Original Title: Notice of the Shandong Provincial Department of Industry and Information Technology on Issuing the "Interim Measures for the Graded Cultivation and Management of Green Manufacturing Entities in Shandong Province"
Chapter I General Provisions

Article 1 These Measures are formulated to accelerate the development of green manufacturing and service systems, expedite the establishment of standardized and sustainable development mechanisms, and foster leading forces in green manufacturing, in accordance with the relevant requirements of the Ministry of Industry and Information Technology’s “Interim Measures for the Graded Cultivation and Management of Green Factories” and the “Shandong Province Work Plan for Carbon Peaking in the Industrial Sector.”

Article 2 Green manufacturing entities include green factories, green industrial parks, and green supply chain management enterprises. The tiered cultivation of green manufacturing entities refers to establishing a cultivation mechanism across two dimensions: vertically, forming a three-tiered (national, provincial, and municipal) coordinated cultivation mechanism for green manufacturing entities; and horizontally, forming a cultivation mechanism where green industrial parks and green supply chain management enterprises drive the creation of green factories among enterprises within the park and along the supply chain.

Article 3 The tiered cultivation and management of green manufacturing entities shall adhere to the principle of placing enterprises and industrial parks at the center, while upholding government guidance and standard-driven development. It shall be based on the construction of green factories, supported by the development of green industrial parks and green supply chain management enterprises, optimize the policy environment, guide third-party institutions to provide professional services, stimulate the endogenous momentum for enterprises’ green development, and promote the green and low-carbon transformation and upgrading of industries and regions.

Article 4 Enterprises and industrial parks are encouraged to actively engage in green manufacturing benchmarking, improvement, and evaluation. Benchmarking and improvement activities shall follow the principle of voluntariness, while evaluation activities shall adhere to the principles of voluntariness, fairness, impartiality, and transparency.

Article 5 The Provincial Department of Industry and Information Technology is responsible for the overall guidance and management of the tiered cultivation of green manufacturing entities across the province. The industrial and information technology departments of each city, county (city, district) are responsible for the cultivation, application, and management of green manufacturing entities within their respective jurisdictions.

Chapter II: Cultivation Criteria

Article 6 Basic eligibility criteria for green factory cultivation candidates:

1. Manufacturing enterprises that are legally established, possess independent legal person status or are independent accounting units treated as legal persons, and are engaged in actual production; such enterprises shall comply with relevant laws, regulations, policies, and standards during construction and production.

2. Possess a sound economic and technical foundation and demonstrate strong economic performance, with relevant performance indicators exceeding the industry average and a clear competitive advantage within the province’s industry sector.

3. Possess high standards of quality, environmental protection, workplace safety, and energy and resource management, with comprehensive management systems that are in place and continuously improved.

4. Place high priority on industrial energy conservation, carbon reduction, water conservation, and clean production. Eligible enterprises should actively participate in initiatives such as energy efficiency benchmarking, water-saving enterprise certification, and zero-waste enterprise certification; voluntarily conduct green audits; strengthen the application of audit findings; and enhance green transformation efforts.

5. The following situations must not have occurred in the past three years: failure to maintain normal business operations (including business deregistration, continuous suspension of production for 12 months or more, or being listed by market supervision authorities on the list of businesses with abnormal operations or serious illegal and dishonest conduct and not yet removed from such lists);Being dynamically removed from the green manufacturing list; incurring accidents related to environmental pollution, safety (including workplace safety, cybersecurity, and data security), or product quality, as well as illegal or non-compliant acts such as tax evasion (refer to “Credit China” and the “National Enterprise Credit Information Publicity System”); being listed as a discredited person subject to enforcement; being found to have serious issues during relevant inspections by the State Council and relevant ministries and failing to complete rectifications as required; or being included in the industrial energy conservation inspection rectification list and failing to complete rectifications as required.

6. Meet the relevant industry evaluation standards for green factories.

Article 7 Basic Conditions for Candidates for Green Industrial Park Development:

1. Industrial parks with legally defined boundaries and scope, equipped with a unified management body, whose primary functions are product manufacturing and energy supply, with industrial value-added accounting for no less than 45% in principle; national and local laws, regulations, policies, and standards related to green, circular, and low-carbon development are effectively implemented; those involving chemical industrial parks must be certified by the provincial people’s government or its authorized agency.

