In order to standardize the division of property rights and real estate registration of small and micro parks, according to the "Hunan Province to accelerate the market-oriented construction and operation of industrial parks, a number of policies" (Hunan Development and Reform Area 〔2020〕 No. 495), "industrial production and non-production of housing can be referenced to the relevant policies of the commercial housing for the transfer of real estate right Registration" and "Changsha Economic and Technological Development Zone on accelerating the construction of small and micro parks to improve the mu efficiency of the implementation of the measures" (Changjingkai Management Development [2022] No. 6) relevant requirements, the development of the implementation of the rules.

Article 1 【Scope of Application】 These rules are applicable to the division of property rights, real estate registration and related work of the small and micro parks whose construction has been considered and agreed by the meeting of the directors of Changsha Economic and Technological Development Zone Management Committee.

Article 2 【Requirements for property rights division】 Small and micro-industrial park industrial production buildings can be divided according to the building, natural layer, and household number under the condition that the public parts are clear and the independent use of the house is satisfied, of which the minimum division unit of single-story standard plant is not less than 1,000 square meters, and the minimum division unit of multilayer standard plant is not less than 300 square meters (before the implementation rules were introduced, the minimum division unit of standard plant was not less than 1,000 square meters). 300 square meters (if the contract signed before the introduction of the implementation rules is inconsistent with the provisions of this article, it shall be implemented according to the original contract). Administrative office and living service facilities, garages and parking spaces shall not be divided and transferred. Public facilities such as power distribution, roads, greening, etc. in the small and micro park shall not be divided and registered property rights, and belong to all owners. The construction and operation unit of the micro park must own more than 35% of the total building area.

Article 3 【Requirements for the use of life】 The construction and operation of small and micro parks can be divided before the property rights in accordance with the provisions of the extension of the land use procedures. The expiration of the life of the need to continue to use the land, the small and micro park real estate rights jointly applied for renewal in accordance with the relevant provisions.

Article 4 [Approval of Self-Holding and Dividing Program] Before handling the division of property rights of small and micro parks, the construction and operation units of small and micro parks shall submit the overall self-holding and dividing program of the project, specify the number of self-holding houses, the number of households and the area of the house (based on the projected or measured area of the report), and attach the dividing diagram, and submit it to the Administrative Approval Service Bureau for approval. The plan shall be submitted to the Administrative Approval Service Bureau for finalization in consultation with the relevant departments. Batch completion and acceptance and property rights division of the project, in accordance with the provisions of the self-holding proportion of phased control of the self-holding area, and allow the later batch of replacement adjustments.

Article 5 【Operation Program Approval】 Before the micro-park is put into use, the micro-park construction and operation unit shall report the micro-park required project investment, business services and other programs to the Economic Cooperation Bureau for approval, and the production safety management program to the Business Environment Bureau for approval.

Article 6 【Maintenance Fund Deposit】 Before the completion and acceptance of the micro-park, the construction and operation unit of the micro-park shall go to the Changsha County Housing and Urban-Rural Development Bureau to approve the standard of the maintenance fund and deposit the maintenance fund into the special account of the special maintenance fund for the property.

Article 7 [First Registration] After the completion and acceptance of the small and micro park, the construction and operation unit of the small and micro park shall go to the Changsha County Natural Resources Bureau to apply for the first registration of the real estate (building certificate) with the materials such as the land ownership, the acceptance of the completion of the building and the real estate surveying and mapping.

Article 8 【Internet-controlled housing】 If the industrial production houses in small and micro parks need to be sold with reference to the relevant policies on commercial housing, the construction and operation units of small and micro parks shall hold the qualification certificate of real estate development enterprises, the validated filing form for the investment of projects of the enterprises in the small and micro parks, the self-holding and splitting plan and the certificate of real estate right (building certificate) to the Changsha County Housing and Urban-Rural Development Bureau for real estate transaction entry procedures and self-holding property control.

Article 9 [Project Pre-approval] Small and micro park houses shall not be rented or sold to individuals. Enterprises leasing small micro park housing, can only be used for their own production and operation, may not be sublet. Small and micro park industrial production housing property rights after the split, may not be rented out on their own. Before the construction and operation unit of the micro park signs the lease and sale contract (including the lease and sale of industrial production houses with divided property rights) and the lease contract for production and living service facilities with the introduced enterprise, it shall report the basic situation of the proposed enterprise to the Economic Cooperation Bureau, and the Economic Cooperation Bureau shall organize the Industrial Development Bureau, the Administration and Approval Service Bureau, the Emergency Management Bureau of Changsha County, and the local streets, etc., and make an assessment of the project to see if it meets the industrial orientation of the micro park, and whether it is in line with the industrial development of the micro park, and whether it meets the requirements of the industry. The pre-approval of small and micro park projects in Xingsha Industrial Base is carried out by Xingsha Industrial Base Affairs Center with reference to the above requirements. Enterprises can purchase or lease houses in the micro park and move in only after the pre-approval. Without the pre-approval of the small and micro park without authorization, the construction and operation unit shall be dismissed, and the enterprises can not enjoy any policy support of Changsha Economic and Technological Development Zone.

Article 10 【Division of Property Rights】 When the industrial production houses in the Small and Micro Park are sold, the construction and operation unit of the Small and Micro Park shall make a net signature for record in accordance with the regulations of the Changsha County Housing and Urban-Rural Development Bureau and sign the "Changsha County Commodity Property Sale and Purchase Contract" (with the item labeled "Small and Micro Park" and the restriction on re-transfer). " item and the restriction clause on re-transfer). When registering the transfer of houses in small and micro parks, the Real Estate Registration Center of Changsha County Natural Resources Bureau shall verify the project pre-approval opinions, the sale and purchase contract and tax payment certificates, and apply for the certificate of real estate rights (for projects labeled as "small and micro parks", the transfer within 5 years shall be subject to the consent of the Management Committee of Changsha Economic and Technological Development Zone). Among them, the real estate right certificate of self-owned property is labeled with the words "self-owned property in small and micro parks shall not be transferred".

Article 11 [Restrictions on Secondary Transfer] After the property rights of industrial production buildings in small and micro parks are divided, they shall not be transferred within 5 years from the date of real estate registration; if they need to be transferred due to objective reasons such as enterprise development or company cancellation, they shall be transferred only with the consent of Changsha Economic and Technological Cooperation Bureau after the Bureau's prequalification and report to Changsha Economic and Technological Development Zone Administrative Committee. In case of transfer of industrial production buildings, priority will be given to the repurchase by the construction and operation unit of the micro- and small-sized parks, or to the enterprises that have been pre-approved and agreed to be admitted by the project. The Natural Resources Bureau of Changsha County shall not apply for real estate right certificates in case of unauthorized transfer without pre-approval of the project. The household rooms shall not be subdivided again in the second transfer.

Article 12 [Supplementary Provisions] These Rules shall come into force on the date of issuance and shall be interpreted by the Administrative Approval Service Bureau in consultation with the relevant departments.
