Chapter 1 General Provisions
Article 1 These Regulations are formulated in accordance with relevant laws and administrative regulations, and in light of the actual conditions of this municipality, to promote the high-quality development of the artificial intelligence industry, strengthen the role of this municipality as a source of innovation for next-generation artificial intelligence, advance the deep integration of artificial intelligence with the economy, daily life, urban governance, and other fields, and build a world-class artificial intelligence industrial cluster.
Article 2 For the purposes of these Regulations, “artificial intelligence” refers to the theories, methods, technologies, and application systems that utilize computers or computer-controlled machines to simulate, extend, and expand human intelligence, perceive the environment, acquire knowledge, and use that knowledge to achieve optimal results.
For the purposes of these Regulations, the “artificial intelligence industry” refers to the development and production of hardware and software products, system applications, and integration services involved in the research, development, and application of artificial intelligence technology, including the industries of critical basic components, intelligent software, and intelligent terminals; as well as related industries driven by the integrated application of artificial intelligence technology in the fields of the economy, daily life, and urban governance.
Article 3 These Regulations apply to activities related to AI scientific and technological innovation, industrial development, application empowerment, and industrial governance conducted within the administrative region of this municipality.
Article 4 The development of the artificial intelligence industry in this municipality shall adhere to the principles of putting people first, technology for the greater good, innovation-driven development, and market-led growth. It shall build an artificial intelligence industrial system characterized by an open and interconnected ecosystem, vibrant innovation clusters, ubiquitous super-scenarios, and agile and secure governance, with the aim of establishing an internationally influential “Shanghai High-Ground” for artificial intelligence.
Article 5 The Municipal People’s Government shall strengthen its leadership over the development of the city’s artificial intelligence industry, organize the formulation of artificial intelligence industry development plans, and incorporate them into the national economic and social development plan; it shall also guide and coordinate the resolution of major issues arising in artificial intelligence technological innovation, industrial cultivation, application scenario construction, and industrial ecosystem development.
District people’s governments shall, in accordance with the city’s overall requirements and arrangements, carry out relevant work regarding the development of the artificial intelligence industry within their administrative regions, and strengthen the promotion of AI application scenarios and the development of the industrial ecosystem.
Township people’s governments and subdistrict offices shall strengthen the application of AI technologies to enhance the level of smart services and governance at the grassroots level.
Article 6 The municipal department of economy and information technology is the competent authority for the city’s artificial intelligence industry and is responsible for planning, implementing, coordinating, and promoting the development of the artificial intelligence industry.
The municipal development and reform department shall coordinate major AI industry projects and infrastructure construction.
The municipal science and technology department shall support research, development, and innovation in cutting-edge fundamental theories and key technologies of artificial intelligence, promote the construction of major science and technology innovation bases, and advance the governance of artificial intelligence technologies.
The municipal cyberspace administration department shall coordinate cybersecurity and informatization efforts in the development of the artificial intelligence industry and be responsible for the governance and supervision of relevant online information content.
The municipal market regulation department is responsible for metrology, standards, inspection and testing, certification and accreditation, and the supervision of product quality in the AI industry.
The municipal departments of state-owned asset supervision, human resources and social security, education, health, finance, statistics, and national security shall, within the scope of their respective responsibilities, formulate relevant policies and measures to promote the development of the artificial intelligence industry.
Article 7 The Municipal People’s Government shall establish a Municipal Artificial Intelligence Strategic Advisory Committee composed of experts from higher education institutions, research institutes, enterprises, and other organizations to provide advisory opinions on major strategies and decisions regarding the development of the city’s artificial intelligence industry.
Article 8: Artificial intelligence industry associations and other AI-related industry organizations (hereinafter collectively referred to as “industry organizations”) shall, in accordance with the law, safeguard the legitimate rights and interests of their members; promote the research, development, and application of AI technologies; foster industrial collaboration; strengthen industry self-regulation; conduct industry statistical monitoring; and formulate standards and specifications to facilitate the orderly development of the industry.
Article 9: The Municipality encourages citizens, legal entities, and other organizations to engage in various innovative activities in the field of artificial intelligence, except for matters explicitly prohibited by laws, regulations, and relevant national and municipal provisions. The municipal department of economy and information technology, in conjunction with relevant departments, shall explore the establishment of a negative list for fields such as artificial intelligence research and application.
