Shanghai Office for Promoting the Construction of Science and Technology Innovation Center (hereinafter referred to as "Shanghai Science and Technology Foundation"), in accordance with the "Measures for the Use and Management of Special Development Funds for Shanghai Zhangjiang National Innovation Demonstration Zone" (Shanghai Cai Bao [2021] No. 75), and in conjunction with the "Special Development Funds" (hereinafter referred to as "Special Funds") for Shanghai Zhangjiang National Innovation Demonstration Zone, will provide the following information to the Shanghai Science and Technology Foundation Combined with the actual management of special development funds (hereinafter referred to as "special funds") in Shanghai Zhangjiang National Innovation Demonstration Zone, the implementation rules are formulated.
Article 1 Guiding ideology

Article 2 Principles of Utilization
The utilization and management of the special funds shall follow the principles of focusing on the gathering of innovation elements, strengthening the integration and linkage of funds, highlighting the policy performance management, and strengthening the management of financial funds. It focuses on the cultivation of high-level innovation subjects, the transformation of innovation achievements, the construction of innovative industrial clusters, the optimization of the innovation ecological environment and the gathering of high-end talents. The special funds strictly implement the provisions of budget management and the use of financial funds, the implementation of earmarking, strict approval procedures, strengthen the implementation of supervision, and effectively improve the effectiveness of the use of special funds.
Article 3 Scope of Application
(a) Applicable Area: The special funds are applicable to the parks (hereinafter referred to as "Zhangjiang Hi-Tech Zone") within the scope of the Zhangjiang Hi-Tech Development Zone (hereinafter referred to as "Zhangjiang Hi-Tech Zone"), which are approved by the state and municipal governments. (hereinafter referred to as "Zhangjiang Hi-Tech Zone") within the scope of the park (except Zhangjiang Core Park, Lingang Park), Zhangjiang Core Park (excluding the expansion area), Lingang Park in accordance with the implementation of the relevant measures; Zhangjiang Core Park expansion area with reference to the enjoyment of the park's policies; to enhance the capacity of innovation source of the major projects can be expanded for the whole city (except Lingang New Area, Zizhu Hi-Tech Zone).
(b) Applicable projects: The projects supported by the special funds are categorized into major projects and key projects. Major projects refer to projects implemented around the construction of science and technology innovation centers with global influence and Zhangjiang Comprehensive National Science Center, projects laid out around the enhancement of innovation curbing capacity, and projects explicitly supported by the municipal party committee and the municipal government. Key projects refer to the projects implemented in the parks of Zhangjiang Hi-tech Zone (except Zhangjiang Core Park and Lingang Park) and the expansion area of Zhangjiang Core Park.
(3) Funding Objects: Legal entities with independent civil liability, the corresponding ability to undertake the project, normal business status, good credit record, and after the official declaration of the project, maintain the stability of the place of registration, and meet one of the following conditions (hereinafter referred to as "project"). The key project units shall be enterprises or organizations with their registered place of business within Zhangjiang Hi-Tech Zone, and the enterprises shall fill in the Torch Statistical Enterprise Report.
2. The units of major projects should be enterprises and organizations registered in Zhangjiang Hi-Tech Zone; the units of major projects to enhance the innovation source capacity should be enterprises and organizations registered in Shanghai.
3. The Municipal Party Committee and the municipal government will determine the supporting units of the project.
Article 4 Funding Arrangement
The special fund will be set up by the municipal and district governments, and will be arranged by the Municipal Bureau of Finance and the District Finance Bureaus' budgets each year between 2021 and 2025.

