Gansu Province 2022 Deepening the Reform of "Putting in Control and Serving" and Optimizing the Business Environment Work Points

To earnestly implement the decisions and arrangements of the Central Committee of the Communist Party of China and the State Council regarding deepening the reform of “delegating power, improving regulation, and upgrading services” and optimizing the business environment, and to comprehensively advance the province’s efforts in this regard for 2022, the following key tasks are proposed in accordance with the arrangements of the Provincial Party Committee and the Provincial Government.

I. General Requirements

Guided by Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, we will thoroughly implement the spirit of the 19th National Congress of the Communist Party of China and its subsequent plenary sessions, as well as General Secretary Xi Jinping’s important speeches and instructions regarding Gansu. Adhering to a people-centered development philosophy, we will accelerate the transformation of government functions, deepen the “streamlining administration, delegating power, and improving regulation and services” reform,continuously optimize the business environment, comprehensively promote the integrated development of the "Delegation, Regulation, and Service" reform and digital government construction, focus on enhancing the standardization, normalization, and convenience of government services, accelerate the creation of a market-oriented, rule-of-law-based, and internationalized business environment, further stimulate the vitality of market entities, and enhance the sense of gain and satisfaction among enterprises and the public, thereby empowering and enhancing the high-quality development of the economy and society.

II. Key Tasks

(1) Continuously Deepen Administrative Streamlining and Delegation of Powers. Solidly advance the implementation of key tasks such as the list-based management of administrative licensing items and the “separation of business licenses and operating permits” reform; deepen reforms in areas such as investment approval and construction project approval; and further remove hidden barriers to market entry.

1. Promote the management of administrative licensing item lists. In accordance with the unified deployment of the General Office of the State Council, carry out the compilation and publication of the basic list of administrative licenses, implementation guidelines, and procedural manuals to clarify the boundaries of administrative licensing authority and standardize the operation of administrative licensing. Organize the compilation and publication of administrative licensing item lists at the provincial, municipal, and county levels, ensuring that all administrative licensing items established in accordance with the law are included in list-based management. Ensure that procedures are open and transparent, and that no administrative licenses may be established or implemented unlawfully outside of these lists.Organize relevant cities (prefectures) and provincial departments to compile and publish, on a case-by-case basis, implementation guidelines and procedural manuals for administrative licensing items established by provincial local regulations and provincial government rules. 2. Fully implement the management of the market access negative list. 3. Deepen reforms of the approval system in the investment and construction sector. Further optimize and standardize approval procedures, items, and application materials. Implement the credit commitment system for enterprise investment and construction projects, improve the “one-stop online” approval service platform for investment and construction projects, and promote “single-map” and visualized approvals. Promote the integration of the engineering construction project approval management system with the business systems of relevant provincial departments, optimize the full-process online approval of engineering construction projects, strengthen supervision of intermediary agencies, and enhance approval efficiency.Lanzhou City will take the lead in piloting initiatives to optimize and restructure the approval process for construction projects, thereby establishing replicable and scalable best practices. 4. Deepen the “Separation of Business Licenses and Operating Permits” Reform. In accordance with the Provincial Government General Office’s “Implementation Plan for Deepening the ‘Separation of Business Licenses and Operating Permits’ Reform to Further Stimulate the Vitality of Market Entities,” conduct a comprehensive self-inspection, focusing on whether there are instances of retained or disguised approvals for items directly abolished; verify whether provincial competent authorities have formulated specific filing requirements, procedural guidelines, operational standards, and processes for items converted from approval to filing, and whether these have been made public;Verify whether, for matters subject to the notification and commitment system, provincial-level competent authorities have formulated and published the “Model Text for the Notification and Commitment System” and are implementing the notification and commitment process as required; verify whether the requirements for list-based processing have been implemented for optimized approval service items; verify whether the department’s administrative licensing business system has been integrated with the “Gansu Provincial Interdepartmental Collaborative Supervision Platform” to enable automatic data push; and verify whether enterprise registration data pushed by market regulation departments has been promptly received, processed, and made public.Complete the self-inspection by the end of May and rectify any issues identified by the end of June. 5. Continue to implement the notification and commitment system. Orderly advance the implementation of the “Gansu Provincial Measures for the Implementation of the Notification and Commitment System for Government Service Matters,” with a focus on promoting the notification and commitment system in areas such as business operation permits, certification requirements, and investment project approvals. (2) Accelerate the development of a digital government. With a firm focus on the goal of “leading in central and western China and ranking among the best in the country,” we will accelerate the construction of digital government projects, data sharing, and deepened applications. We will comprehensively improve the rate of “fully online processing” and the capability for “one-stop online services,” promote “mobile processing” and “finger-tip processing,” and ensure that enterprises and the public enjoy tangible digital dividends.

