Guidelines for the Construction of Specialized Industrial Parks in Shanghai
Chapter I General Provisions
Article 1 (Purpose and Basis)
These Construction Guidelines are formulated to further implement the strategy of building specialty industrial parks into core platforms for fostering new industrial momentum and demonstrating urban competitiveness, in accordance with the “14th Five-Year Plan for the Transformation and Upgrading of Shanghai’s Industrial Parks” and other relevant documents.
Article 2 (Development Direction)
Municipal-level specialized industrial parks are encouraged to enhance their development capacity and competitiveness. Focusing on the modern industrial system and implementing the Shanghai Industrial Map, they shall concentrate on specialized industrial sectors, establish high-quality park operators, and foster robust industrial ecosystems. By leveraging technological innovation to drive high-quality development, they shall optimize resource allocation and build a specialized development system for the parks.
Article 3 (Administrative Authorities)
The Shanghai Municipal Commission of Economy and Information Technology (hereinafter referred to as “the Municipal Commission”) is responsible for the recognition, evaluation, management, and formulation of relevant policies regarding municipal-level specialty industrial parks. The competent departments of each district’s specialty industrial parks (hereinafter referred to as “district competent departments”) are responsible for the application, evaluation, and daily management of municipal-level specialty industrial parks within their respective jurisdictions, and shall cooperate with the Municipal Commission in carrying out relevant management tasks for municipal-level specialty industrial parks.
Article 4 (Park Operating Entities)
Operating entities of municipal-level specialized industrial parks shall adhere to the orientation of specialized industries, coordinate the full lifecycle management of park development, construction, and operation, establish statistical management systems, and regularly report on the development status of the parks.
Chapter II: Recognition Mechanism
Article 5 (Application Requirements)
Applications for municipal-level specialty industrial parks shall meet the following conditions:
(1) Planning Requirements: Compliance with relevant laws, regulations, and industrial policies; conformity with relevant territorial spatial planning, fire safety and emergency response, environmental protection, and municipal industrial zoning requirements; clearly defined boundaries; a planned area generally between 1 and 5 square kilometers, with appropriate flexibility allowed for areas demonstrating distinct industrial clustering characteristics.
(2) Industrial Requirements: Must have a clear industrial positioning, align with the modern industrial system, possess distinct industrial characteristics, and demonstrate a high degree of industrial clustering.
(3) Spatial Requirements: The park must possess sufficient space for industrial development; development and construction should have reached a preliminary scale, and it must be able to provide industrial land or commercial space to meet industrial development needs.
(4) Industrial Aggregation Requirements: The area should center on a leading industry, aggregating a group of enterprises across the upstream and downstream of the industrial chain to form a cluster of enterprises within a specific industrial chain or its key segments. It should demonstrate a high degree of concentration in the leading industry or host a cluster of leading enterprises within the industrial chain.
(5) Technology Concentration Requirements: The park should establish multi-tiered industrial science and technology innovation platforms, maintain close cooperation with enterprises, universities, and research institutes in science and technology innovation, have established a collaborative innovation mechanism among industry, academia, and research, and have achieved certain breakthroughs in key core technologies of the leading industry.
(6) Requirements for the Operating Entity: The park’s operating entity shall possess strong operational management capabilities and the ability to foster an industrial ecosystem, and shall be capable of providing comprehensive talent services, financing services, property management services, consulting services, technology services, and integrated services to enterprises within the park.
Article 6 (Application Materials)
Applications for municipal-level specialty industrial parks shall include the following materials:
(1) Basic Information on the Shanghai Specialized Industrial Park;
(2) Construction Plan for the Shanghai Specialized Industrial Park;
(3) Supporting documents: a copy of the operating entity’s business license, the enterprise’s audited financial report for the previous fiscal year, relevant development plans for the park, a description of the park’s industrial service system, and a boundary map and description of the proposed park’s boundaries.
Article 7 (Application Process)
Park operating entities that meet the application criteria may voluntarily submit an application to the competent authority of their respective district. After conducting a preliminary review of the application materials for completeness, authenticity, and validity, the competent authorities of each district shall determine a list of recommended applicants and submit the application materials along with their review opinions to the Municipal Commission of Economy and Information Technology.
Article 8 (Review and Announcement)
The Municipal Commission of Economy and Information Technology shall organize experts to conduct a comprehensive review of the application materials submitted by the applying parks. Upon approval, the parks shall be included in the list of municipal-level characteristic industrial parks, which shall be announced to the public.
The Municipal Commission of Economy and Information Technology shall regularly publish the latest edition of the Shanghai Specialized Industrial Park Announcement annually, which shall include the names of municipal-level specialized industrial parks, industrial categories, park areas, and boundaries.
Article 9 (Unified Awarding of Plaques)
Each year, following the publication of the announcement, the Municipal Commission of Economy and Information Technology shall conduct a unified plaque presentation ceremony for newly designated municipal-level specialty industrial parks.