Article 10: This municipality shall promote the coordinated and integrated development of the artificial intelligence industry within the Yangtze River Delta region (hereinafter referred to as the “Yangtze River Delta”), and shall explore joint efforts to advance the alignment of cross-regional AI industry development plans, mutual recognition of technical standards, mutual recognition of test data in key areas, and the sharing of infrastructure construction costs and benefits.
The Municipality shall expand cooperation in the AI industry with other regions within the country.
Article 11: The Municipality shall deepen international cooperation. Leveraging events such as the China International Import Expo and the World Artificial Intelligence Conference, it shall organize and attract high-level international academic conferences and joint innovation institutions related to artificial intelligence, thereby providing an international cooperation platform for relevant entities to participate in the development and governance of the artificial intelligence industry.
The Municipality supports enterprises, higher education institutions, research institutes, and other organizations in strengthening international cooperation in areas such as basic AI research, technology development, industrial development, standard-setting, and talent cultivation.
Article 12: The Municipality promotes the popularization of science and technology in the field of artificial intelligence. It publicizes new developments and achievements in the artificial intelligence industry through media such as radio, television, newspapers, and the internet, and strengthens guidance on ethics, security, and social values in the field of artificial intelligence.
Chapter II: Basic Elements and Technological Innovation
Section 1: Basic Elements
Article 13 The municipal departments of economy and informatization, development and reform, and other relevant departments shall strengthen the planning of computing power infrastructure, promote the construction of public computing power infrastructure, foster the green and low-carbon development of computing power infrastructure, and support relevant entities in constructing and opening up computing power infrastructure based on independently developed AI-specific computing architectures.
The municipal Department of Economy and Information Technology, in conjunction with the municipal departments of development and reform, science and technology, and others, shall formulate measures for the supply of public computing resources, promote the construction and utilization of public computing resource platforms, strengthen the scientific scheduling of computing resources, and provide public computing support for the development of AI technology and industry through means such as computing power incentives, ensuring that small and medium-sized enterprises have access to inclusive public computing resources.
The city encourages relevant entities to participate in the construction of computing infrastructure, engage in market-based trading of computing resources, guide various industries to use computing resources in a reasonable and orderly manner, and enhance the utilization efficiency of computing infrastructure.
Article 14: The Municipality shall implement the “East Data, West Computing” initiative in accordance with national directives, collaborate with other provinces and cities in the Yangtze River Delta to build the Yangtze River Delta National Hub Node of the National Integrated Big Data Center System, optimize the layout of data center infrastructure construction, enhance the cross-network and cross-regional data interaction capabilities of data centers, guide the intensive, large-scale, and green development of data centers, and ensure the computing power needs of the artificial intelligence industry are met.
Article 15: This municipality supports algorithm innovation. Through policy support, platform development, and other means, it promotes algorithm research and development by relevant entities to achieve the trustworthiness, hardware integration, modularization, systematization, and platformization of algorithms, thereby fostering the innovative development and application of algorithmic models.
The municipal department of economy and information technology shall support relevant entities in building and operating open-source platforms, communities, and projects for proprietary technologies, promote the compliant application of open-source software projects, accelerate commercialization efforts, and foster a healthy open-source ecosystem.
Article 16: The Municipality promotes the trading and circulation of algorithm models. The Municipal Department of Economy and Information Technology, in conjunction with relevant departments, shall guide industry organizations in formulating a recommended catalog of artificial intelligence algorithm models to reduce transaction risks and improve transaction efficiency.
The Municipality encourages enterprises or third-party institutions to conduct testing and evaluation of algorithm models. For algorithm models involving public interests, relevant entities are encouraged to proactively submit evaluation reports to the Municipal Department of Economy and Information Technology and other competent authorities, and to explain the basic principles and intended purposes of the algorithms in a manner understandable to the public.
The city shall strengthen the protection of algorithm models and promote their lawful application and dissemination. The Municipal Department of Economy and Information Technology, in conjunction with relevant departments, shall explore the establishment of a filing system for algorithm models that have undergone testing and evaluation, focusing on AI-related datasets, algorithm design, and model training.
The city encourages industry organizations to formulate guidelines for collaborative innovation in algorithms and to improve the profit-sharing mechanisms in the trading and circulation of algorithmic models.
Article 17: The city promotes the development of high-quality datasets in the field of artificial intelligence. It supports relevant entities in deeply integrating data with industry knowledge to develop data products that serve the needs of algorithm design, model training, product validation, and scenario applications.