6. Advance Project Implementation. Make every effort to advance digital government project construction and ensure stable operation. Strengthen the development of the integrated government service platform, ensure that all government service items are made available online, and standardize online service guidelines. In accordance with the principles of “all that should be included must be included, all that should be included must be fully included, and all that should be included must be included promptly,” carry out data integration, migration, aggregation, and sharing. Improve the functionality of the government cloud management platform. 7. Deepen specialized applications. 8. Promote the operationalization of the Digital Government Operations Command Center. Fully leverage the functions of the Digital Government Operations Command Center to strengthen data monitoring and reporting on the work of local governments and departments in advancing government services and optimizing the business environment, and promote the realization of “a single screen to view the entire province, one-click access to government services.” (Lead Agency: Provincial Big Data Center; Responsible Agencies: Municipal and Prefectural Governments, Lanzhou New Area Administrative Committee, Relevant Provincial Departments, and Relevant Central Government Units in Gansu)

9. Advance the construction of the electronic certificate repository. Accelerate the expansion of the application scope of electronic certificates and their mutual recognition nationwide; establish a basic integrated electronic certificate sharing service system for the provincial government service platform; promote the widespread use of electronic seals, electronic signatures, and electronic contracts in government service sectors such as social security, healthcare, education, and employment; and promote “document-free” services.(Lead Agency: Provincial Big Data Center; Responsible Agencies: Municipal and Prefectural Governments, Lanzhou New Area Administrative Committee, Relevant Provincial Departments, and Relevant Central Government Units in Gansu)

10. Improve institutional frameworks and standards. Compile and formulate institutional mechanisms and standards for data sharing in digital government construction, government cloud management, and distinctive brands. Organize and carry out preliminary research on the “Data Management Regulations.” Relevant departments shall formulate standards and norms for industry data management. (III) Stimulate the Vitality of Market Entities. Continue to promote the optimization and upgrading of the business environment, uphold the service philosophy of “enterprises bring capital and projects, and we handle the rest,” closely monitor key aspects affecting the survival and development of market entities, and focus on fostering and stimulating their vitality.

11. Optimize the functions of the “One-Stop Online Service” platform for business establishment (and deregistration). Improve the fully electronic registration system to achieve online “one-stop” and offline “single-window” processing for business establishment across the province. 12. Accelerate the implementation of investment promotion projects. Continue to implement “concierge-style” services for major investment promotion projects. For provincial-level major investment promotion projects recognized by the Provincial Investment Promotion Leading Group, establish a three-tiered leadership oversight mechanism at the provincial, municipal, and county levels. Implement supportive policies such as land supply, fiscal incentives and subsidies, and factor guarantees to fully advance project implementation and construction. 14. Increase fiscal and financial support. Make full use of the inclusive micro and small enterprise loan support tool and increase re-lending for agriculture and small businesses. Continue to provide financing support to enterprises in industries severely affected by the pandemic. Promote the sharing of enterprise credit information, accelerate the interconnection of information between tax, customs, and power authorities and financial institutions, strengthen the development of government-backed financing guarantee systems, and increase the allocation of special loans for small, medium, and micro enterprises.Deepen interaction among government, banks, and enterprises. Relying on the provincial credit platform website and the “Gansu Credit-Easy Loan” platform, build a province-wide integrated financing and credit service platform network to enhance the level of financial services to the real economy. Fully launch and operate the full-process electronic public resource trading system to complete the entire public resource trading process in the form of electronic data. Deepen the construction and routine operation of the province-wide remote, cross-regional bid evaluation system to promote the cross-regional and cross-industry sharing of high-quality expert resources. Establish an electronic archive system for public resource trading. 16. Assist market entities in overcoming difficulties. Make full use of the combined policy measures of “reductions, exemptions, deferrals, refunds, and subsidies,” providing preferential support to industries severely affected by the pandemic. Encourage support for small, medium, and micro enterprises in the form of reductions or exemptions on rent and utility fees (including water, electricity, gas, heating, and telecommunications). Conduct a special campaign to address illegal charges imposed on enterprises. (IV) Strengthen in-process and post-event supervision. Strictly implement the supervisory responsibilities of industry authorities, relevant departments, and local governments, and accelerate the establishment of a comprehensive, multi-level, and multi-dimensional regulatory system.

