A number of policy measures to promote the development and growth of the private economy

To fully implement the "Opinions of the Central Committee of the Communist Party of China and the State Council on Promoting the Development and Growth of the Private Economy" and the "Several Measures of the Jiangsu Provincial Committee of the Communist Party of China and the Jiangsu Provincial People’s Government on Promoting the Development and Growth of the Private Economy," continuously improve the institutional mechanisms for serving the development of the private economy, and stimulate the private economy’s internal momentum and innovative vitality, the following policy measures are formulated in light of our city’s actual conditions.

I. Maintaining a Fair and Competitive Market Environment

(1) Facilitating Market Entry and Operations for Private Enterprises. Strictly implement the national “single list” management model and adhere to the principle of “access unless prohibited,” ensuring that private enterprises can enter industries and sectors outside the negative list on an equal footing in accordance with the law. For industries, sectors, and businesses outside the market access negative list that are not explicitly prohibited by laws and regulations, no additional entry barriers shall be imposed on private investment entities.We will continue to conduct evaluations of market access efficiency, establish a complaint and response mechanism for market access barriers, and improve the system for compiling and disseminating typical cases. We will deepen the “individual-to-enterprise” reform, allowing individual businesses to directly register as enterprises without prior deregistration. The Unified Social Credit Code, registration records, and annual report disclosure information will remain consistent before and after the transition, and eligible administrative permits in market supervision areas may be extended and transferred.Explore and advance the “One Industry, One License” reform, promoting integrated “one-stop” processing of business-related operations by industry. Establish “No-Certificate Service Halls,” actively implement the notification and commitment system, publish the “Yangzhou List of Shared Electronic Certificates,” and promote “certificate-free services” and “one-code access.”[Responsible Units: Municipal Development and Reform Commission, Municipal Commerce Bureau, Municipal Government Affairs Office, Municipal Market Regulation Bureau, etc.; People’s Governments of all counties (cities, districts); and the Administrative Committees of the Economic and Technological Development Zone, Eco-Technology New City, and Shugang-Slender West Lake Scenic Area, each according to their respective responsibilities. (2) Implement the fair competition review system. Adhere to the principle of treating enterprises of all ownership types equally and without discrimination; promptly review and abolish policy measures that contain elements of local protectionism, market segmentation, or designated transactions, which hinder the unified market and fair competition.No operator shall be granted a franchise without undergoing a fair competition review, nor shall there be any requirement to operate, purchase, or use goods and services provided by specific operators. In key industries and sectors such as transportation, engineering construction, government procurement, and bidding and tendering, special law enforcement campaigns shall be conducted to address the abuse of administrative power to exclude or restrict competition and to combat unfair competition. (3) Eliminate “hidden barriers” in the bidding and tendering sector. Ensure that private enterprises enjoy equal standing in participating in public resource transactions such as government procurement and bidding and tendering. Formulate and improve the “Guidance Checklist for the Preparation of Government Procurement Documents” and the “List of Prohibited Conduct in Bidding and Tendering,” strictly enforce the “Rules for Fair Competition Review in the Bidding and Tendering Sector,” carry out special rectification efforts in the construction sector’s bidding and tendering processes, standardize the application of credit evaluations in the bidding and tendering sector, and vigorously foster a fair, just, standardized, efficient, and transparent market environment for bidding and tendering.(Responsible Units: Municipal Development and Reform Commission, Municipal Finance Bureau, Municipal Housing and Urban-Rural Development Bureau, Municipal Transportation Bureau, Municipal Water Resources Bureau, Municipal Agriculture and Rural Affairs Bureau, Municipal State-owned Assets Supervision and Administration Commission, Municipal Government Affairs Office, Municipal Market Regulation Bureau, and other relevant departments, each according to their respective responsibilities)