The city encourages relevant entities to engage in collaborative research and development of big data and artificial intelligence technologies, develop specialized tools and a series of standards for data annotation, establish big data laboratories for artificial intelligence training, and build large-scale artificial intelligence data repositories.
The municipal department of economy and information technology shall, in conjunction with relevant departments, conduct surveys of AI industry data resources, strengthen the cataloging of available data resources in key sectors and enterprises, compile key industry data resources, and promote the development of the AI industry.
Article 18: Relying on the public data openness mechanism, the city shall establish a dynamic list of publicly available data in fields such as economic development, public services, and urban governance; promote the orderly, categorized, and graded opening of public data in fields such as life sciences and health, and autonomous driving; and expand the scope of public data supply for the AI industry. The city supports relevant entities in applying for public data access, either individually or jointly, and ensures fair access to open data for small and medium-sized enterprises (SMEs) and individual developers.
The Municipality supports AI enterprises in developing and utilizing data generated from AI applications. It encourages enterprises to trade relevant data products through the Shanghai Data Exchange, to create data value and distribute data appreciation benefits in a lawful and compliant manner, and to promote the circulation and trading of data within the AI industry.
Section 2: Scientific and Technological Innovation
Article 19 The Municipal People’s Government and its relevant departments shall formulate policies to encourage higher education institutions, research institutes, and enterprises to conduct fundamental theoretical research and R&D on key generic technologies addressing major scientific frontier issues in the field of artificial intelligence.
The Municipality supports higher education institutions, research institutes, and enterprises in conducting research in interdisciplinary fields related to artificial intelligence and undertaking major science and technology and industrial innovation projects.
Article 20 The Municipal People’s Government and its relevant departments shall strengthen support for major AI scientific and technological infrastructure and major research platforms; serve and promote the innovative development of relevant national laboratories and the enhancement of capabilities at national key laboratories; and support the establishment of AI research institutions affiliated with higher education institutions, research institutes, and enterprises.
Article 21. Universities, research institutions, and enterprises may establish new R&D institutions through various means to explore integrated models of R&D, testing, and application that align with the rapid iteration characteristics of artificial intelligence. They shall utilize market mechanisms to integrate advanced AI technologies and high-quality resources, and carry out activities such as research and development, the cultivation of innovative talent, and the application and promotion of research outcomes.
Article 22: The Municipality encourages higher education institutions, research institutions, and enterprises to engage in innovation and independent R&D across the entire spectrum of artificial intelligence. It supports the development of core systems and critical software and hardware to achieve autonomy and control over cutting-edge technologies and their applications in areas such as underlying interfaces, common algorithms, and data processing protocols.
Article 23: The Municipality encourages higher education institutions, research institutions, enterprises, and other entities to open large-scale scientific instrumentation and facilities in the field of artificial intelligence to the public.
The municipal departments of economy and informatization and science and technology shall, in conjunction with relevant departments, improve the incentive mechanisms for the open sharing of large-scale scientific instrumentation and facilities in the field of artificial intelligence.
Article 24: The Municipality shall strengthen the integration of artificial intelligence technological innovation into strategic emerging industry projects and increase support for artificial intelligence technological innovation, industrial infrastructure revitalization, and industrial demonstration applications within high-quality industrial development initiatives.
The municipal science and technology department shall establish an artificial intelligence special program within the city’s major science and technology innovation projects to support research into the fundamental theories and core technologies of artificial intelligence.
Article 25: The city shall promote reforms in the approval and organizational management of scientific research projects, granting AI innovation teams and leading talents greater autonomy in determining technical approaches and using funds, and supporting the implementation of flexible compensation systems and incentive measures for researchers undertaking major AI R&D tasks.
The city shall explore granting researchers ownership or long-term usage rights to scientific and technological achievements generated in the course of their duties in the field of artificial intelligence.
Article 26 The Municipality shall establish incentive mechanisms conducive to promoting the transformation of scientific and technological achievements in the field of artificial intelligence, promote cooperation among relevant entities in the transformation of scientific and technological achievements, support researchers from higher education institutions and research institutes in starting businesses while on or off duty, or taking on part-time roles in enterprises to engage in the transformation of scientific and technological achievements, and encourage the establishment of various specialized service agencies for the transformation of scientific and technological achievements in the field of artificial intelligence.