17. Promote full-chain, all-domain supervision of administrative licensing matters. In accordance with the principle of “whoever approves, supervises; whoever oversees, supervises,” formulate and publish supervision rules and standards for administrative licensing matters established by local regulations and provincial government rules.For items included in the administrative licensing lists at the corresponding levels, scientifically classify risk levels, identify key regulatory points, and implement targeted, differentiated regulatory policies; for administrative licensing items that have been abolished or delegated, simultaneously implement regulatory responsibilities and clarify the regulatory levels, departments, and measures. 18. Strengthen “Internet Plus Regulation.” Enhance the functional capabilities of platforms for investment project approval supervision and construction project approval. 19. Strengthen credit-based tiered and categorized supervision and adopt a tolerant and prudent regulatory approach. Relying on the provincial social credit information platform, conduct in-depth comprehensive public credit evaluations. Combining these results with industry-specific credit evaluations, classify and categorize regulatory targets to implement differentiated supervision, thereby reasonably reducing the proportion and frequency of spot checks on honest and law-abiding enterprises.In accordance with the principle of “whoever imposes the penalty shall publicize it, and whoever includes an entity on a list shall facilitate its credit repair,” ensure the proper public disclosure of information regarding administrative penalties, the list of business entities with abnormal operations, and the list of entities with serious violations and loss of integrity, as well as the management of credit repair. 20. Strengthen supervision in key safety sectors. Implement comprehensive, full-chain supervision across all entities regarding matters involving production safety and public health and safety, such as vaccines, food and pharmaceuticals, hazardous chemicals, and special equipment. Strictly enforce the requirements that “whoever approves (or files for record) is responsible, whoever organizes is responsible, and whoever oversees is responsible,” and strengthen safety supervision of public safety activities and key sectors with high potential risks and significant social risks through graded and categorized approaches.Strengthen ecological and environmental supervision, continue to conduct quality inspections of pollution discharge permits, and establish a “single-permit” regulatory system for fixed pollution sources. (5) Enhance the quality and efficiency of public services. Adhering to a people-centered development philosophy, we will focus on the public’s concerns, aspirations, and worries to create an upgraded version of government services.