Article 5 Use of Funds

2. Support high-quality innovation and development of enterprises, and support the continuous innovation and development of high-tech enterprises; support enterprises to improve their intellectual property rights, technological innovation, quality management and other levels, and set up industry benchmarks.
3. Encourage enterprises to actively participate in the construction of comprehensive national science centers, build high-level innovation platforms around major plans, projects and programs in the field of science and technology of the country, carry out forward-looking research, core technology research, and the transformation of major innovations to enhance the concentration and display of comprehensive national science centers.
(2) Promote the transformation of innovation achievements
1. Support the industrialization of innovation achievements in the park, and support the industrialization of domestic and international leading innovation achievements independently developed and introduced by enterprises; support enterprises to apply advanced technological means to enhance the industrialization capacity; support enterprises to apply advanced technological means to enhance the industrialization capacity; support enterprises to apply advanced technological means to enhance the industrialization capacity. Support the upgrading of the functions of innovation and entrepreneurship carriers, and the improvement of public service facilities; support the upgrading of science and technology services, and the integration of specialized service resources such as business incubation, science and technology finance, and intellectual property rights. Support the upgrading of scientific and technological service capacity, integration of business incubation, scientific and technological finance, intellectual property and other specialized service resources, and the provision of high-level integrated services for SMEs. (6) Other programs explicitly supported by the municipal government.
Article 6 Support Mode
The special fund adopts the mode of gratuitous subsidy or incentive, loan subsidy, capital injection, etc., in principle, the same project can only apply for one mode of support. In principle, the same project can only apply for one type of support. The project has been supported by other municipal or district-level financial resources, in principle, no longer support.
Article VII of the project management process
(a) major project management process
1, project declaration
The project unit fills in and submits the application materials online on the information management platform of Shanghai Municipal Finance Science and Technology Input. For those who have undertaken special funding projects and have not yet completed the acceptance of the unit, in principle, until the completion of the acceptance before applying for new projects.
The declaration of major projects to enhance the innovation source capacity outside the parks covered by the special funds will require the district finances to arrange district-level funds in principle at a ratio of no less than 1:1.
2. Project Evaluation
The Shanghai Science and Technology Development Organization (SSTDO) organizes the evaluation and assessment of the project. For projects that need to adjust the content and budget after evaluation, the project applicant will be notified to make adjustments, and if necessary, a reassessment and review will be organized.
3. Project Announcement
Projects that have passed the evaluation and assessment will be announced on the portal of Shanghai Science and Technology Foundation for 5 working days. If there are any objections to the public announcement, the project will not be established if it is found to be true.
4. Consultation and review
The Shanghai Science and Technology Foundation will summarize the projects to be established, prepare a report on the proposed budgetary arrangements for major projects, and submit it to the director of the Foundation for consideration at the meeting of the Director General of the Shanghai Science and Technology Foundation, after consulting with the Municipal Commission of Development and Reform, the Municipal Science and Technology Commission, and the Municipal Finance Bureau. After reviewing with the Municipal Development and Reform Commission, the Municipal Science and Technology Commission and the Municipal Finance Bureau, the report will be submitted to the Director of Shanghai Science and Technology Development for consideration.
5. Project Approval
The projects and budgets approved by the Director Meeting of the Shanghai Science and Technology Development Corporation (SSDF) shall be issued by the SSDF to the project units, with a copy to the relevant management organizations.
6. Contract Signing
Major projects are managed by contracts, which are signed by the Shanghai Science and Technology Foundation (SSTF), the co-management unit of the project and the project unit. The project contract is the basis for the allocation of project funds, project supervision and project implementation, and the contract text is uniformly produced by the Shanghai Science and Technology Development Corporation (SSTD).
7. Disbursement of Funds
Municipal support funds will be disbursed by the Municipal Bureau of Finance through the transfer of funds from the municipal to the district to the district bureaus of finance. In the annual implementation, according to the project contract and implementation progress, in accordance with the management requirements of the centralized payment from the state treasury, the district finance bureaus will disburse the special funds to the project units.
8. Project Supervision
The Shanghai Science and Technology Development Corporation (SSTDC) and the joint management unit of the project will carry out the whole process of supervision on the use of the special funds and the implementation of the project. Establishment of a monitoring mechanism including stage-by-stage inspection, acceptance (including audit), project adjustment, termination and liquidation.