2. The park has issued a green factory cultivation plan and actively organizes enterprises within the park to carry out green factory creation efforts.

3. In the past three years, there have been no major pollution or safety incidents or major ecological damage events; no serious issues were identified during relevant inspections by the State Council or relevant ministries and commissions; the park has not been dynamically removed from the green manufacturing list; energy conservation, emission reduction, and carbon reduction targets set by the national or local government have been met; environmental quality meets the environmental quality standards for environmental functional zones as stipulated by national or local regulations, and pollutant emissions from enterprises within the park comply with standards;Total emissions of all key pollutants do not exceed national or local total emission control requirements; 100% of enterprises within the park subject to mandatory clean production audits must conduct such audits in accordance with the law.

4. Enterprises within the park shall not use outdated production technologies, processes, or equipment listed in the national phase-out catalog, nor shall they produce products listed in the national phase-out catalog.

5. Establish a dedicated agency responsible for green development and assign at least two full-time staff members to it.

6. The park is encouraged to establish and operate an environmental and energy management system, as well as an energy monitoring and management platform; it is encouraged to construct and operate facilities for the application of renewable energy sources such as wind and solar power; and it is encouraged to actively pursue the creation of a “zero-waste” and “near-zero-carbon” industrial park.

7. Meet the relevant evaluation criteria for green industrial parks.

Article 8 Basic Eligibility Criteria for Enterprises to be Cultivated as Green Supply Chain Management Entities:

1. Legally established with independent legal person status or as an independently accounted unit deemed equivalent to a legal person; possessing a solid foundation in green supply chain management and significant industry influence; maintaining high standards in quality, environmental protection, work safety, and energy and resource management; having sound management systems in place; and complying with national and local laws, regulations, and standards.

2. Have formulated a green factory development plan for upstream and downstream suppliers to promote the establishment of green factories among suppliers; in principle, the enterprise itself should be a green factory.

3. Possess a large number of suppliers, exert significant influence among them, and maintain sound cooperative relationships with upstream and downstream suppliers; have a comprehensive supplier management system, and establish sound mechanisms for supplier certification, selection, auditing, performance management, and termination.

4. Possess sound financial management systems, with sales profitability at the industry-leading level; have clear objectives, plans, and measures for implementing green supply chain management.

5. Must not have experienced any of the following situations in the past three years: failure to maintain normal business operations (including business deregistration, continuous suspension of production for 12 months or more, or being listed by market supervision authorities on the list of businesses with abnormal operations or serious illegal and dishonest conduct and not yet removed from such lists);Being dynamically removed from the green manufacturing list; incurring accidents related to environmental pollution, safety (including workplace safety, cybersecurity, and data security), or product quality, as well as illegal or non-compliant acts such as tax evasion (refer to “Credit China” and the “National Enterprise Credit Information Publicity System”); being listed as a discredited person subject to enforcement; being found to have serious issues during relevant inspections by the State Council and relevant ministries; or being included in the industrial energy conservation inspection rectification list and failing to complete rectification as required.

6. Meet the relevant evaluation criteria for green supply chain management enterprises.

Chapter III Application and Certification Procedures

Article 9 The Provincial Department of Industry and Information Technology issues an application notice annually. Enterprises and industrial parks, acting on a voluntary basis, shall prepare application reports in accordance with relevant standards, either through self-evaluation or by commissioning a third-party evaluation agency with the necessary capabilities. Enterprises and industrial parks that meet the standard requirements following evaluation shall submit their self-evaluation reports or third-party evaluation reports, along with relevant supporting materials, to the local Department of Industry and Information Technology.In principle, applicants for provincial-level green manufacturing units must first be included in the municipal-level green manufacturing list. The number of recommendations from each city will be determined comprehensively based on factors such as the number of industrial enterprises above a certain scale and the development of the tiered cultivation system.

