In order to standardize the management of fishing boats and fishing ports in our region, and to maintain the safe production order of the fishery industry, we have formulated these measures in accordance with the Fisheries Law of the People's Republic of China, the Regulations on the Management of Fishing Ports in Liaoning Province, the Regulations on the Management of Fishing Boats in Liaoning Province, and other relevant documents such as "Comprehensively Strengthening Comprehensive Control Measures for Fishing Boats and Fishing Ports in the Sea (for Trial Implementation)" (LiaoNongLiangLingBan [2023] No. 41), "Opinions on Further Strengthening Safety Management for Fishing Boats at Sea" (DaGingBanFa [2014] No. 50), etc. ), the General Office of the Dalian Municipal People's Government "on further strengthening the safety management of fishing vessels at sea views" (Dazhengbanfa [2014] No. 50) and other relevant documents, the development of this approach.

A management responsibility

Article 2 The Social Affairs Bureau is responsible for coordinating the region's fishery production safety management. The region's fishing boats and fishing port safety management and pollution prevention and control work to supervise and inspect and business guidance, the implementation of industry regulatory responsibility.

Article 3 The street office is responsible for the management of fishery production safety within the jurisdiction. Responsible for fishing boats and fishing port safety management and pollution prevention and control. Implementation of the "port control ship" system. Organize and carry out production safety education, fisheries safety risk investigation and rectification and other related work.

Article 4 The village (neighborhood) is responsible for the establishment of the jurisdiction of the fishing boat and practitioners safety management accounts. At least 1 time per quarter to organize ship owners (operators), captains face-to-face publicity and education activities. Two fishing port management

Article 5 strict control of the number of fishing ports. The number of fishing harbors shall only be reduced and not increased. The region temporarily retained Tongshuigou fishing harbor and abalone belly, North Island, small Beihai, dangdizhi, eight fork of the ditch, the South China Sea head and the East circle of seven natural harbors due to the development and construction or other needs, should be immediately closed, prohibited the use of.

Article 6 The District Social Welfare Administration in Tongshui Gully fishing harbor and Bachanggou Harbor to establish the Fisheries and Fisheries Harbor Supervision and Management Station and is responsible for the management; in the abalone belly, Beidao, Xiao Beihai, Dangdidi, Bachanggou, Tongshui Gully, Nanhai Tou and the East Small Circle of the seven natural harbors to set up a fishing boat and fishing port management station, the local street is responsible for the day-to-day management.

Article 9: Strictly control the number of fishing vessels. The number of fishing vessels shall be strictly controlled, and the number of local fishing vessels shall be reduced but not increased. Article 10 The implementation of fishing boat mooring port reporting system. Fishing vessels must be centralized at fixed mooring points. Before March 30 every year, the owner and actual operator of the fishing boat must hold the vessel documents (purchase and sale agreement, notary public certificate and other relevant supporting materials) to the village (neighborhood) People's Committee for the registration of fixed mooring ports, summarized by the street reported to the District Agricultural Administrative Law Enforcement Team, Coastal Defense Brigade and the marine police workstation for the record. It is prohibited to moor in natural harbors that have been closed. Fishing vessels in the area to transfer the port of call, must be transferred to the port of transfer and transfer to the port management station to apply for the approval of the District Agricultural Administrative Law Enforcement Team before the transfer. New non-native fishing vessels coming to the district for berthing shall be examined and approved by the District Agricultural Administrative Law Enforcement Team and the number of new vessels shall be strictly controlled.

Article 11 The local fishing boats are still under the management of the local streets, and the streets and law enforcement departments will conduct safety inspections of fishing boats at least once a quarter at the port of call for the transfer of fishing boats. Transfer to the port of fishing boat production must be reported to the District Agricultural Administrative Law Enforcement Team, and comply with the management of the port of call.

Fishing vessels must choose a port of regular operation or the port of domicile of the vessel owner (operator) as a fixed port of call, and report it to the street of the place where they are anchored, the district agricultural administrative law enforcement team, and the Coastal Safety and Security Brigade for record.

Article 12 in the contracted waters to engage in aquaculture activities of units or individuals, must hold the contract, certificate of right to use the sea area, aquaculture license and other related materials to the Social Welfare Administration for registration and licensing. No registration and licensing procedures and non-region of the culture of fishing boats engaged in sea farming, guarding and other production and business activities, the law enforcement agencies will be dealt with according to the "three no" vessels.