For projects that have passed the preliminary examination, the government of the district where the sub-park is located will issue a letter of commitment for project recommendation and funding support.
4. Project Evaluation
The Shanghai Science and Technology Parks Foundation (SSTP) organizes project evaluation and assessment. For project units that have serious credit violations, their applications will not be evaluated. For projects that need to adjust the content and budget after evaluation, the project unit will be notified to make adjustments, and if necessary, a reassessment will be organized.
5, linkage and integration of consultation
In accordance with the requirements of the city's financial and scientific and technological input linkage and integration of management requirements to carry out linkage and integration of consultation, the project has been supported by other municipal financial funds will not be established.
6. Project Announcement
Projects that have passed the evaluation and assessment will be announced in the portal of Shanghai Science and Technology Development for 5 working days. For projects that are questioned by the public, the management organization of the branch park will verify and clear the doubts; projects that are not verified or have problems will not be established.
7. Review
The Shanghai Science and Technology Foundation summarizes the projects to be supported, prepares a report on the proposed budgetary arrangements for the key projects, and submits it to the Director of the Shanghai Science and Technology Foundation for consideration at the meeting of the Director of the Shanghai Science and Technology Foundation, after consulting and reviewing the report with the Municipal Bureau of Finance, Municipal Commission for Development and Reform, and Municipal Commission for Science and Technology. After reviewing with the Municipal Finance Bureau, the Municipal Development and Reform Commission and the Municipal Science and Technology Commission, the report will be submitted to the Director of Shanghai Science and Technology Foundation for consideration.
8. Project Approval
The projects and funding arrangements considered and approved by the Director's Meeting of the Shanghai Science and Technology Foundation (hereinafter referred to as "SSTF") shall be approved in writing by the SSTF to the management organizations of the sub-parks, and copied to the Municipal Commission for Development and Reform (hereinafter referred to as "CCDR"), the Municipal Science and Technology Commission (hereinafter referred to as "CSTC"), the Municipal Finance Bureau, and the district government of the sub-park. The approval opinions will be copied to the Municipal Development and Reform Commission, Municipal Science and Technology Commission, Municipal Finance Bureau, and the district government where the branch park is located. 9. Contract Signing
The approved project will be signed by the management organization of each sub-park and the project unit. The project contract is filled out online on the Information Management Platform of Shanghai Municipal Finance and Science and Technology Input. The project contract is an important basis for the project management body to allocate funds, supervise and manage as well as the project unit to implement the project, and is not transferable. The text of the project contract is produced by the Shanghai Science and Technology Foundation.
10. Disbursement of Funds
Municipal support funds will be disbursed by the Municipal Bureau of Finance through the municipal to district transfer payment to the district bureaus of finance. In the annual implementation, according to the project contract and the progress of project implementation, in accordance with the management requirements of centralized payment from the state treasury, the district finance bureaus will disburse the special funds to the project units.

Article 8 Budget Arrangement
Before the end of September each year, the management body of each sub-park will report to the Shanghai Science and Technology Development Corporation (SSTD) on the expenditure demand for special funds for the key projects for the next year. SSTD will summarize the demand for expenditure of special funds for the major projects, and after coordination and balance, form the expenditure demand for special funds for the urban areas for the next year. After balancing, it will form the budget demand for special funds in the urban area in the next year.
Before the end of October each year, the Shanghai Science and Technology Foundation will submit the municipal budget for the next year's special funds to the Municipal Bureau of Finance, and copy the coordinated and balanced municipal budget demand for special funds for the next year's sub-parks to the sub-parks' management organizations, and the sub-parks' management organizations will submit the municipal budget demand for special funds for the next year to the Finance Bureau of the district in which they are located. The city's budgetary requirements for the next year will be submitted to the district finance bureau in the region.
The municipal finance departments of the two levels of the next year special funds budget needs were reviewed, the municipal finance bureau in accordance with the amount of municipal support for the next year into the municipal to district transfer budget, the district finance bureaus in accordance with the total amount of municipal and district support for the preparation of the budget for the next year special funds in full.
Article IX Audit Supervision