Chapter III: Industrial Development
Section 1 General Provisions
Article 27: The city shall provide a favorable development environment for artificial intelligence enterprises, take measures to improve the integrated ecosystem of AI software and hardware, strengthen the clustering of AI enterprises, and establish and improve the AI industrial chain.
Article 28 The Municipal People’s Government and relevant departments shall formulate measures to attract leading domestic and international AI enterprises to establish headquarters and expand emerging businesses in this city; for leading enterprises with strong innovative capabilities, policy support in areas such as investment and financing, R&D, talent, and market access shall be strengthened to enhance their core technological capabilities and business competencies, thereby fostering world-class technology leaders.
The city shall attract world-class research institutions and talent teams from both domestic and international sources to incubate and nurture AI startups.
Article 29: The city supports leading AI enterprises in opening up their AI operating systems, algorithm frameworks, common technologies, and data resources to drive coordinated development across the entire industrial chain and build an AI industrial ecosystem.
Article 30: The city will establish specialized AI industrial parks, intensify efforts to attract projects, and promote the clustering and development of the industry.
The city encourages specialized AI industrial parks to provide services in areas such as talent recruitment, intellectual property protection, IPO guidance, investment and financing matchmaking, and rent reductions.
The Municipal Department of Economy and Information Technology and other relevant departments may, in accordance with relevant regulations, conduct assessments of the level of intelligence in specialized industrial parks.
Article 31: The Municipality shall coordinate various special funds to support basic research, technological innovation, technology transfer, demonstration applications, talent recruitment, and major international cooperation and exchanges in the field of artificial intelligence. For enterprises, institutions, or projects that receive municipal-level funding support, the respective districts may provide corresponding matching support.
Municipal and district finance departments shall focus on new technologies and products such as the first-round tape-out of AI chips, the first major set of AI technical equipment, the first version of AI software applications, and the first version of AI software products, strengthening targeted support for eligible innovation projects and exploring support measures such as loan interest subsidies.
The city encourages investment in AI research and development. Enterprises may include the innovation costs of AI products and technologies in their R&D expenses and claim additional tax deductions in accordance with national regulations.
Article 32 Relevant municipal and district departments may, in accordance with relevant regulations, provide support regarding land use classification, floor area ratio, and building height for key AI projects that align with industrial development priorities, and shall give priority in ensuring computing power energy consumption indicators, terminal communication spectrum resources, and project power capacity connections.
Article 33: The Municipality shall guide social capital to support the development of the artificial intelligence industry through various channels, including venture capital, private equity funds, and capital market financing.
The Municipality encourages state-owned capital to participate in AI industry investment. The municipal state-owned assets regulatory department shall establish and improve a state-owned assets regulatory system adapted to the development of the AI industry in accordance with relevant national and municipal regulations. The Municipality shall establish government-backed funds, such as AI industry funds, to leverage the role of industrial investment guidance funds, mobilize various social resources, and provide focused support for early-stage projects and high-growth start-ups in the AI sector.
The municipal local financial regulatory and economic and information technology departments shall support eligible artificial intelligence enterprises in raising capital through listings on capital markets such as the STAR Market.
The Municipality encourages financial institutions, such as banks, to provide specialized loan support to AI enterprises.
Article 34: The municipality encourages higher education institutions to establish AI-related disciplines and interdisciplinary programs, supports enterprises, higher education institutions, and research institutes in jointly establishing industry-education integration training bases, and strengthens the cultivation of multidisciplinary talent.
The Municipality shall improve talent evaluation standards in the field of artificial intelligence, promote the evaluation of intermediate and senior professional titles for artificial intelligence engineering and technical personnel, as well as the assessment of artificial intelligence trainers; explore the introduction and integration of international vocational training programs in the field of artificial intelligence, and implement training and evaluation for digital technology engineers.
The municipal department of economy and informatization, in conjunction with the municipal department of human resources and social security and other relevant departments, shall include high-level, highly skilled, and critically needed talent in the AI sector within the scope of talent policy support, and provide conveniences in areas such as household registration and residence permit processing, housing, medical insurance, and children’s education.