Article 13 Non-native fishing vessels docking in the region must comply with the regulations of the region. Those who do not obey the management shall inform the law enforcement department of the place of ship's registration to recall them within a period of time. For violation of laws and regulations, the law enforcement department, in addition to the strict and maximum penalties in accordance with the law, shall order the suspension of navigation and production for 15-30 days for education and training. Laws and regulations provide otherwise, from its provisions.

Article 14 prohibits the use of no ship name and number, no ship certificate, no port of registry "three no" ships engaged in maritime activities. The law enforcement authorities shall confiscate and dismantle the "three nos" ships according to law.

Article 15: Fishing vessels are required to report their entry and exit from ports in accordance with regulations. Before entering or leaving the port, in addition to reporting in the APP system of "Fishing Port Pass" at the place of ship's registry, it is necessary to hold the ship's documents, crew certificates, insurance policies and so on to register for the entry and exit report at the management station of the fishing port where the fishing vessel is moored, and the vessel will be allowed to go out to sea for operation only after being inspected and verified.

Article 16: Fishing vessels operating at sea must comply with the conditions of navigation and observe the system of formation production. They should be equipped with full crews and safety equipment for life-saving, fire-fighting, communication and navigation according to the regulations, display the light and number according to the regulations, and abide by the rules of marine traffic and the management regulations on fishery safety.

Article 17 Fishing vessels are prohibited from operating in excess of wind level, navigation area, overloading and overcrowding; anchoring and operating in harbor pools, anchorages and channel waters; entering sensitive waters for operation, illegal cross-boundary fishing and engaging in illegal and criminal activities such as smuggling, stowaway, poaching, etc.; and engaging in activities that change the nature and use of operation, such as carrying passengers for tourism, angling and transportation. Any violation of the provisions of the law enforcement agencies from the strict top of the deal.

Article 18 of the provincial management of temporary license fishing boats, in accordance with the "natural attrition" principle, the reef, grounding, wind damage, wave damage and other causes of loss of fishing boats or not in accordance with the provisions of the application for inspection, do not apply for the new construction, renewal and reconstruction procedures, according to the law canceled! Ship documents.

Four shipowner crew management

Article 19 Owners and actual operators of fishing vessels must be fully manned with duty crews in accordance with the regulations, and must apply for fishery safety liability insurance for the crew in full, sign Labor Contracts in accordance with the law, and do a good job in daily safety education and training and management. The number of crew members shall not exceed the number authorized by the ship inspection certificate. Shall not employ the personnel who have not obtained the corresponding grade position certificate of duty crew and ordinary crew certificate to operate on board the ship. Any violation of the provisions of the Agricultural Law Enforcement Team to issue a notice of suspension, and tracking management in place.

Article 20 The duty crew must obtain the corresponding grade of the duty certificate, ordinary crew must obtain the crew certificate before they can operate on board. When crew members are working on the ship, they must wear life jackets, abide by the operation regulations, obey the command of the captain and take good personal protection. Must comply with laws and regulations and fisheries safety production management provisions.

Article 21 The owner and actual operator of a fishing vessel shall, before March 30 and August 30 of each year, go to the management station of the port of call with the crew certificate to apply for the registration of crew information. If the registration is not done, the Agricultural Law Enforcement Team shall issue a notice of suspension and prohibit the operation at sea.

V Law Enforcement and Supervision

Article 22 The District Agricultural Administrative Law Enforcement Team, the Coastal Safety and Security Brigade, the Marine Police and other law enforcement departments shall establish and improve the law enforcement and inspection system. In accordance with their respective division of responsibilities, regularly organize and carry out sea and land law enforcement inspections, the formation of a crackdown posture. Article 23 The market supervision, fishing vessel inspection and other departments in accordance with their respective responsibilities, to strengthen the supervision and inspection of ship repair and shipbuilding yards, prohibit the construction, repair of fishing vessels without approval procedures, and prohibit the provision of maintenance services for the "three noes" ships.

Article 24 The district discipline inspection and supervision departments of the fishery safety management work dereliction of duty, supervision and ineffective, resulting in the jurisdiction of the fishing boat production safety accidents occurring in the units and individuals, serious pursuit of responsibility and accountability.