Article 10 Performance Management
In accordance with the requirements of financial policy performance management, the special funds to establish a performance evaluation mechanism. The Shanghai Science and Technology Development Corporation (STD) will carry out at least one mid-term evaluation during the policy period to track the degree of achievement of the performance targets; within half a year before the expiration of the policy, STD will organize and carry out a performance evaluation on the implementation of the policy, and the results of the evaluation will be used as an important reference for the continuation of the policy. Each district should formulate the performance objectives of the special funds of its sub-parks and track the achievement of the performance objectives; within six months before the expiration of the policy, the organization will carry out the performance evaluation of the implementation of the policy of its sub-parks.
The Shanghai Science and Technology Development Corporation (STDF) and the districts regularly conduct performance evaluation or assessment of the projects supported by the special funds and their utilization of funds. The performance evaluation or assessment of major projects is organized and implemented by the Shanghai Science and Technology Foundation. The performance evaluation or assessment of key projects will be organized and implemented by the management bodies of the sub-parks, and the evaluation results will be reported to the Shanghai Science and Technology Development Corporation (STD). The results of the assessment and evaluation of the projects implemented by the project units will be incorporated into the credit evaluation system, which will serve as an important reference for the declaration of the special fund projects in the following years.
Article 11 Information Disclosure
The use of special funds is included in the scope of government information disclosure. The utilization of special funds for major projects is the responsibility of the Shanghai Science and Technology Development Corporation (SSTD) for the public disclosure of government information. The use of special funds for key projects is the responsibility of the Shanghai Science and Technology Development Corporation and the districts in accordance with the requirements of government information disclosure.
Article 12 Accountability
(a) The project unit should use the special funds in strict accordance with the relevant requirements.
1. The project unit has the following behavior, suspend the allocation of special funds, give a deadline for rectification, notification and criticism. Depending on the circumstances, the termination of the project, recovery of the allocated special funds.
(1) unauthorized changes in the use of funds, project implementation content, project cycle, the implementation of the main body, change the implementation of the main registered place;
(2) intentionally delaying the progress of project implementation;

(4) do not accept the project tracking and management in accordance with the provisions.

(4) preparation of false budgets, to seize financial funds;
(5) providing false financial accounting information, false expenditure;
(6) Violation of the provisions of the transfer, retention, transfer of project funds.
4. Other violations of laws and regulations or relevant disciplines, the need to be held accountable, in accordance with the relevant provisions.
(b) The districts should be strictly in accordance with the requirements of the use of special funds and supervision.
1, the key projects have been approved, according to the project contract and project implementation progress, the district finance bureau should be timely disbursement of special funds. If the funds are not disbursed in a timely manner, support for subsequent projects in the district will be suspended.
2. The project supervision is ineffective, to take interviews, notification and criticism and other processing measures. For the existence of other violations of laws and regulations or related disciplines, the need to be held accountable for the behavior, in accordance with the relevant provisions of the implementation.
Article 13 Supplementary Provisions
(a) These Rules shall be implemented from the date of issuance to December 31, 2025. Projects for which project management contracts have been signed before the effective date of these Rules and are still under implementation shall be implemented in accordance with the content of the signed project management contracts.
(2) The Shanghai Science and Technology Development Corporation shall separately formulate the "Measures for the Management of Major Projects of Special Development Funds of Shanghai Zhangjiang National Innovation Demonstration Zone", "Measures for the Management of Key Projects of Special Development Funds of Shanghai Zhangjiang National Innovation Demonstration Zone" and "Measures for the Implementation of Auditing Work of Project Funds of Zhangjiang National Innovation Demonstration Zone" and other management documents in accordance with the present Rules. (3) Each district shall formulate the documents on the use and management of special funds and the performance targets of financial policies in their districts based on the Measures for the Use and Management of Special Development Funds in Shanghai Zhangjiang National Innovation Demonstration Zone (Shanghai CaiBei 〔2021〕 No. 75) and the present rules, and copy them to the Shanghai Science and Technology Development Corporation (STDC) in a timely manner.
(d) These rules are interpreted by the Shanghai Science and Technology Foundation.