(4) Improve the incentive mechanism for corporate integrity. Deepen the implementation of the “Credit + Commitment” tiered approval pilot program and comprehensively expand the scope of application for corporate credit commitment letters to replace bid bonds. Improve the “one-stop online service and cross-platform coordination” mechanism for credit repair, implement the new “Integrity Education + Commitment” credit repair model, and organize more than 1,000 participants annually to attend public-interest credit repair training.Strengthen the application of credit-based services that benefit the public and facilitate business operations, and strive to create more “Credit-Plus” scenarios in areas such as “Credit-Easy Loans,” “Credit-Easy Approvals,” “Credit-Easy Healthcare,” “Credit-Easy Tourism,” and “Credit-Easy Insurance.”(Responsible Units: The Municipal Development and Reform Commission, Municipal Government Affairs Office, Municipal Housing and Urban-Rural Development Bureau, Municipal Transportation Bureau, Municipal Water Resources Bureau, Municipal Agriculture and Rural Affairs Bureau, Municipal Culture, Radio, Television, and Tourism Bureau, Municipal Market Regulation Bureau, Municipal Local Financial Regulatory Bureau, People’s Bank of China Yangzhou Branch, Yangzhou Regulatory Sub-bureau of the National Financial Regulatory Administration, Municipal Big Data Management Center, Municipal Big Data Group, and other relevant departments shall assume responsibility in accordance with their respective duties)

II. Optimizing the Investment Environment for Private Capital

(5) Expand the scope of private investment.Issue guidelines encouraging private investment in sectors such as transportation, water conservancy, clean energy, new infrastructure, advanced manufacturing, agriculture and rural development, municipal services, environmental protection, healthcare, and elderly care, clarifying methods and pathways, and ensuring effective dissemination and interpretation. Regularly compile and update lists of major national projects, projects addressing shortcomings, key industrial and supply chain projects, and concession projects based entirely on user fees that are open to private capital. (6) Support Participation in Major Project Construction. Encourage private enterprises to participate in new (including renovation and expansion) projects under public-private partnerships (PPPs). Establish a database of key private investment projects, improve the efficiency of approval services for major projects, strengthen the provision of essential resources such as forest land use, cultural relics surveys, energy, and environmental support, intensify follow-up services, and promptly coordinate to resolve difficulties and issues encountered during project implementation. Systematically and specifically ensure the provision of supporting infrastructure for major projects, including water, electricity, gas, and sewage treatment.(Responsible Units: Municipal Development and Reform Commission, Municipal Industry and Information Technology Bureau, Municipal Government Affairs Office, and other relevant departments, in accordance with their respective responsibilities)

(7) Support the Expansion of International Markets. Implement the municipal government’s policies to stabilize the scale and optimize the structure of foreign trade. Encourage and support private enterprises to participate in overseas in-person trade fairs, and provide subsidies for expenses such as booth fees, shipping costs for large exhibits, and business travel expenses.Organize participation in key domestic and international exhibitions such as the Canton Fair, China International Fair for Trade in Services, and the Osaka Trade Fair, and make every effort to secure orders. Guide and assist private enterprises in transitioning to cross-border e-commerce models, support the establishment of public overseas warehouses by private enterprises, actively foster local private multinational companies, and participate in the joint construction of the “Belt and Road” initiative. Support private enterprises in managing exchange rate risks and expand the scale and coverage of foreign exchange hedging for private enterprises.Encourage banking institutions to include more private enterprises in pilot programs for trade foreign exchange receipts and payments facilitation, and to provide capital account income payment facilitation services to a greater number of private enterprises. Support high-tech and “specialized, refined, distinctive, and innovative” private enterprises in conducting cross-border financing facilitation pilots to enhance new trade formats and models. Strive to have more high-quality enterprises included in the “whitelist” for APEC Business Travel Card applications, establish “specialized foreign affairs service windows,” assign dedicated personnel to handle applications, and improve the efficiency of card approval.(Responsible Units: Municipal Bureau of Commerce, Municipal Development and Reform Commission, Municipal Foreign Affairs Office, Yangzhou Branch of the People’s Bank of China, Yangzhou Regulatory Bureau of the National Financial Regulatory Administration, and other relevant departments, to be responsible according to their respective duties)