Article 35: The Municipality shall strengthen intellectual property protection in the field of artificial intelligence, improve the interactive support mechanism for technological innovation, intellectual property protection, and standardization in the field of artificial intelligence, promote the conversion of artificial intelligence innovation achievements into intellectual property rights, and facilitate the application and promotion of new artificial intelligence technologies; in accordance with relevant national and municipal regulations, support the inclusion of patent applications related to the field of artificial intelligence within the scope of patent fast-track examination and validation services, and improve the systems for collaborative protection, rapid enforcement, and overseas enforcement of intellectual property rights in the field of artificial intelligence.
Article 36: The Municipality encourages relevant insurance institutions to develop insurance products tailored to the characteristics of the AI industry in accordance with national regulations, covering the full lifecycle of business operations, including product R&D, production, sales, and application.
The Municipality supports relevant entities in purchasing relevant insurance products when applying AI products and services.
Article 37 The Municipal People’s Government and relevant departments shall support local AI enterprises and relevant industry organizations in playing a leading role in the formulation of national, industry, and local AI standards, and in participating in the formulation of technical standards regarding algorithm performance, data security, privacy protection, product compatibility, and performance testing.
The municipal market regulation department shall formulate local AI standards based on the actual development of the city’s AI industry and guide the Municipal AI Standardization Technical Committee to strengthen the technical coordination of relevant local standards. The municipal market regulation, economic and information technology, and other relevant departments shall guide AI enterprises and relevant industry organizations to take the lead in researching and formulating enterprise standards and group standards related to AI. Upon voluntary application and evaluation by a third-party institution, if the standards meet the requirements of being domestically leading and internationally advanced, they may use the special “Shanghai Standard” logo for AI on the standard text.
Article 38 The Municipality shall establish a statistical classification system for the AI industry. The municipal statistics department, in conjunction with the municipal economic and information technology department, shall formulate statistical classification standards for the AI industry, conduct statistical surveys and monitoring analyses of the AI industry, and provide support for assessing industry development trends and formulating policy measures.
Section 2: Key Areas for Promotion
Article 39: The Municipality shall, in accordance with global trends in artificial intelligence technology and industrial development and in light of the Municipality’s industrial strengths and development foundation, promote high-quality development in areas such as basic hardware, critical software, and intelligent products through increased policy support, the construction of innovation systems, and the promotion of cluster development.
Article 40: The Municipality shall support relevant entities in conducting design innovations for high-performance intelligent chips based on advanced architectures, developing cloud-edge chips and cloud-edge intelligent servers, and advancing brain-inspired chip research. It shall strengthen the coordination and adaptation of hardware and software, support the joint construction of R&D, testing, and application platforms, enhance technological synergy and chip architecture interoperability, improve the competitiveness of intelligent chip products and technologies, and foster an intelligent chip application ecosystem.
The municipal departments of development and reform and economic and information technology shall promote the application of domestically developed intelligent chips in major projects such as computing infrastructure.
Article 41: The Municipality supports relevant entities in strengthening the research, development, and application of artificial intelligence framework software; developing engine framework tool systems; deepening the application of artificial intelligence frameworks and platforms; and enhancing the mutual compatibility, performance optimization, and application promotion of artificial intelligence framework software and hardware such as chips.
The Municipality supports relevant entities in developing artificial intelligence system software and promoting machine self-learning systems; it encourages relevant entities to develop operating systems for smart products and promotes the development of various application functions.
Article 42: The Municipality shall promote the standardization and modularization of intelligent robot hardware and software systems, support the cultivation of intelligent robot system integrators, and encourage relevant enterprises, product users, and financial institutions to adopt methods such as product leasing and service procurement to expand the application scenarios of intelligent robots.
The municipal departments of economy and informatization and market regulation shall promote the formulation of standards by industry organizations regarding the classification of robot intelligence levels and application security testing, guide the iterative development of intelligent robot technology, and ensure the information security and safe use of intelligent robots.
Article 43: The Municipality supports the independent research, development, and industrial application of key technologies, operating systems, dedicated chips, and core components for intelligent connected vehicles.
The Municipality supports relevant entities in conducting testing, demonstration applications, and demonstration operations of intelligent connected vehicles on municipal highways (including expressways), urban roads (including urban expressways), and within designated areas, in accordance with relevant regulations. Specific provisions shall be formulated by the Municipal Departments of Economy and Information Technology, Transportation, Public Security, and other relevant departments.