Article 10: The Municipal Bureau of Industry and Information Technology must review the application reports and supporting materials submitted by enterprises and industrial parks. After soliciting opinions from local departments such as ecological environment, emergency management, and market regulation, it shall recommend the most qualified candidates to the Provincial Department of Industry and Information Technology.The Provincial Department of Industry and Information Technology shall organize expert reviews and, as appropriate, conduct on-site inspections. Entities that meet the criteria for provincial-level green factories, green industrial parks, and green supply chain management enterprises, and have been approved following review and deliberation, shall have their names published on the website of the Provincial Department of Industry and Information Technology. Upon the absence of objections, the Provincial Department of Industry and Information Technology shall issue an official document to announce the list.

Article 11: The criteria for the recognition of provincial-level green manufacturing entities shall be based on the relevant standards and requirements for national-level green manufacturing entities issued by the Ministry of Industry and Information Technology. After comprehensive evaluation, the total score must be 70 points or higher. In key industrial sectors, priority shall be given to factories whose energy efficiency levels meet the benchmark standards issued by relevant national authorities; in other industries, priority shall be given to factories that meet the advanced values or Level 1 standards of the corresponding national energy consumption limits. Priority support shall be given to entities that have been recognized as provincial-level or higher energy efficiency and water efficiency leaders.

Article 12 Applications for national-level Green Factories, Green Industrial Parks, and Green Supply Chain Management Enterprises shall be organized and conducted in accordance with relevant documents and requirements issued by the Ministry of Industry and Information Technology. In principle, applicants for national-level Green Manufacturing Units must first be recognized as provincial-level Green Manufacturing Units.

Article 13 Third-party evaluation agencies shall conduct their work in accordance with relevant national laws, regulations, policies, standards, and these Measures, following the requirements for third-party evaluation of green manufacturing. They shall produce evaluation results, issue evaluation reports, assume responsibility for such reports, and accept supervision.

Article 14 Industrial and Information Technology departments at all levels shall strengthen the qualification review and supervision of third-party evaluation agencies serving their respective regions. Third-party evaluation agencies found to have engaged in fraud or to have poor evaluation quality shall have their qualifications to conduct green manufacturing evaluations revoked, and their evaluation results shall not be accepted for three years; evaluation reports and results submitted by third-party agencies that do not meet basic requirements shall not be accepted.

Chapter IV Dynamic Management

Article 15 Green manufacturing entities shall be subject to dynamic management.Provincial-level green manufacturing entities shall operate on a three-year cycle. Upon expiration of the cycle, they shall undergo a re-evaluation as required. Entities undergoing re-evaluation must report on their production and business operations during the previous evaluation cycle and changes in key green manufacturing indicators, and submit re-evaluation materials as required. After review by the Municipal Bureau of Industry and Information Technology, the materials shall be submitted to the Provincial Department of Industry and Information Technology for examination. The Provincial Department of Industry and Information Technology shall organize expert reviews and conduct on-site spot checks as appropriate. Based on actual conditions, the list shall be dynamically adjusted, and the re-evaluation results shall be promptly announced; entities meeting the criteria shall have their designation extended for three years.

Article 16 During the three-year cycle, if there are significant changes in the actual scope of production and operations, production address, or organizational boundaries compared to the time of inclusion as a green manufacturing entity due to investment, mergers and acquisitions, management, or other reasons, a re-evaluation must be promptly applied for, and a revised evaluation report submitted. After preliminary review by the Municipal Bureau of Industry and Information Technology, the materials are forwarded to the Provincial Department of Industry and Information Technology. The Provincial Department of Industry and Information Technology organizes a review of the re-evaluation materials; entities no longer meeting the standard requirements are removed from the list in accordance with procedures, and the re-evaluation results are promptly announced.

Article 17 Green manufacturing units at the national, provincial, and municipal levels shall, as required, report on the progress of their green manufacturing work annually within the specified timeframe. They shall complete the “Green Manufacturing Dynamic Management Form” and submit it via the Industrial Energy Conservation and Green Development Management Platform (URL: https://green.miit.gov.cn) to the Department of Energy Conservation and Comprehensive Utilization of the Ministry of Industry and Information Technology, with a copy sent to the Provincial Department of Industry and Information Technology.