III. Supporting the Transformation and Upgrading of Private Enterprises

(8) Cultivate and Strengthen Market Entities. Expand the ranks of “Specialized, Refined, Unique, and Innovative” enterprises and support high-quality private enterprises in integrating into the supply chain systems of central state-owned enterprises, local state-owned enterprises, and industry leaders. By 2025, the number of “Specialized, Refined, Unique, and Innovative” enterprises at the provincial level or above will exceed 600. Encourage high-quality enterprises to pursue vertical integration and shareholding restructuring for listing. Cultivate more enterprises to rank among the Top 500 Private Enterprises in China and the Top 200 Private Enterprises in Jiangsu.Establish a cultivation pool for “individual businesses transitioning to enterprises,” provide guidance for “enterprises transitioning to standardized operations,” implement enterprise cultivation incentive policies, and promote steady growth in the number of private enterprises meeting the “four criteria” (annual revenue, number of employees, asset size, and operating scale). (9) Support enterprise technological innovation. Guide private technology-based enterprises to increase R&D investment and strengthen the cultivation and management of intellectual property, thereby expanding the ranks of private technology-based small and medium-sized enterprises (SMEs) and high-tech enterprises. In principle, the proportion of municipal forward-looking key R&D programs and municipal science and technology achievement transformation projects organized and implemented with the participation of private enterprises shall not be less than 60%.Increase the openness of scientific research infrastructure, large-scale scientific instruments, and basic patent information resources to private enterprises. Support the upgrading of private enterprise R&D institutions and promote the opening of more critical application scenarios and large enterprise supply chains to private entities. Support private enterprises in partnering with universities, research institutes, and upstream and downstream enterprises to form innovation consortia. Encourage private enterprises to establish technology innovation centers, proof-of-concept centers, and new types of R&D institutions, as well as to build pilot production bases for the transformation of scientific and technological achievements.Encourage eligible private enterprises to issue science and technology innovation corporate bonds. Make full use of incentive policies allowing fiscal budget units to directly procure products on the designated procurement list, and support the first purchase, first trial, and initial batch application of innovative products from private enterprises. By 2025, the number of private high-tech enterprises will exceed 2,500. (10) Support Enterprise Transformation and Upgrading. Focusing on the “613” industrial system, support private enterprises in joining the provincial “Peak Building and Chain Strengthening” enterprise cultivation and support program, and participate in efforts to strengthen, supplement, and extend industrial chains. Deepen the integrated development of the digital and real economies, accelerate the application of digital technologies, and promote the digital transformation of manufacturing. Support private enterprises in implementing projects for intelligent transformation, digital upgrading, and network connectivity, and organize activities such as on-site observation and training, scenario analysis, and case sharing on a categorized basis.By 2025, establish 160 provincial-level or higher smart manufacturing benchmark demonstration sites and 2,500 provincial-level star-rated cloud-based enterprises. Increase support for private enterprises in technological upgrades at key links of industrial chains and in tackling core technological challenges; implement 100 key industrial common technology R&D projects annually to help private enterprises overcome major bottlenecks and “chokepoint” technologies constraining industrial development.Strengthen quality management and standardization efforts in private enterprises. Advance the quality management system certification enhancement initiative for small and micro enterprises. Conduct quality benchmark enterprise training for more than 300 private enterprises annually, provide quality management system certification training for more than 1,000 small and micro enterprises, and provide targeted assistance to 100 small and micro enterprises to improve their certification management capabilities. IV. Strengthening Support for Key Resources in the Private Economy

(11) Increase fiscal, tax, and financial support for enterprises. Implement the tax and fee preferential policies extended, optimized, and improved by the central and provincial governments; continue to carry out the “Spring Rain Nurturing Seedlings” special campaign; promote the “online availability and full online processing” of tax-related matters, maintaining a “contactless” processing rate of over 95%. Increase the support from municipal-level special fiscal funds for private enterprises; in sectors such as advanced manufacturing, modern services, and commerce and logistics, ensure that the proportion of awards and subsidies allocated to private enterprises is over 80%.Increase support for private enterprises through municipal industrial investment funds and the Inclusive Finance Development Risk Compensation Fund. Municipal industrial investment funds should prioritize investments in private enterprises; the proportion of loans to private enterprises under government-bank (guarantee) cooperation products such as “Sukedao,” “Xiaoweidao,” “Huanbaodao,” and “Fumindao” should exceed 80%; and the proportion of financing guarantee business for private enterprises handled by government-backed financing guarantee institutions should exceed 80%.Fully leverage the incentive role of monetary policy tools such as re-lending, rediscounting, and inclusive micro and small enterprise loan support instruments, striving to ensure that the proportion of central bank funds supporting private enterprises exceeds 70%. Encourage financial institutions to innovate financial products and service models based on the needs of private enterprises, accelerate the development of innovative pledge financing businesses involving intellectual property, equity, warehouse receipts, orders, and accounts receivable, and promote credit-based financing facilitation products such as “Micro Enterprise Easy Loan” and “Water Rights Loan.”(Responsible Units: The Municipal Finance Bureau, the Municipal Local Financial Regulatory Bureau, the Municipal Taxation Bureau, the Yangzhou Branch of the People’s Bank of China, the Yangzhou Regulatory Sub-bureau of the National Financial Regulatory Administration, the Municipal Big Data Group, the Municipal State-owned Capital Group, and other relevant departments shall assume responsibility in accordance with their respective duties)