Article 44: The Municipality encourages the development of the unmanned aerial vehicle (UAV) industry and supports the construction of civil unmanned aerial vehicle test bases (pilot zones), UAV takeoff and landing sites, general aviation airports, and UAV operation management service platforms. It will strengthen multi-departmental coordinated supervision and, through operation management service platforms, provide services such as flight path planning and electronic fence configuration to support the expansion of UAV application scenarios.
The Municipality encourages the development of the unmanned vessel industry, improves support systems such as electronic channel mapping and intelligent shipping communications for unmanned vessels, and conducts unmanned vessel channel testing in designated areas.
Article 45: The Municipality supports relevant entities in conducting research and development of key technologies for artificial intelligence (AI) medical devices, and will intensify efforts to achieve breakthroughs in areas such as intelligent diagnostic assistance algorithms, surgical positioning and navigation, and integrated brain-computer interfaces; it will strengthen guidance and services related to the registration and approval of AI medical devices, and support the inclusion of relevant innovative products in the National Special Approval Procedure for Innovative Medical Devices; it will also support the exploration of fee models for the clinical application of eligible AI medical devices.
Chapter IV Application Empowerment
Section 1 General Provisions
Article 46: The Municipality shall promote the large-scale application of artificial intelligence in the fields of the economy, daily life, and urban governance, accelerate digital transformation, and encourage relevant organizations to utilize artificial intelligence technologies and products to conduct R&D, manufacturing, services, and management operations through methods such as product leasing, service procurement, system integration, and financial leasing.
The municipal department of economy and informatization shall, in conjunction with relevant departments, formulate and regularly update a list of AI demonstration applications to guide relevant parties in strengthening the application of AI in the economy, daily life, urban governance, and other fields.
State organs, public institutions, state-owned enterprises, and other organizations authorized by laws and regulations to perform public affairs management functions within this municipality shall take the lead in implementing the list of AI demonstration applications, optimize procurement systems as needed, improve transaction mechanisms, and procure and use safe and reliable AI-related products and services.
Article 47: This municipality promotes the application of innovative products and services in the field of artificial intelligence. Support shall be provided in accordance with relevant policies for eligible new products and first-time applications. Upon lawful approval, government procurement entities may procure innovative products that meet the threshold for open tendering through non-public tendering procedures.
The municipal department of economy and information technology, in conjunction with the municipal science and technology department and other relevant departments, shall include eligible artificial intelligence products and services in the municipal directory of recommended innovative products.
Article 48: This municipality shall establish a system for opening up artificial intelligence application scenarios. The municipal department of economy and informatization shall establish and improve relevant incentive mechanisms, regularly solicit and publish lists of application scenario requirements and demonstration solutions, build real-world testing environments, and promote the cultivation, discovery, implementation, and demonstration of application scenarios.
Entities involved in artificial intelligence applications shall promote the optimization, upgrading, and sustained operation of application scenarios. Diverse entities, such as third-party service providers and financial institutions, are encouraged to participate in the construction and operation of artificial intelligence scenarios.
Article 49. Relevant municipal departments shall organize industry associations and other entities to formulate methods for evaluating the effectiveness of AI applications, establish evaluation mechanisms for the intelligence levels of AI products and applications, explore the assessment of the comprehensive social impact of AI products and applications, and promote the in-depth application and continuous innovation of AI.
Article 50: Pudong New Area shall leverage its role as a pilot zone for innovative AI applications, conduct pilot programs for institutional innovation in the AI field, and accelerate the mutually reinforcing development of leading industries such as AI, integrated circuits, and biomedicine.
Pudong New Area shall explore the establishment of an evaluation system for AI assets, including computing power, algorithm models, and high-quality datasets; promote the formulation of AI asset evaluation guidelines by relevant industry organizations; develop AI asset evaluation indicators; and support relevant institutions in conducting AI asset evaluations within Pudong New Area.
Relevant municipal departments and the People’s Government of Pudong New Area shall, in accordance with national and municipal regulations, intensify innovation pilot efforts in areas such as the commercial operation of intelligent connected vehicles, technological breakthroughs in the research and development of AI-enabled medical devices and AI-assisted pharmaceuticals, and the testing and operation of drones and unmanned vessels.
Section 2: Economic Applications
Article 51 The Municipality shall promote the deep integration and innovation of artificial intelligence and information technology with the manufacturing sector, and advance the integrated application of key technologies and equipment for smart manufacturing, core supporting software, and the industrial internet. It shall support enterprises in carrying out technological transformation and upgrading through special policies promoting high-quality industrial development, thereby facilitating the digital and intelligent transformation of the manufacturing sector.
