Chapter I General  rules

Second Article The funds for industrial transformation and development referred to in these Measures refer to the funds arranged in the provincial fiscal budget for supporting the promotion of industrial transformation and upgrading, clean and efficient use of energy, and reform of state-owned enterprises in the province.

Third, the management and use of industrial transformation and development funds adhere to the "focus, merit-based support, open and transparent, performance-oriented" principle, give full play to the guiding role of financial funds to ensure that the use of funds standardized, safe and efficient.

Article IV of the Industrial Transformation and Development Funds by the Provincial Department of Finance and the Provincial Party Committee of the Office of Civil-Military Integration, the Provincial Department of Industry and Information Technology, the Provincial State-owned Assets Supervision and Administration Commission, the Provincial Bureau of Energy (hereinafter referred to as the "Provincial Department in charge of the") in accordance with the responsibilities of the division of labor for the management.

The provincial department in charge of operations is responsible for the budgeting and specific implementation of the industrial transformation and development funds, researching and formulating the allocation and use of funds and task lists, and is responsible for the progress of expenditure, the performance of use, and the safety and standardization of the special funds.

Cities and counties, finance, business departments should strengthen coordination and cooperation, timely and full allocation of industrial transformation and development funds issued to the local, dynamic management and tracking of the use of funds, to ensure that the funds are earmarked to improve the effectiveness of the use of funds.


Chapter II Budgeting

 

Article 5 Industrial transformation and development funds are mainly used in the form of equity investment, awards in lieu of subsidies, non-reimbursable grants, loan subsidies, insurance compensation, government purchase of services and other ways to accelerate the conversion of old and new kinetic energy and promote high-quality development, focusing on the key areas of industrial transformation and development and work tasks, focusing on supporting the following aspects:

(a) eliminating backward production capacity and reducing excess capacity.

(ii) Industrial transformation and upgrading. It mainly includes high-level technological transformation of industrial enterprises, upgrading of traditional industries, cultivation of new industries such as industrial internet and 5G, and cultivation and training of talents.

(3) Innovative development of private economy. It mainly includes the promotion and application of new products, the cultivation of high-growth enterprises such as gazelles and the construction of public service platforms, and the publicity and promotion of brands in the industrial field.

(4) Other key tasks determined by the provincial government.

Article 6: In accordance with the requirements of the provincial budgeting work, the provincial departments in charge of provincial operations shall, in advance, do a good job of project demonstration, assessment and sub-yearly measurement of funding needs, performance target setting and other basic work, study and put forward the proposal of medium-term financial planning for the development of funds for industrial transformation and the arrangement of the annual budget, and in accordance with the order of priority, set up a perfect project library management system to realize the management of the whole life cycle, and fail to incorporate budgetary Projects not included in the project database of the integrated management system shall not be budgeted. In the budget preparation, the provincial party committee and provincial government to determine the major reforms, important policies and key project expenditures should be compiled.

The Provincial Department of Finance, in accordance with the requirements of budgeting and fund management, will review the budget of the funds submitted by the provincial departments in charge of operations, comprehensively consider the expenditure policy, fund demand, financial possibilities, the performance of the previous year and other factors, study and propose the annual budget arrangement, and submit it to the Provincial People's Congress for deliberation and approval in accordance with the procedures.

Article VII Establishment of major policies and projects prior performance assessment mechanism. Provincial departments in charge of applying for new major policies and projects through the industrial transformation and development funds to arrange the expenditure budget, prior performance assessment should be carried out, issued an assessment report, focusing on the policy and project budget set up the necessity of the input economy, the reasonableness of the performance objectives, the feasibility of the implementation of the program, funding compliance and other demonstration and assessment. The Provincial Department of Finance shall review and approve the budgets of new major policies and projects based on the budget applications and prior performance assessment reports submitted by the provincial departments in charge of provincial operations, organize third-party institutions to independently carry out performance assessment when necessary, and make the assessment results a necessary condition for project entry and budget arrangement. Policies and projects without prior performance assessment and poor performance assessment results shall not be included in the medium-term financial planning and annual budget.

Article VIII In accordance with the principle of "who applies for funds, who prepares the performance target", the provincial department in charge of the business should improve the performance target reporting mechanism. Article 9 The industrial transformation and development funds implement task list management, clarifying the specific expenditure matters, scale of funds, and performance objectives of each task. According to the different contents of the tasks, the task list is divided into binding tasks and guiding tasks. Cities and counties are allowed to co-ordinate the use of the remaining funds within the same task list after completing the binding tasks, and the cities and counties shall report the co-ordination situation to the provincial operational departments within the specified time limit, which will summarize the situation and submit it to the provincial Department of Finance for record.


Chapter III Budget Implementation

 

Article 10 After the provincial budget has been considered and approved by the provincial people's congress, the provincial department in charge of provincial operations shall, in accordance with the size of the annual budget of the funds for the development of the industrial transformation and the list of tasks under its management, study the development of a program for allocating the funds to ensure that the key expenditures determined by the provincial party committee and the provincial government do not leave a "hard gap". The provincial business administration shall fill in the budget execution plan in time, specify the time nodes and work measures for budget execution, and report to the Provincial Department of Finance for the record on schedule.

Chapter IV Supervision and Management of Funds

 

Article XVI of the provincial departments in charge of business to accelerate the progress of the budget implementation, in strict accordance with the management of funds and the use of funds in accordance with the financial management and other relevant regulations. To ensure that funds are earmarked for specific purposes, shall not be crowded out, misappropriation, shall not arbitrarily change the use of funds and expand the scope of use, shall not be falsely charged, and shall not arbitrarily change the budget expenditure subjects. Article 20 The project implementation unit (enterprise) is responsible for the authenticity, accuracy and completeness of the declaration materials, and bears direct responsibility for the legal and compliant use of funds, as well as the progress of the project implementation and the implementation effect.

Article 21 The municipalities (counties) should be in charge of the business of industrial transformation and development funds to review the declaration materials, compliance, completeness is responsible for, and to strengthen the industrial transformation and development funds to support the whole process of supervision of the project, to ensure the smooth implementation of project construction. All levels of business administration departments, financial departments should take the initiative to accept the supervision of the National People's Congress, discipline inspection and supervision, audit and other aspects. Chapter V Supplementary Provisions

 

Article 22 of the provincial departments in charge of the operation may be based on these measures, combined with the expenditure of matters and management needs, to formulate specific rules for the implementation of fund management.

Article 23 These Measures shall come into force on March 9, 2022, and shall be valid until March 8, 2025. The Notice of the Shandong Provincial Department of Finance of the Office of the Military-Civilian Integration Development Committee of the Communist Party of China Eastern Provincial Committee of Shandong Province on the Issuance of Interim Measures for the Management of Shandong Provincial Funds for the Transformation and Development of Industry (Lu CaiGong [2019] No. 15) is hereby repealed at the same time. Other regulations on the management and use of funds that are inconsistent with these Measures shall be implemented in accordance with these Measures.