(12) Strengthen land use service guarantees. Improve the secondary market for the transfer, lease, and mortgage of construction land use rights to revitalize existing land resources. Launch a comprehensive industrial land renewal initiative to guide private investment projects to prioritize the use of existing land, with the aim of ensuring that private investment projects account for more than 70% of land use.Continue to advance the “standard land + dual-credit land + customized land” supply model for industrial land. No additional land transfer fees will be levied for projects that increase land utilization rates and floor area ratios through methods such as adding stories to existing factory buildings, demolition and reconstruction, renovation of old factories, or internal reorganization. Private enterprises may use irrevocable, unconditional on-demand payment guarantees to substitute for the payment of bid security deposits. Implement the “two-in-one verification” system for planning verification and land verification of industrial enterprise projects.(Responsible Units: Municipal Bureau of Natural Resources and Planning, Municipal Development and Reform Commission, and other relevant departments, to be responsible according to their respective duties)

(13) Strengthen support for talent recruitment and employment. Focusing on the “613” industrial system, compile a talent demand handbook and a talent recruitment map for enterprises to support private enterprises in attracting key talent for innovation and creation. For high-level talent recruited by private enterprises on a full-time, high-salary basis, actively recommend them for application to the municipal “Green Yang Golden Phoenix Plan,” the provincial “Mass Entrepreneurship and Innovation Plan,” and national talent programs, and support private enterprises in cultivating postgraduate students.Establish a “green channel” for outstanding private-sector talent to apply for intermediate professional titles. Eligible private enterprises may apply to establish professional title evaluation committees to conduct independent evaluations. Strengthen industry-education integration, optimize the direction and curriculum of vocational education, and cultivate more than 800 new-style enterprise apprentices annually through the “integrated work-study, dual-instructor” model. Encourage private enterprises to collaborate with vocational (technical) schools to conduct “order-based” skilled talent training, providing financial support in accordance with regulations.(Responsible Units: The Municipal Party Committee Talent Office, Municipal Education Bureau, Municipal Human Resources and Social Security Bureau, Municipal Science and Technology Bureau, and other relevant departments shall assume responsibility in accordance with their respective duties)

(14) Strengthen the Guarantee of Resources and Factors. Support private enterprises in developing and utilizing renewable energy, fully leverage the policy of “excluding renewable energy from energy consumption quotas,” provide follow-up services for tracking energy assessment approvals of projects submitted to the provincial level, and optimize the energy assessment approval process for municipal projects. Ensure that the proportion of newly added energy consumption quotas allocated to private investment projects each year matches the proportion of private investment in total social investment, with a minimum of 70% in principle. Establish a reserve pool for total pollutant discharge quotas and fully implement the pollutant discharge rights trading mechanism.Comprehensively implement the linkage between environmental impact assessments for industrial park planning and those for construction projects; actively seek to pilot the “joint processing of two permits”—namely, environmental impact assessments for construction projects and enterprise pollutant discharge permits; advance the “Green Island” project construction for small and medium-sized private enterprises; deepen integrated pollution control to reduce enterprises’ pollution control costs; and support private enterprises in implementing green transformation projects and building green factories. V. Safeguarding the Legitimate Rights and Interests of Private Enterprises

