects. We will strive to resolve major technical issues in the transformation and development of our city’s key industries, using continuous technological breakthroughs to lead the enhancement of industrial technological innovation capabilities.Introduce supporting policies and measures for new R&D institutions, establish a tiered cultivation and growth mechanism for such institutions in our city, strengthen innovation entities, promote the transformation of scientific and technological achievements and technology transfer, and enhance regional independent innovation capabilities. By establishing high-standard innovation policies, we will solidify the policy foundation for innovation-driven development across the city.

33. Optimize access services for municipal public utilities. Advance reforms for the integrated application process for water, electricity, gas, heating, and internet services by comprehensively consolidating service items and business processes, and unifying dedicated service windows in government service halls and dedicated sections on the “Sanjin Tong” app. Implement full-process online parallel processing for construction-related permits involved in access projects, such as construction planning permits, greening permits, and road-related construction permits. Adopt a notification-based commitment management system for eligible cases, and impose penalties for false commitments or breaches of commitment.

34. Promote lean services for distribution network power supply. Focus on minimizing power outages by upgrading outdated switches and distribution transformers with integrated terminals. Pilot terminal applications such as smart sub-stations and smart substations to enhance the distribution network’s proactive sensing and self-healing capabilities.Comprehensively promote live-line operations and implement advanced equipment such as bypass work vehicles and mobile substation units. Achieve a 100% live-line connection rate for customer expansion projects and a 40% live-line connection rate for distribution network projects, while maintaining a power supply reliability rate of 99.9% or higher. Ensure live-line operations cover all 33 projects across four major categories.Reduce the number of procedures for high- and low-voltage electricity connection to 4 and 3, respectively, and innovate the “Four Ones” green electricity connection model. The processing time for high-voltage single-source connections shall not exceed 22 working days, and for high-voltage dual-source connections, it shall not exceed 32 working days (excluding the design and construction phases of the customer’s power receiving facilities).