Article 52: The Municipality promotes the deep integration of artificial intelligence and big data with the financial sector, encourages the financial sector to enhance its capabilities in processing and interpreting financial multimedia data, facilitates the intelligent transformation of the financial sector, and fosters innovation in intelligent financial products and services.
The City supports financial institutions and other market entities in applying artificial intelligence technologies and equipment, such as intelligent investment advisors, intelligent customer service, and intelligent risk control, to enhance their capabilities for intelligent early warning and prevention of financial risks.
Article 53. Relevant municipal departments shall support enterprises in applying new business service and decision-making systems based on artificial intelligence, encourage enterprises to develop and apply new technologies such as cross-media analysis and reasoning and knowledge computing engines in the business sector, and promote the intelligent transformation of business operations.
Article 54: Relevant municipal departments shall take measures to promote the digital and intelligent upgrading of goods management, transportation services, and terminal facilities; support enterprises in researching, developing, and promoting the application of emerging intelligent logistics equipment for loading and unloading, sorting and packaging, processing, and distribution; and enhance the level of automation and intelligence in logistics operations.
Section 3: Lifestyle Applications
Article 55: The city encourages the application of artificial intelligence technology on the internet, promotes the use of artificial intelligence to improve the matching and predictability of information searches, expands content production and interpersonal interaction methods in social media, and promotes the integrated development of online and offline e-commerce.
Article 56: The Municipality promotes the routine integration of artificial intelligence into the entire process of teaching, management, and resource development, establishing a new modern education system and a talent cultivation system for innovation that aligns with the intelligent era; it constructs digital twin schools and explores the development of digital applications for experiments, practical training, and facilities; it also explores the use of artificial intelligence technology to enrich the supply of educational resources and builds an intelligent, open educational resource platform.
The city encourages educational institutions, enterprises, and other entities to provide intelligent, precise, and personalized services across various learning scenarios, thereby supporting the development of an intelligent educational ecosystem.
Article 57: The City promotes innovation in the application of artificial intelligence in the medical field, builds intelligent medical infrastructure, establishes new models of AI-empowered medical services, enhances medical technology innovation capabilities, and promotes the intelligent transformation of the medical sector; it supports medical institutions, enterprises, and other entities in applying and developing human-machine collaborative intelligent medical systems, and encourages the development of flexible, wearable, and biocompatible intelligent physiological monitoring systems.
Article 58: The Municipality promotes the use of artificial intelligence to improve the quality of urban elderly care and intensifies efforts to upgrade and modernize urban elderly care infrastructure through intelligent technologies; it encourages relevant entities to adopt artificial intelligence technologies, smart devices, and digital platforms to provide convenient services for the elderly; and it encourages relevant entities to develop intelligent, age-friendly elderly care products and services.
Section 4: Applications in Urban Governance
Article 59: This municipality shall promote the application of artificial intelligence to modernize urban governance capabilities and increase the application of and investment in artificial intelligence technologies in areas such as the construction of government information systems.
The city shall strengthen the integrated development of “one-stop online government services” and “unified online management of urban operations,” develop AI platforms suitable for government services and decision-making, and innovatively apply AI technologies to enhance dynamic, intelligent, and precise monitoring of urban operational status.
Article 60: The Municipality shall strengthen the construction of intelligent urban infrastructure, promote the scientific deployment of smart terminals such as video surveillance, monitoring sensors, and control execution devices, enhance the integration of AI technology with the Internet of Things (IoT), and support the realization of precise interaction between the physical city and the digital city.
Article 61: The Municipality shall establish an intelligent urban operations hub and build a distributed, multi-center urban data hub system to facilitate cross-departmental, cross-sectoral, and cross-regional coordination of data, technology, and operations. It shall encourage the development of AI solutions tailored to various digital city application scenarios and construct a digital twin platform for the city.
Article 62: The Municipality shall comprehensively advance the application of artificial intelligence in urban governance. Focusing on areas such as community governance, public safety, traffic management, emergency management, market regulation, ecological and environmental protection, planning and construction, and the management of building glass curtain walls, the Municipality shall deepen the comprehensive application of artificial intelligence to enhance the overall operational and decision-making efficiency of the city and improve the capacity for prevention and emergency response to public health and other emergencies.