Chapter III Daily Management
Article 10 (Statistical Reporting)
The operating entities of municipal-level Specialized Industrial Parks shall establish and improve a statistical reporting mechanism, designate a dedicated person to be responsible for the park’s statistical reporting work, and submit the following data and materials to the Municipal Commission of Economy and Information Technology and the relevant district authorities in accordance with reporting requirements:
(1) Data regarding the park’s basic profile and construction and operation status;
(2) Materials for the comprehensive evaluation of the park;
(3) Routine materials, including the park’s latest plans, annual plans and summaries, progress on major projects, best practices in park development, and relevant industry events held.
Article 11 (Park Promotion)
The operating entity of a municipal-level characteristic industrial park shall carry out publicity and reporting activities for the park. Through publications, radio, television, and the internet, it shall disseminate basic information about the park, its characteristic industries, and investment advantages to the public, thereby enhancing the park’s visibility and reputation.
Article 12 (Adjustment of Operating Entity or Name)
If adjustments are required to the operating entity or its name of a municipal-level specialty industrial park, or if the park’s name needs to be changed, the operating entity shall submit an application stating the reasons. Upon approval by the competent authority of the district where the park is located, the district authority shall report the matter to the Municipal Commission of Economy and Information Technology for review. Upon approval, the adjustment shall be implemented in the next public announcement.
Article 13 (Boundary Adjustments)
Once the boundaries of a municipal-level specialty industrial park have been announced, they shall not be adjusted in principle. If an adjustment is indeed necessary, the park’s operating entity shall submit an application explaining the reasons and necessity for the boundary adjustment, along with a map of the adjusted boundaries and a description of the four boundaries. After obtaining approval from the competent district authority, the district authority shall submit the application to the Municipal Commission of Economy and Information Technology for review. Upon approval, the adjustment shall be implemented in the next public announcement.
Chapter IV Comprehensive Evaluation
Article 14 (Purpose of Evaluation)
The Municipal Commission of Economy and Information Technology conducts comprehensive evaluations of municipal-level specialty industrial parks to identify issues and weaknesses in the parks’ development, and to serve as an important basis for exit management and policy formulation.
Article 15 (Scope of Evaluation)
The evaluation shall cover recognized municipal-level specialty industrial parks, as specified in the latest edition of the Shanghai Specialty Industrial Parks Announcement issued by the Municipal Commission of Economy and Information Technology.
Article 16 (Evaluation Period)
The comprehensive evaluation of municipal-level specialty industrial parks is conducted annually. The evaluation period covers one calendar year, and the data cutoff date is December 31 of the preceding year.
Article 17 (Evaluation Content)
The comprehensive evaluation of municipal-level characteristic industrial parks primarily assesses the parks’ industrial development, innovation leadership, and construction and operation.
Article 18 (Evaluation Process)
The specific evaluation of municipal-level specialty industrial parks shall be conducted in accordance with the following procedures:
(1) The Municipal Commission of Economy and Information Technology issues an annual notice regarding the comprehensive evaluation of municipal-level specialty industrial parks.
(2) The parks shall submit data in accordance with the requirements of the notice, along with supporting documentation relevant to the evaluation.
(3) The Municipal Commission of Economy and Information Technology reviews the evaluation materials, determines the evaluation results, and publishes them.
Article 19 (Application of Evaluation Results)
Based on the comprehensive evaluation results, the Municipal Commission of Economy and Information Technology conducts a star-rating evaluation of municipal-level specialty industrial parks, designating them as five-star, four-star, or three-star parks in accordance with the evaluation criteria.
Municipal-level Specialized Industrial Parks are subject to dynamic management. Based on the comprehensive evaluation results, the Municipal Commission of Economy and Information Technology periodically adjusts and updates the list of municipal-level Specialized Industrial Parks and related information. Newly designated municipal-level Specialized Industrial Parks are exempt from dynamic management for two years but must still participate in the comprehensive evaluation.
Article 20 (Circumstances for Delisting)
If a municipal-level specialty industrial park falls under any of the following circumstances, the Municipal Commission of Economy and Information Technology shall, upon review, revoke its designation.
(1) The park ranks in the bottom two positions in the annual comprehensive evaluation for three consecutive years.
(2) The park fails to participate in the comprehensive evaluation for two consecutive years, including failure to submit evaluation data and materials in accordance with reporting requirements or deadlines for two consecutive years.
(3) The park’s evaluation data or materials contain material misrepresentations or omissions, and the park fails to correct them after being reminded.
(4) Other serious violations of relevant national or municipal regulations.
Article 21 (Review Process)
Where a municipal-level specialty industrial park is subject to delisting pursuant to Article 20, the park’s operating entity may, within 10 working days after the release of the annual comprehensive evaluation results, apply for a review through the district-level competent authority to the Municipal Commission of Economy and Information Technology and submit relevant supporting materials. The Municipal Commission of Economy and Information Technology shall make a corresponding decision after conducting an investigation and assessment.
Chapter V Supplementary Provisions
Article 22 (Authority to Interpret)
The Municipal Commission of Economy and Information Technology shall be responsible for interpreting these Construction Guidelines.
Article 23 (Validity Period)
These Construction Guidelines shall take effect on December 5, 2023, and remain valid until December 4, 2028.