21. Standardize services at government service venues. Establish service counters for comprehensive consultation, general affairs, assistance and proxy services, “inter-provincial processing,” “intra-provincial processing,” and “feedback on unresolved matters” within government service centers, achieving full coverage of comprehensive service counters in government service centers by the end of the year. Except where space is limited or matters involve state secrets, all government service items should, in principle, be centralized for processing within government service centers.Strengthen the development of township (subdistrict) convenience service centers and village (community) convenience service stations. Provide parallel online and offline services, ensuring that applications are accepted and processed to the same standards regardless of whether they are submitted online or in person. 22. Continue to advance the integrated handling of government service matters. Focusing on the full life cycle of enterprises—from establishment to dissolution—and individuals—from birth to death—promote the integrated handling of multiple cross-departmental and cross-level government service matters that are highly interrelated, in high demand, and provide a strong sense of benefit to enterprises and the public. 23. Deepen the implementation of “inter-provincial” and “intra-provincial” government service processing. Building upon the national list of “inter-provincial” service items, focus on the high-frequency service needs of migrant workers from our province—including housing, employment, marriage, childbirth, children’s school enrollment, social security, and pension—and proactively coordinate with relevant provinces and cities to promote “inter-provincial” processing.Achieve near-universal “intra-provincial processing” for high-frequency government service matters. Promote the province-wide implementation of services such as “inter-provincial processing” for household registration transfers and the issuance of household registration certificates. Accelerate the online “intra-provincial processing” of public medical insurance service matters across the province. Promote “intra-provincial processing” and “inter-provincial processing” for the issuance of disability certificates and the online verification of proportional employment of persons with disabilities. 24. Promote the implementation of more public convenience measures. Encourage government service centers to offer extended and flexible service hours. Promote 24-hour self-service options and expand the deployment of integrated self-service terminals to villages (communities), industrial parks, shopping malls, office buildings, and locations such as banks, post offices, and telecommunications service points. Advance the full self-service processing of more administrative matters to achieve the goal of “handling government services nearby and right at your doorstep.”Promote the delegation of government service matters in areas such as public education, labor and employment, social security, healthcare, elderly care services, social services, and household registration—which are frequently handled by the public and can be effectively managed at the grassroots level—to community service centers (stations) through methods such as delegated acceptance, authorized processing, and assistance or proxy services.(Lead Agencies: General Office of the Provincial Government [Provincial Big Data Administration], Provincial Big Data Center; Responsible Agencies: Municipal and Prefectural Governments, Lanzhou New Area Administrative Committee, relevant provincial departments, and relevant central government units in Gansu)

25. Optimize services for special groups. Combine traditional service methods with innovative smart services, accelerate the aging-friendly and barrier-free upgrades of various government service platforms, and provide application services such as large-print and voice versions for special groups including the elderly and people with disabilities. 26. Improve the “Good or Bad Evaluation” system for government services. Fully implement the “Good or Bad Evaluation” system across government service agencies at all levels, government service platforms, and government service hotlines. Establish a government service evaluation mechanism that seamlessly integrates evaluation, rectification, feedback, and supervision throughout the entire process, ensuring that “the quality of government services is determined by businesses and the public.”(Lead Agency: Provincial Big Data Center; Responsible Agencies: Municipal and Prefectural Governments, Lanzhou New Area Administrative Committee, Relevant Provincial Departments, and Relevant Central Government Units in Gansu)

III. Support Measures

(1) Strengthen Coordination and Oversight. The offices of the leading groups for deepening the “streamlining administration, delegating power, and improving government services” reform and promoting the transformation of government functions at all levels shall play a leading and coordinating role, promptly submitting major issues to the leading groups for study and resolution. Lead units for key tasks shall earnestly assume responsibility and coordinate with local governments and relevant departments to form a concerted effort; relevant responsible units shall actively cooperate and, in accordance with their respective duties, ensure the implementation and effectiveness of all reform measures.All localities and departments shall report their annual progress on deepening the “Delegation, Regulation, and Service” reform and optimizing the business environment to the Provincial Government by early December 2022.

(2) Strictly Supervise Implementation. The Provincial Party Committee and Provincial Government have included the progress of deepening the "Delegation, Regulation, and Service" reform and optimizing the business environment in their annual supervision plan. All localities and departments must fully leverage the "12345" government service hotline, the government service "Good or Bad Evaluation" system, and the "Internet Plus Supervision" system to improve mechanisms for addressing issues raised by enterprises and the public—ensuring immediate response and closed-loop rectification—effectively eliminating bottlenecks and difficulties in the reform process, and enhancing the quality and efficiency of the reform.

(3) Promote Exemplary Practices. All localities and departments must promptly summarize and promote effective experiences and practices in deepening the “streamlining administration, delegating power, and improving government services” reform to optimize the business environment. They should utilize mainstream media such as newspapers, radio, television, and the internet to strengthen publicity and guidance, fostering a favorable atmosphere for deepening reform and promoting development.