Article 18 Industrial and Information Technology departments at all levels shall strengthen guidance and management of green manufacturing entities, conduct on-site spot checks and re-verifications from time to time, and continuously track and analyze the effectiveness of their initiatives. Any major or higher-level production safety or quality incidents, or Level II (major) or higher sudden environmental pollution incidents, must be reported in real time. Upon verification of the relevant circumstances, such entities shall be promptly removed from the green manufacturing lists at all levels and an announcement shall be made.

Article 19. Green manufacturing entities that fall under any of the following circumstances shall be removed from the annual list and publicly announced upon its release:

1. Those that are not operating normally (e.g., business registration has been revoked, production has been suspended for 12 consecutive months or more, or the entity has been listed by market supervision authorities on the list of entities with abnormal business operations or serious violations and loss of credibility and has not been removed from such lists).

2. Entities dynamically removed from the green manufacturing list.

3. Entities that have incurred accidents related to safety (including work safety, cybersecurity, and data security), quality, or environmental pollution, or have engaged in illegal or non-compliant activities such as tax evasion or underpayment (as referenced in “Credit China,” the “National Enterprise Credit Information Publicity System,” and feedback from relevant departments).

4. Entities found to have serious issues during relevant inspection and supervision activities conducted by the State Council and other relevant ministries and commissions.

5. Entities included on the industrial energy conservation inspection rectification list that have failed to complete rectification as required.

6. The enterprise has been designated as a discredited entity subject to enforcement.

7. Refusal to submit the dynamic management form on time.

8. Submitted materials or data contain falsifications or other issues.

Article 20 If a green manufacturing entity changes its name, it shall promptly report such change to the local Department of Industry and Information Technology within 30 working days after completing the relevant procedures. The local Department of Industry and Information Technology shall review the change application and provide its opinion on the change. For entities included in the provincial green manufacturing list, the department shall submit the change opinion collectively during the annual list recommendation process, and the Provincial Department of Industry and Information Technology shall announce and update the list accordingly when publishing the annual list.

Article 21. Any organization or individual may file a real-name report with the local Department of Industry and Information Technology regarding issues related to the authenticity or accuracy of information concerning green manufacturing entities or third-party institutions, and shall provide supporting materials and contact information.For accepted reports, the relevant Department of Industry and Information Technology shall promptly verify the information. If the reported issues are confirmed through verification, corrective actions shall be required based on the severity of the circumstances; if the corrective actions are inadequate, the entity shall be removed from the Green Manufacturing List or the third-party institution shall be placed on a blacklist as required.

Chapter V Incentive Measures

Article 22 Industrial and Information Technology departments at all levels shall provide policy support to recognized and published green manufacturing entities in accordance with relevant documents, and shall, in conjunction with relevant departments, provide priority support in areas such as technological upgrading, applications for special funds, government procurement, pilot demonstrations, financial services, and brand promotion. They shall actively promote the dissemination and implementation of green manufacturing standards and strengthen the cultivation of green manufacturing entities.

Article 23. Industrial and Information Technology departments at all levels shall actively utilize public channels to showcase and promote the advanced technologies and exemplary practices of green manufacturing entities, and organize enterprises to benchmark against these standards for improvement. Green factories are encouraged to compile green and low-carbon development reports; green industrial parks are encouraged to formulate support policies for green factories; and enterprises engaged in green supply chain management are encouraged to increase their procurement of products from green factories.

Article 24 Green manufacturing evaluation agencies shall strengthen their own capacity building and the training of professional personnel; proactively disseminate green manufacturing concepts and requirements to target enterprises; promote advanced and proven practices; thoroughly identify highlights and potential areas for improvement in green development efforts; propose reasonable recommendations for enhancement; track the needs of target enterprises throughout their green development process; and provide comprehensive green manufacturing solutions and ongoing technical services.

Chapter VI Supplementary Provisions

Article 25 The Provincial Department of Industry and Information Technology shall be responsible for interpreting these Measures.

Article 26 These Measures shall take effect on June 22, 2024, and remain valid until June 21, 2027.