(15) Protect the property rights of private enterprises. Improve mechanisms for the filing and review of economic crime cases, as well as for law enforcement and judicial oversight. Routinely conduct clean-up efforts to resolve “pending cases,” and resolutely prevent the use of criminal means to interfere in economic disputes. Implement specific measures by disciplinary inspection and supervision agencies to safeguard the development and growth of the private economy. Adopt a development-oriented perspective, correctly apply policies and strategies, and handle cases involving private enterprises with a balanced approach of leniency and strictness, while exercising strict and prudent use of investigative measures.Launch special campaigns such as “Cracking Down on Fraud and Extortion,” and crack down in accordance with the law on “online trolls” and “black industrial chains” that deliberately hype up, spread rumors, and smear private enterprises and private entrepreneurs.Deepen compliance reforms for enterprises involved in cases, promoting the application of these reforms throughout the entire process of investigation, prosecution, and trial. Deepen the reform of integrating enforcement and bankruptcy proceedings, improve mechanisms for identifying the value of enterprise reorganization, advance the construction of the “Smart Bankruptcy Platform,” and actively rescue viable enterprises. (16) Strengthen intellectual property protection. Implement the principle of the strictest judicial protection of intellectual property rights, accurately apply punitive damages for intellectual property infringement, and severely crack down on criminal offenses involving the infringement of private enterprises’ intellectual property rights and trade secrets in accordance with the law.Advance the classification of intellectual property civil cases based on complexity, leverage the institutional advantages of the single-judge second-instance trial system and the small claims procedure in grassroots courts to enhance the efficiency of intellectual property rights protection, and actively explore public interest litigation in intellectual property matters. Implement the “four-pronged investigation” approach for intellectual property cases, simultaneously examining whether circumstances warrant criminal prosecution, civil liability, administrative violations, or public interest litigation. Accelerate the application and construction of a national-level intellectual property protection center, striving to secure approval for its construction and operation by 2024.Strengthen support for private enterprises in protecting their rights, providing consultation and guidance on intellectual property laws and regulations, dispute resolution, and litigation. Intensify efforts to protect intellectual property rights overseas, strengthen risk prevention and control regarding overseas intellectual property, conduct training on overseas intellectual property systems and related operational procedures, and improve the mechanism for assisting enterprises in protecting their intellectual property rights abroad. (17) Optimize regulatory and law enforcement methods. Launch a three-year campaign to improve the quality of administrative law enforcement, and comprehensively promote strict, standardized, fair, and civilized law enforcement. Implement the principle of “one visit, multiple inspections,” identify cross-departmental and cross-sectoral law enforcement and regulatory matters, and advance integrated regulatory oversight.Comprehensively advance cross-departmental “double-random” supervision, with more than 80% of departments citywide participating in or conducting cross-departmental joint inspections. Implement tolerant and prudent regulation, improve the “three lists” for exemption from penalties, light penalties, and reduced penalties, as well as the benchmarks for administrative penalty discretion, and strengthen their enforcement. (18) Regularly clear overdue payments. Establish and improve long-term mechanisms for preventing and resolving overdue payments to enterprises, including information sharing, reminders and follow-ups, and joint disciplinary actions. Carry out a cleanup of overdue payments to enterprises by government agencies, public institutions, and state-owned enterprises. Intensify inspections, audits, and supervision regarding overdue payments to enterprises, and establish records of government and social capital cooperation (PPP), investment promotion, and government procurement-related breaches of trust and contractual obligations.Improve the information exchange and sharing mechanism for enforcement cases involving Party and government organs, and routinely conduct clean-up efforts for such cases. Ensure 100% enforcement of cases where assets are available for execution, and ensure that 100% of cases where no assets are currently available for execution are incorporated into the budgets of relevant departments.Guide private enterprises to standardize employment practices and encourage workers to exercise their rights rationally. Comprehensive measures, including administrative law enforcement, criminal justice, and credit-based sanctions, will be employed to crack down on illegal wage arrears and illegal acts of fabricating false facts or using unlawful means to collect wages from migrant workers.(Responsible Units: The Municipal Bureau of Industry and Information Technology, the Municipal Party Committee Inspection Office, the Municipal Court, the Municipal Public Security Bureau, the Municipal Finance Bureau, the Municipal Human Resources and Social Security Bureau, the Municipal Audit Bureau, the Municipal State-owned Assets Supervision and Administration Commission, the Municipal Market Regulation Bureau, and other relevant departments shall assume responsibility in accordance with their respective duties)

(19) Standardize the management of enterprise-related charges. Publish the “three lists” of enterprise-related administrative and public service charges, government funds, and government-priced business service charges. Regularly publish, inspect, and evaluate enterprise-related charges.No new administrative and public service charges or government-priced business service charges related to enterprises may be established outside of these lists. Fee standards may not be adjusted without soliciting opinions from enterprises and the public, and relevant fees may not be collected unless publicly displayed at collection sites and on the websites of the collecting units. Establish unobstructed channels for reporting and filing complaints regarding illegal charges related to enterprises, and establish a mechanism for inter-departmental sharing and referral of leads on violations.Strictly enforce the “zero investment” policy for water, electricity, and gas connections for users outside building boundaries; reasonably guide retail prices for industrial and commercial gas; and conduct special inspections of water, electricity, gas, and telecommunications prices.