Article 63: This municipality supports the construction of a smart judicial system by integrating functions such as data application, judicial transparency, and dynamic tracking. It promotes the application of artificial intelligence in case triage, evidence collection, case analysis, and the reading and analysis of legal documents to enhance the intelligence level of the judicial system.
Chapter V: Industry Governance and Security
Article 64: The Municipality adheres to the overall national security outlook, coordinating the development and security of the AI industry to ensure the security of industrial and supply chains. Relevant departments shall conduct security inspections and supervision of AI applications in accordance with the law.
Article 65 The Municipal People’s Government and relevant departments shall, in response to new AI technologies, industries, business models, and operational paradigms, and in accordance with the rapid iteration of AI, formulate, amend, or repeal corresponding regulatory rules and standards; explore tiered governance and sandbox regulation; stimulate the innovative vitality of various entities; and expand the scope for AI development.
High-risk AI products and services shall be subject to list-based management, with compliance reviews conducted in accordance with the principles of necessity, legitimacy, and controllability. For medium- and low-risk AI products and services, a governance model combining prior disclosure and post-event control shall be adopted to promote pilot initiatives. Specific measures shall be separately formulated by the Municipal People’s Government.
Relevant municipal departments may establish a list of minor violations in the course of AI industry development that are exempt from administrative penalties in accordance with the law, and promote the lawful and compliant conduct of production and business operations by citizens, legal persons, and other organizations through measures such as criticism and education, guidance, and formal discussions.
Article 66 The Municipality shall establish an Expert Committee on AI Ethics to perform the following duties:
(1) Organize the formulation of ethical guidelines for the AI sector;
(2) Guide higher education institutions, research institutes, enterprises, and relevant industry organizations in conducting research and exploration on AI ethics, and promote participation in domestic and international discussions on major ethical issues and the formulation of standards in the AI field;
(3) Promote the establishment of ethical and safety governance systems by artificial intelligence enterprises;
(4) Conducting assessments of potential risks associated with AI applications in key areas such as life and health, and public safety;
(5) Conducting ethical consultation activities in the field of artificial intelligence and providing decision-making advisory services to relevant departments;
(6) Conduct education and outreach on ethical safety in the field of artificial intelligence.
Article 67: Relevant entities engaged in the research, development, and application of artificial intelligence shall comply with laws and regulations, enhance ethical awareness, and shall not engage in the following acts:
(1) Providing products or services that endanger national security or public safety;
(2) Providing products and services that endanger the personal or property safety of users, or infringe upon personal privacy or the rights and interests related to personal information;
(3) Providing products and services that discriminate against users on the basis of ethnicity, race, gender, age, occupation, or religious beliefs;
(4) Using algorithmic technologies to engage in acts that infringe upon consumer rights, such as price discrimination or consumer fraud, or to engage in monopolistic practices or unfair competition;
(5) Using deepfake technology to carry out acts prohibited by the state;
(6) Other acts that violate relevant laws, regulations, and public order and good morals.
Article 68 Entities providing services using biometric technology, as well as entities providing technical support (hereinafter referred to as “biometric service providers”), shall adopt secure and controllable technical safeguards and establish sound algorithm management systems. The municipal cyberspace administration and other relevant departments shall strengthen supervision over biometric information and supervise and guide biometric service providers in the provision of related services.
Article 69. When employers use artificial intelligence technology to assist in labor discipline management, employee scheduling, recruitment, and promotion decisions, they shall comply with laws, regulations, and ethical standards, shall not establish discriminatory conditions, and shall protect the lawful rights and interests of employees.
Article 70 The Municipality shall strengthen the application of artificial intelligence in fields such as education, healthcare, elderly care, childcare, and disability assistance to improve the quality of life for special groups, including the elderly, persons with disabilities, women, and minors. When providing intelligent public services, the needs of special groups such as the elderly, persons with disabilities, women, and minors shall be fully taken into account, and necessary alternative solutions shall be provided.
Chapter VI Supplementary Provisions
Article 71. The artificial intelligence technologies referred to in these Regulations are those listed in the State Council’s “New Generation Artificial Intelligence Development Plan,” including key technologies such as machine learning, knowledge graphs, natural language processing, computer vision, human-computer interaction, biometric recognition, and virtual reality (augmented reality).
Article 72. These Regulations shall come into effect on October 1, 2022.
